RESOLUTION NO. /, -t.3
A RESOLUTION authorizing the commencement, investiga-
tion and prosecution of damage action for violation
of anti-trust statutes and principles, employing
counsel therefor, authorizing joinder with others,
and the payment of a proportionate share of the
costs of such litigation.
WHEREAS, the City of Port Angeles has, since January 1,
1950, purchased directly or through contractors products and
equipment and other materials from various suppliers of elec-
trical equipment, inCluding one or more of the companies here-
inafter described, said purchases aggregate a substantiU valu-
ation, and the City having been informed and having reason to
believe that one or more of the said suppliers or manufacturers
of such products, equipment and materials have engaged in com-
bination and conspiracy in unreasonable restraint of trade in
violation of Federal anti-trust legislation, including provi-
sions of the Sherman Act and/or the Clayton Act, and the City
having been injured and damaged in its business and property
by reason thereof and believing that the City has a cause of
action or causes of action against one or more or all of said
manufacturers and/or suppliers of the said products, material
or equipment so purchased for damages, including triple damages,
costs and attorneyst fees; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ANGELES, WASHINGTON:
Section 1. Houghton, Cluck, Coughlin and Schubat,
attorneys, Seattle, Washington, are hereby authorized and di-
rected to proceed with due diligence to investigate, commence
and prosecute to final conclusion an action or actions against
any or all of the following persons or parties:

Ohio Brass Co.
Lapp Insulator Co.
The Porcelain Insulator Corp.
A. B. Chance Co.
H. K. Porter Co.
Hubbard & Co.
Joslyn Manufacturing and Supply Co.
Southern States Equipment Co.
and such other or further persons or companies as may appear
responsible, in the discretion of said attorneys and the City
Attorney for the recovery of damages and costs and attorneys'
fees suffered by the City of Port Angeles arising out of any
activities or violation of anti-trust principles or from con-
spiracy or combination in restraint of trade, and related
activities in such manner as said attorneys shall determine
to be proper.
Section 2. Said attorneys are further authorized to
commence and prosecute said action, either separately or jointly
with the State of Washington acting through the Attorney General,
and/or other political subdivisions or municipal corporations
as the attorneys may determine to be proper.
Section 3. In the event of joint activities with others
in the prosecution of such litigation, the City shall pay a
proportionate cost thereof in such an amount and ratio as may
be negotiated by the attorneys with the approval of the Coun-
cil of the City of Port Angeles.
