WHEREAS, the City of Port Angeles, acting through its duly constituted legislative authority, did by resolution adopt certain personnel rules and regulations enumerated as Resolution No.8-58; and WHEREAS, conditions have changed and it appears desir. able and to the best interest of the City and its employees to make certain changes and additions a6 hereinafter set forth, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES that said Resolution No.8-58 is amended to read as follows: SECTION III, entitled "Sick Leave With Pay" is amended to read: Sick leave with pay shall be granted by appointing authorities at the rate of one work day for each calendar month of service. Sick leave shall not be considered as a privilege which the employee may use at his discretion, but shall be only used in the case of necessity and actual sickness or dis- ability. Unused sick leave shall be accumulated at the rate of twelve days a year and all twelve days can be accumulated if not used to a total of not more than 120 work days. In order to receive compensation while absent on such leave, the employee must see that proper notification is given his immediate superior of his illness within four hours after the time set tor beginning his daily duties, or asnay be specified by the head of his department. When absence i8 for more than three work days, the employee shall file a personal affidavit or a physician's certificate with the head of the department stat- ing the cause of the absence. No accumulated sick leave may - - ...J t"--=- be used except in case of actual sickness. Sick leave with pay ehall be granted for one of the following reasons, where the facts are established to the satisfaction of the head of the deparment. (1) Because of, and during, illness or injury incapa- citating the employee to perform his duties. (2) By reason of exposure to contagious disease dur- ing such period as his attendance on duty would jeopardize the health 'of fellow workers or the public, or (3) Because of illness or death in the immediate familY,requiring the attendance of the employee. (4) In the case of maternity leave. For the purpose of subsection (3) of Section III, wimmediate familyft shall include only persons related by blood or marriage or legal adoption in the degree of consanquinity of which includes grandparents, parent, wife, husband, brother, ~i8ter, child, or grandchild; and any relative living in the employee's household. Leave for such reason shall be limited to three (3) days in anyone instanca. In cases of absence arising by reason of injury to an employee in line of duty, except when covered by industrial in- surance,. or by reason of illness from contagious or infectious diseases clearly contracted in the line of duty where the em- ployeeta occupation is such as to require exposures to known cases of such contagious or infectious disease, the head of the department may extend the sick leave provided for in these rules. SECTION V, entitled "Holiday Leave" is amended to read: Any employee required to work on a legal holiday, as establi~hed by ordinance, excepting Sundays, shall be entitled to one day holiday within the week immediately following such holiday worki provided, however, that this shall apply in such -2- .1t "'" to.. -- .oJ instances where the employee's holiday work has taken place continuously between the hours of 8:00 A.M. and 5:00 P.M. Whenever any legal hOliday, other than Sunday, falls on Sunday, this section shall apply. This section shall not apply to em- ployees who receive 'additional compensation for holiday work. All employees shall be entitled to receive those holidays established by ordinance except if and when they fall on a Satur~aYt If and when the holiday falls on a Saturday, then no compensating time or extra pay will be granted. Pro- vided further, if the holiday falls on a Sunday, then the following Monday shall be observed as the legal holiday. Provided further, with respeat to the Police and Fire Departments, pay will be given instead of compensating time on five hOlidays, and the department head of each department shall in his discretion fix these five holidays. On these five holi- days, policemen or firemen should have the choice of getting compensatory time off or being paid. The policemen would be paid for an eight hour day and the firemen for a twelve hour day. On all other holidays the policemen or firemen would be required to take time off ae they have in the past. The actual time of taking the compensatory time shall be left to the dis- cretion of the department head. BE IT FURTHER RESOLVED, there shall be added to Resolu- tion No.8-58 a new section designated as follows: SECTION XIII. Nonpayment of Debts. Nonpayment of just debts by City employees, or garnishments against them. may be ~ cause for disciplinary action or termination. of employment.
