CITY COUNCIL MEETING
Port Angeles, Washington
November 29, 1979
I CALL TO ORDER
The special meeting was called to ordex by Mayor Haguewood at 7:00 P.M.
The purpose of this meeting is to consider the ordinance governing sidewalk
obstructions, revision of the proposed business license ordinance, and a
proposed banquet license for Roosevelt gym.

1. SIDEWALK OBSTRUCTIONS
Attorney Miller briefly reviewed his memorandum to the Council dated September
7, 1979 in which he placed all sidewalk obstructions which presently exist on
City streets into two categories: (a) obstructions placed by the City, in-
cluding garbage cans, planters, regulatory signs, and benches; and (b) pri-
vately placed obstructions, including sandwich signs, newspaper dispensers,
private flower planters, other forms of advertisement, stairways, fire excapes,
private garbage cans, and merchandise. While the present ordinances are not
specific concerning publicly placed obstructions, they are probably lawful,
as a use of the public way by the public entity charged with regulata.on of
their use, for a public purpose. However, the second type of uses of the
City's sidewalks are all presently banned by the various provisions of
Chapter 11.12 of the City Code. Attorney Miller requested the Council con-
sider whether an amendment to the Code would be appropriate to allow certain
of the minor, secondary uses of sidewalks to occur, in addition to an amend-
ment to the ordinance to specifically delineate that there is authority on
behalf of the City to place the public obstructions referred to onto the
public sidewalks.
The Council discussed Attorney Miller's suggestions at length, and commented
on needed beautification of the downtown area, and use of the sidewalks for
minor, secondary purposes, i.e. sidewalk sales, newspaper stands, etc. through
a City permit, with final approval of the permit by perhaps the City Manager,
Police Chief, or Public Works Director. Mayor Haguewood then directed Attorney
Miller to draft an amendment to the present ordinances, keeping the Council's
suggestions and comments in mind, and submit the proposed amendments to the
Council for their consideration at a later date.
2. REVISION OF PROPOSED BOSINESS LICENSE ORDINANCE
The next agenda item to be discussed by the Council was revisions to the
proposed business license ordinance. During the special Council meeting of
September 26, 1979, the Council indefinitly tabled a proposed business license
ordinance which 'would license ail business activity within the City. However,
Attorney Miller was directed to revise Chapter One of the proposed ordinance,
which would continue the licensing of those businesses which are presently
licensed by the City. This revision continues the requirement that there be
a €ee for the licensing of these businesses, but establishes a flat fee of
$25 for them rather than the present system of varying and cumulative fees.
This revision also proposed that only one business license should be required
for any business requiring a license, and that indications be made upon that
single license for the various types of business for which the particular
license is issued. The remainder of the proposed ordinance, consisting of
Chapters 2 through 16 would need to remain essentially unchanged.

During this meeting Mayor Haguewood referred to a memorandum from Attorney
Miller explaining the proposed revisions to the business license ordinance,
and a memorandum from Finance Director Orton explaining the impacts of the
proposed ordinance. One such impact, Mr. Orton pointed out, would be a loss
in license revenue of $3,800 annually. However, the ordinance will be much
more equitable, especially to those firms whose fees were out of proportion
to a reasonable charge.
The Council, Attorney Miller, and Finance Director Orton then discussed the
proposed business license ordinance revisions at length, with several Council-
members expressing their satisfaction with the revisions. Also discussed was
the need for regulation of new businesses and protection of existing businesses
within the City in the event of rapid growth; the loss in license revenue as
a result of these revisions, and the cost to the City to issue the licenses.
Attorney Miller then advised the Council that Chapters 2 through 16 of the
proposed ordinance still need to be slightly amended to conform with Chapter
One, and he will submit the final draft at the December 18th Council meeting.
3. ROOSEVELT GYMNASIUM BANQUET LICENSE
Mayor Haguewood read a memorandum from Parks Director Frizzell concerning
the use of liquor in the Roosevelt gym. In 1975, the City adopted an ordi-
nance prohibiting the consumption of liquor within the total park system.
However, several inquiries have been made in regard to permitting liquor
consumption in the gym only, since plans have been made to convert it
into a multi-purpose convention center.
During discussion of Park Director Frizzell's memorandum, Councilmen Buck and
Wray voiced their opposition to liquor being allowed in the gym, or any park
facility. The Council, Acting Manager Flodstrom, and Parks Director Frizzell
then discussed certain advantages and disadvantages of allowing liquor in
the gymnasium, some of which included increased facility clean-up and main-
tenance, facility desirability if liquor is allowed and the need to attract
tourism to the City, traffic problems in the area and whether a convention
center would compound the problem, and use of liquor at the convention center
during swimming pool hours. Mayor Haguewood then noted that additional in-
formation and input is needed from the Chamber of Commerce and perhaps other
cities with convention centers before any decisions are made, and continued
any further discussion on the matter until the next regular Council meeting.
VI LATE ITEMS
Clallam County Commissioner Harry Lydiard was present at this meeting to inform
the Council that certain County offices will be moving into the new Courthouse
on Monday, December 3rd, and a formal dedication will take place in March, 1980.
