HomeMy WebLinkAbout09-93 RESOLUTION NO. 9-93 A RESOLUTION of the City Council of the city of Port Angeles, Washington, declaring an emergency, dispensing with the requirement of calling for bids for the repair of a broken watermain, and authorizing the City Manager to sign the necessary contracts. WHEREAS, RCW 35.23.352 requires the City to call for bids for any public work project in excess of $30,000, if more than one craft or trade is involved, or $20,000, if a single craft or trade is involved; and WHEREAS, the law allows for the bid requirement to be dispensed with where it is essential to the health, safety or welfare of the people that immediate action be taken, provided that the emergency is present, immediate and existing, and not a condition which may or may not arise in the future, or a condition which reasonably may be foreseen in time to advertise for bids; and WHEREAS, the 20-inch watermain east of the Peabody Heights Reservoir broke shortly before 12:30 a.m. on January 27, 1993, and had to be repaired as soon as possible in order to provide for the health, safety and welfare of the citizens of Port Angeles; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Angeles as follows: Section 1. It is hereby declared that the repair of the 20-inch watermain east of the Peabody Heights Reservoir is essential to the health, safety and welfare of the citizens of Port Angeles and is an emergency necessitating that the requirement of formal bidding be dispensed with. Section 2. The Public Works Department is authorized and directed to provide for the repair of the watermain as soon as possible without complying with the formal bid requirements, such as advertising for competitive bids, and instead obtaining the necessary engineering and construction assistance in the most expedient fashion, yet obtaining the lowest possible price through negotiation. -1- Section 3. The City Manager is authorized and directed to execute the necessary contracts to accomplish the emergency watermain repair work. Section 4. The City Clerk shall publish a description and estimate of the public works project within seven (7) days after the commencement of the work. PASSED by the city Council of the City of Port Angeles at a regular meeting of said Council held on the 2nd day of February, 1993. ~~c~/ ATTEST: Ci~ -C~i e r-k APPRO~D~AS TO FORM: Craig D. ~/utson, City Attorney -2- NOTICE OF EMERGENCY REPAIRS FOR WATERMAIN BREAK NOTICE IS HEREBY GIVEN that the City Council of the City of Port Angeles, at its meeting of February 2, 1993, passed Resolution No. 9-93 declaring an emergency and dispensing with the requirement of calling for bids for the repair of a broken watermain east of the Peabody Heights Reservoir. The project involves the repair of approximately 150 feet of 20 inch watermain and will include the placement of a valve and replacement pipe in the area of the break.
