A RESOLUTION of the City Council of Port
Angeles, washington, designating The
Daily News as the official newspaper
of the City of Port Angeles.

WHEREAS, Senate Bill 3800 requires every city and town
to designate an official newspaper by resolution; and
WHEREAS, The Daily News has been awarded the bid for
official printing for 1986; and
WHEREAS, The Daily News has been published regularly,
Sunday through Friday, for the preceding six months and in the
English language and is of general circulation; and
WHEREAS, The Daily News is compiled in whole in an
office maintained in the City of Port Angeles, as specified in
RCW 65.16.020;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Port Angeles as follows:
Section 1. The Daily News is hereby designated as the
official newspaper of the City of Port Angeles.
PASSED by the City Council of the City of Port Angeles,
at a regular meeting of said Council held on the 21st day of
January, 1986.

RE: Award of Bids for Legal Publication and Designation of
Official Newspaper
ISSUE: Shall the City accept the legal advertising bid proposal of the
Port Angeles Daily News; and designate the Daily News as the official
newspaper of the City?
BACKGROUND: State statute requires that we bid out printing and
publication requirements for the City and further, that the City designate
an official newspaper by resolution (Chapter 35A.65 RCW and Section 102 of
SB 3800, amending Chapter 35A.65 RCW).
Considering that a good deal of our publications are legal publications of
ordinances, public hearing notices, etc., State statute (Chapter 65.16 RCW)
specifies the qualifications for a legal newspaper. These are:
1. That the newspaper be published at least once per week.
2. That the paper be of general circulation.
3. That it be written in the English language.
4. That the paper hold a second class mail permit.
5. That the issue be compiled in whole in an office at the place of
publication.
6. And that the content of the news be of general interest, as opposed to
a specific group or special interest.

ANALYSIS: We called for bids on January 3rd and January 6, 1986, for legal
publication advertising rates. Both local newspapers were invited to
participate. The City received only one bid and that from the. Port Angeles
Daily News.
This company bid a rate of $4.19 per column inch for first publications and
a rate of $3.14 per column inch for subsequent insertions. In the 1985
period, the newspaper charged us $4.01 per inch for first publications and
$3 per inch for subsequent insertions.
As to the designation of one newspaper as the official newspaper of the
City, there doesn't seem to be anything in the statutes that suggests
criteria for deciding between two companies who at least appear to meet the
legal qualifications specified above. In this instance, it appears that

the City is free to establish its own criteria for selection. In my
opinion, such criteria could include the cost of advertising in one paper
versus the other, the extent of circulation (on the premise that greater
local circulation would reach more of the public), or time factors involved
in publication of legal notices to reach the public in a timely manner.

In the present case, cost seems to be the most obvious decision criterion,
inasmuch as only one bid was received from the two local newspapers.
RECOMMENDATION: Two separate actions seem appropriate in this matter.
First, I recommend that the Council accept the legal advertising bid
proposal submitted by the Port Angeles Daily News and dated January 6,
1986, at $4.19 per column inch for first publications and $3.14 per column
inch for subsequent insertions.
Secondly, I recommend that the City Council designate the Daily News as the
official newspaper of the City and approve the attached Resolution which
makes this appointment.

Pursuant to your published call for public printing bids to be
opened Jan. 13, 1986, we submit the following bid for public
printing for legal publications for the year 1986.
Prices quoted are for single column legals based on (8) columns
to the page and are conditional on copy reaching our office not
later than 2 p.m. two days prior to publication, except in the
case when the publication is Sunday or Monday, then the
deadline is 2 p.m. on the Thursday before. When publications
are unusually long, proportionately longer time is required.
First publications will be $4.19 per column inch. Subsequent
insertions will be $3.14 per column inch.
