WHEREAS, the City of Port Angeles is an intervenor party ~ 4 in the application for site certification In the application of the 5 Trans Mountain Oil Pipe Line Corporation to the Washington State 6 Energy Facility Site Evaluation Council, Application No. 79-1; and 7 WHEREAS, representation of the City will require an 8 extensive amount of time, but must be of the highest quality; and 9 WHEREAS, Clallam County, another intervenor party in 10 the application process, has interests which are substantially 11 similar to the interests of the City of Port Angeles in the pro- 12 ceedings; and 13 WHEREAS, Clallam County will also be represented by 14 counsel at the proceedings; and 15 WHEREAS, in the interests of efficiency and consistency, 16 it would be beneficial to both the City and County for each others 17 counsel to be able to represent the other on certain matters and 18 at certain times; and 19 ~fHEREAS, however, it is the intent that primary respon- 20 sibility for representation of the City shall remain with the 21 city attorney's office; now therefore, 22 BE IT RESOLVED BY THE CITY COUNCIL OP THE CITY OF PORT 23 ANGELES, as follows: 24 Section 1. That Craig D. Knutson, Cla11am County ~ 25 Deputy Prosecuting Attorney, is hereby appointed a special 26 assistant city attorney, for the purpose of representation of the 27 City of Port Angeles in regard to the Trans Mountain Oil Pipe Line 28 Corporation application to the Energy Facility Site Evaluation 29 Council, Application No. 79-1, subj ect to the fOllowing conditions: 30 (A) Authorization for Craig D. Knutson to act as a special 31 assistant city attorney shall be obtained from the Port Angeles 32 / . , e e 1 City Attorney upon each instance that such authorization is 2 determined by the Port Angeles City Attorney to be necessary and 3 expedi tious . 4 (B) The existence of this specific authorization for repre- 5 sentation upon a particular subject matter or the particular time 6 shall be placed upon the record before the Energy Facility Site 7 Evaluation Council, or its administrative law judge, by the 8 special assistant city attorney, before the subject matter of the 9 authorization is encountered or discussed. 10 (C) The authority and responsibility for representation of 11 the City of Port Angeles remains with the Port Angeles City 12 Attorney, and any authorization granted to the special assistant 13 city attorney shall be subject to such responsibility and author- 14 ity. 15 (D) If, for any reason, there is a conflict of interest 16 involved in any proposed or existing authorization, then the 17 authority for such representation of the City in the special 18 assistant city attorney shall cease immediately. 19 (E) The Port Angeles City Council hereby waives all possible 20 allegations of conflict of interest arising from dual representa- 21 tion by the special assistant city attorney in this matter, 22 provided that all of the stipulations herein contained are fully 23 observed. 24 (F) This appointment of a special assistant city attorney 25 is terminable at will by the Port Angeles City Attorney upon at 26 least five (5) days notice to the other party.
