HomeMy WebLinkAboutMinutes 11/19/1996 340.~ CITY COUNCIL MEETING Port Angeles, Washington November 19, 1996 CALL TO ORDER - Mayor Ostrowski called the regular meeting of the Port Angeles City Council to REGULAR MEETING: order at 7:00 p.m. ROLL CALL: Members Present: . Mayor Ostrowski, Councilmembers Braun, Doyle, Hulett, McKeown, and Wiggins. Members Absent: Councilman Campbell. Staff Present: Manager Pomeranz, Attorney Knutson, Clerk Upton, B. Becket, S. Brodhun, B. Collins, K. Godbey, S. Ilk, J. Pittis, B. Titus, and K. Ridout. Public P~esent: No one signed in. PLEDGE OF The Pledge of Allegiance to the Flag was led by Mayor Ostrowski. ALLEGIANCE: APPROVAL OF Councilman Braun moved to approve the minutes of the special meeting of MINUTES: November 4, 1996. Councilmember McKeown seconded the motion, which carried by a majority vote, with Councilman Wiggins abstaining due to absence from the meeting. Councilmember McKeown moved to approve the minutes of the regular meeting of November 5, 1996. Councilman Hulett seconded the motion. Councilman Hulett asked to have Page 4 of the minutes corrected to read '...Councilman Hulett advised Mr. Olsen that a rezone request cannot be project specific.' A vote was taken on the motion, which carried by a majority vote, with Councilman Wiggins abstaining due to absence from the meeting. CEREMONIAL None. MATTERS/ PROCLAMATIONS: FINANCE: None. CONSENT AGENDA: Councilman Braun moved to accept the Consent Agenda, including: 1) Payroll - November 3, 1996 - $352,211.23; and 2) Voucher list - November 15, 1996 - $427,450.80. Councilman Wiggins seconded the motion. Following brief discussion, a vote was taken on the motion, which carried unanimously. · ITEMS FROM THE Bob Wagner, a resident living on West Sixth Street, suggested the City of Port AUDIENCE/COUNCIL/ Angeles look into a new zero pollution energy system. It would involve putting STAFF TO BE electric engines and fuel cells into City buses, plus starting a hydrogen facility. CONSIDERED OR Mayor Ostrowski referred Mr. Wagner to staff in the Public Works and Utilities PLACED ON A Department for discussion of this issue, and thanked him for showing interest in the FUTURE AGENDA: City's future. Councilman Braun asked to add an item D.4. to report on his trip to Victoria, BC. Mayor Ostrowski added item D.5, a letter from the Friends of the Marine Lab. PUBLIC HEARINGS: I. 1997 City of Port Angeles Budget 1997 Budget Mayor Ostrowski stated that the Council had been briefed on the 1997 proposed Budget this past evening. He opened the public hearing at 7:10 p.m. There was no public testimony, and the public hearing was closed at 7:11 p.m. -1- 3405 CITY COUNCIL MEETING November 19, 1996 LEGISLATION: A. Ordinances not Requiring Public Hearings Forfeited Firearms - 1. Authorization of Disposition of Forfeited Firearms Ordinance No. 2936 Mayor Ostrowski reviewed the information provided by the Police Department and read the Ordinance by title, entitled ORDINANCE NO. 2936 AN ORDINANCE of the City of Port Angeles, Washington, providing for the destruction, retention, auction, sale or trade of forfeited firearms and amending Ordinance 2447 as amended and Chapter 9.42 of the Port Angeles Municipal Code. Councilman Wiggins moved to adopt the Ordinance as read by title. Councilman Braun seconded the motion. Attorney Knutson asked that Section 1, Subsection B of the Ordinance be changed as follows: ' .by ~'~^-';-~ by .~c ...... followin£ the procedures set forth in RCW 9.41.098." The change was agreed to by the maker and seconder of the motion. After brief discussion, a vote was taken on the motion, which carried unanimously. Model Traffic Ordinance - 2. Washington Model Traffic Ordinance Ordinance No. 2937 Mayor Ostrowski reviewed the information provided by the City Attorney's office and read the Ordinance by title, entitled ORDINANCE NO. 2937 AN ORDINANCE of the City of Port Angeles, Washington, adopting the Washington Model Traffic Ordinance (MTO) as contained in the Washington Administrative Code, Ch. 308-330 WAC, to regulate traffic in the City of Port Angeles and amending Chapter 10.04 of the Port Angeles Municipal Code by repealing Ordinance 2443 and Ordinance 2133. Councilman Doyle moved to adopt the Ordinance as read by title. Councilman Hulett seconded the motion. Councilman Doyle asked for clarification of the purpose of the Ordinance, which was provided by Attorney Knutson. A vote was taken on the motion, which carried unanimously. Industrial Development B. Resolutions not Requiring Public Hearings Bonds for Admiral Marine Resolution No. 22-96 1. Resolution Approving Port's Issuance of Industrial Development Bonds for Admiral Marine Mayor Ostrowski reviewed the information provided by the City Attorney and read the Resolution by title, entitled RESOLUTION NO. 22-96 A RESOLUTION of the City Council of the City of Port Angeles, Washington, approving the issuance of nonrecourse revenue 'bonds of The Industrial Development Corporation o~: the Port of Port Angeles for the benefit of Admiral Marine Works, Inc., and Buildings Plus, Inc., pursuant to RCW 39.84.060. Councilman Braun moved to pass the Resolution as read by title. Councilmember McKeown seconded the motion. Attorney Knutson explained the Resolution and informed the Council that the City would not be responsible for payment if bonds are defaulted. Bill James of the Port clarified several issues relating to the Resolution and explained that the City is the planning jurisdiction which must be made aware of the bonds via this Resolution. He further clarified for Councilman Braun that there is a trustee who is charged with making the payments in the event of default. In this particular instance, the transaction is totally between Admiral Marine and Key Bank. A vote was taken on the motion, which carried unanimously. C. Consideration of Findings and Conclusions for Denial of the Ralston Rezone Findings & Conclusions (Continued from November 5, 1996.) Supporting Ralston Rezone Mayor Ostrowski reviewed the information provided by the Planning Department. Councilman Wiggins asked to be excused from the proceedings, as he was not present at the November 5, 1996, meeting. Councilman Braun moved to support denial of the Ralston rezone by citing Findings 1 - 13 and Conclusions A - C, as set forth in Exhibit 'A", which is attached to and becomes a part of these minutes. Councilmember McKeown seconded the motion, which carried by a majority vote, with Councilman Wiggins abstaining. Ecological Study of 2. Agreement with U.S. Department of Agriculture for Ecological Study of the Landfill Landfill Mayor Ostrowski reviewed the information provided by the Public Works Department and invited Public Works Director Pittis to comment. Director Pittis gave a brief history of the ecological problems associated with the landfill, and he explained the need to now have a study performed. It is hoped the life of the landfill can be extended, and this study will address that possibility. A brief discussion followed, and Director Pittis offered further clarification of several issues. Councilman Wiggins moved to authorize the Public Works Department to enter into an agreement, approved by the City Attorney, with the U.S. Department of Agriculture for an ecological study at a cost not to exceed $22,378. Councilman Doyle seconded the motion, which carried unanimously. Agreement with 3. Agreement with Bonny's Bakery Bonny's Bakery Mayor Ostrowski reviewed the information provided by the Public Works Department. Ken Ridout, Deputy Director of Public Works, informed the Council that there were a few items in the lease that needed to be changed. Mr. Ridout has rewritten the lease and will meet with Mr. Ed Kelly, co-owner of the bakery, to review the changes and resolve any outstanding issues. Manager Pomeranz asked the Council to hold a special meeting Friday, November 22, 1996, at 1:30 p.m. to complete the negotiations. This was agreed to by the Council. Report from Councilman 4. Report from Councilman Braun Re: Victoria Remembrance Day Celebration Braun on Victoria Trip Councilman Braun represented the City of Port Angeles at the Victoria B.C. Remembrance Day celebration. There were 5,000+ people in attendance for the ceremony which took place at the Soldiers' Memorial. Mayor Ostrowski' noted that the Veteran's Day celebration held at the Coast Guard base was also well attended and very memorable. Letter from Friends of the 5. Letter from Friends of the Marine Lab Marine Lab Mayor Ostrowski read a letter from the Friends of the Marine Lab in support of the Valley Creek Estuary. Mayor Ostrowski reported on his and Manager Pomeranz's meeting with the K-Ply Board of Directors. The local K-Ply mill is doing well and employs 200 people. They are looking for possible expansion and were pleased with the reception given them by the City. Councilman Wiggins felt it would be helpful if the Council toured the facility to better understand the need to fill the K-Ply pond. The request is to rezone 4.4 acres from RS-7 and RS-9 to RMD south of Park Avenue and west of Porter Street in Lots 1-4 and the south 220 feet of Lot 5, Highland Acre Tracts. 2. The Comprehensive Plan designates the site as Low Density Residential and at the margin of Medium Density Residential. A number of policies have been identified as being most relevant to the proposal including Land Use Element Policies A 1 and 2 and C 1-4. 3. The zoning on surrounding properties is RS-9 to the south and west, RMD to the north, and PBP to the east. 4. The site is currently vacant or in pasture. 5. Lots 1-4 of the subject rezone site were rezoned from RS-9, Residential Single Family, to RS-7, Residential Single Family, in 1993. 6. The City adopted a new Comprehensive Plan in 1994 and amended it in 1995 and 1996. 7. The City adopted revised Areawide Zoning in 1995. 8. The requirements of the State Environmental Policy Act have been met with the issuance of a Determination of Non-Significance and the adoption of existing environmental documents on September 27, 1996. 9. Park Avenue is a principal arterial, and Porter Street is a collector arterial. 10. Nineteen letters in opposition to the rezone were received prior to the November 5, 1996, City Council public hearing. 11. Written and oral testimony was received by the City Council about severe " stormwater drainage and traffic problems in the area of the subject site. 12. Written and oral testimony was received by the City Council to the effect that the area is saturated with multi-family housing and that there is vacant land available which is zoned for multi-family housing. 13. Written and oral testimony was received by the City Council that additional multi-family housing would adversely affect the character of the neighborhood. 3409 Conclusions: A. The rezone is not consistent with the Comprehensive Plan Land Use Map, which designates the subject site as primarily Low Density Residential (LDR), and the rezone should not be reconsidered without a revision on the Comprehensive Plan Land Use Map changing the LDR designation. B.. The 1993 rezone of the subject site to Residential Single Family (RS-7) already provides a transition of residential uses in the area and a sufficient mix of residential densities compared to other districts in the City. C. The rezone is not in the public use and interest and is not compatible with the surrounding zoning and land uses, which have formed a stable neighborhood and should not be quickly revised following the 1993 rezone and 1995 Comprehensive Plan land use designations. ~by~es City Council at its meeting of November 19, 1996. _ P~e/Ostrowski, Mayor- Becky J.
