HomeMy WebLinkAbout13-12RESOLUTION NO. 13-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT ANGELES, CLALLAM COUNTY, WASHINGTON, ACCEPTING THE PROPOSED SHORELINE MASTER PROGRAM UPDATE AND DIRECTING ITS SUBMITTAL TO THE WASHINGTON STATE DEPARTMENT OF ECOLOGY WHEREAS, The State of Washington Shoreline Management Act (Chapter 90.58 RC W) declares that shorelines of the state are among the most valuable and fragile of our natural resources; and WHEREAS, the Shoreline Management Act (Act) requires local governments to prepare, and the State to adopt, Shoreline Master Programs (SMPs) for designated shorelines of the state; and WHEREAS, the City of Port Angeles (City) adopted a Shoreline Master Program in 1995; and WHEREAS, in 2003, Ecology adopted guidelines for review and update of shoreline master programs (WAC 173 -26) which require that all local jurisdictions review and periodically update their Shoreline Master Programs; and WHEREAS, the City began the process of updating its Shoreline Master Program with a City Council work session on October 20, 2009; and WHEREAS, The City of Port Angeles Planning Commission began review of the City's Shoreline Master Program on April 14, 2010, and continued to receive updates on the development of the SMP until June, 2012; and. WHEREAS, the City of Port Angeles established and Harbor Planning Committee in December of 2010, which Committee included representation from the following groups: City of Port Angeles Clallam County The Lower Elwha Klallam Tribe U. S. Coast Guard Washington State Department of Natural Resources The Puget Sound Partnership /Strait Ecosystem Recovery Network Washington State Department of Ecology 1 WHEREAS, the City established 3 Focus groups to provide specific expertise on Public access and recreation, Economic Development and Land Use, and the Environment and Ecology, which met on August 9, 2010; and WHEREAS, the City received public input through a website SMP update page, on- line survey, and four citywide open house meetings; and WHEREAS, the City developed a visioning document entitled the Harbor Resource Management Plan based on citizen input; and reports; WHEREAS, through the review process, the City developed the following technical Inventory, Characterization and Analysis Cumulative Impacts Analysis Restoration Plan WHEREAS, the City compiled existing studies, documents and plans pertinent to the City's shoreline to enhance the basis upon which decisions regarding the shoreline were made; and WHEREAS, the City issued a draft Shoreline Master Program in June of 2011, and WHEREAS, Ecology provided comment letters on September 1, 2010, April 1. 2011, June 28, 2011 (via e- mail), September 16, 2011, and November 17, 2011, suggesting technical edits and corrections; and WHEREAS, the City considered and responded to government agency and public comments and prepared and issued revised drafts of the Shoreline Master Program in March of 2012, April of 2012, and May of 2012; and WHEREAS, the proposed SMP recognizes private property rights and is intended to be consistent with other adopted land use regulations, and WHEREAS, the proposed SMP is compatible with the City's adopted land use designations, policies and goals contained within its Comprehensive Plan and its development regulations; and 2 WHEREAS, the City's SEPA Responsible Official issued a Determination of Non significance (DNS) on May 25, 2012, as required by the State Environmental Policy Act (SEPA) for amendment to the Shoreline Master Program; and WHEREAS, Shoreline Master Programs are a requirement of the State's Growth Management Act and the Washington State Department of Commerce (Commerce) requires a 60 -day notification of amendment to development regulations required under the Growth Management Act (RCW 36.70A.106) and said notification was provided to Commerce on May 31, 2012; and WHEREAS, a public hearing notice was posted in the Peninsula Daily News on April 15, 2012, and said meeting notice was placed on the City Hall reader board the week prior to the public hearing and on the City's web site; and WHEREAS, a duly noticed public hearing was held before the City of Port Angeles Planning Commission on April 25, 2012, and continued to May 9, 2012, with a special Planning Commission meeting held on May 30, 2012, to consider late comments; and WHEREAS, a duly noticed public hearing was conducted by the City Council on June 5, 2012 with action continued to June 19, 2012; and WHEREAS, public comments were received throughout the two year review process and all comments were reviewed and many, including those received during the public hearings and work sessions, were incorporated into the final document; and WHEREAS, once it is accepted by the City, the revised Shoreline Master Program must be submitted to the Washington State Department of Ecology along with a package of supporting documents per WAC 173 -26 -110 to enable final state approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES, WASHINGTON, to accept the revised Shoreline Master Program dated June 19, 2012, and its associated documents and direct that the revised Program be submitted to the Washington State Department of Ecology for its final approval.
