HomeMy WebLinkAbout07-86 }\ - I RESOLUTION NO. 0 r"f- ~~ A RESOLUTION of the City Council of the City of Port Angeles, Washington, declaring the necessity for recon- struction of sidewalks for the public convenience and safety. WHEREAS, the sidewalk at the following described location has become unfit or unsafe for purposes of public travel: On 4th Street adjacent to Lot 16, Block 71 or the Townsite of Port Angeles, commonly known as 217 West 4th Street; and WHEREAS, the streets at both ends of said areas are improved by sidewalks in good repair; and WHEREAS, RCW 35.69.020 provides that under these 'circumstances, if the City Council finds by resolution that the reconstruction of the sidewalks is necessary for the public safety and convenience, then the duty, burden and expense of reconstructing~ such sidewalks shall devolve upon the abutting property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES, WASHINGTON, as follows: Section 1. It is hereby declared that the improvement of the sidewalks abutting the locations listed above are neces- sary for the public safety and convenience. Section 2. Notice shall be served on the owners of the properties directly abutting on such portions of such streets, instructing them to construct or reconstruct sidewalks on such portions in accordance with the plans and specifications which shall be attached to said notice. Section 3. Said notice shall specify that in the event of the failure of the owners to correct such conditions with~n -1- - I thirty (30) days of the date of the service of the notice on the owners, the same will be corrected by the City, through the Pub- lic Works Department, at the expense of such owner or occupants, and the cost thereof shall be and remain a lien upon such premises until paid. Section 4. Said notice shall also specify that the Public Works Department shall report to the City Council at the Council's regular meeting on April 15, 1986, an assessment roll showing the lots or parcels of land directly abutting on such portions of the streets so improved, the cost of the improvements and the names of the owners, if known, and that the City Council at the time stated in the notice or at the time or times to which the same may be adjourned, will hear any and all protests against the proposed assessment. Section 5. The Director of the Public Works Department shall forthwith cause a notice to be served on the owners of the properties in the manner as described in RCW 35.69.030.
