HomeMy WebLinkAbout21-96 RESOLUTION NO. 21 - 9 6 A RESOLUTION of the City Council of the City of Port Angeles, Washington, declaring the intention of the City Council to create a local improvement district and to order the improvement of a certain area within the City by doing sanitary sewer extensions and all other work necessary in connection therewith, and fixing a time, date, and place for a hearing on this resolution of intention. BE IT RESOLVED by the City Council of the City of Port Angeles, Washington, ~s follows: Section 1. Based upon the receipt of a petition approving the work, it is the .ntention of the City Council of the city of Port Angeles, Washington, to order the improvement )f that certain area described in Exhibit "A", by doing sanitary sewer extensions as shown in Exhibit "B", and all other work necessary in connection therewith. Section 2. The City Engineer is hereby directed to submit to the Council at or ~rior to the date fixed for the hearing on this Resolution, the following: 1. An estimate of the costs and expense of the proposed improvement; 2. All papers and information in his possession touching the proposed improvement; 3. A description of the boundaries of the district; 4. A statement of the portion of the cost and expense of the improvement which .hould be bome by the property within the proposed boundaries of the district; 5. A detailed statement setting out the outstanding and unpaid local improvement ~ssessments against the property in the proposed district; and 6. A statement of the aggregate actual valuation of the real estate in the district, including twenty-five percent of the actual valuation of the improvements in the proposed district, ~ccording to the valuation last placed upon it for the purposes of general taxation. Section 3. The City shall acquire by gift, pm'chase, franchise, lease or :ondemnation all property, both real and personal, or any interest therein and all rights-of-way, ~anchises, permits and easements which may be found necessary to acquire, construct, and install :he above-described improvements. 1 Section 4. It is hereby further provided that the hereinbefore authorized plan of improvements shall be subject to such changes as to details of said plan, not affecting the service Lo be provided by the plan of improvements, as shall be authorized by the Council either prior to ar during the actual course of construction. Section 5. The cost of improvements described in Section 1 and costs of interim ~otes and bonds shall be assessed against the property specifically benefited by such mprovements, on the basis of the amount of the special benefits to such property. The tssessments shall be for the sole purpose of payment into such local improvement district bond ~nd as may be specified by the City Council for the payment of local improvement district bonds :o be issued in part to defray the cost of such improvements. Section 6. Actual assessments may vary from assessment estimates so long as hey do not exceed a figure equal to the increased true and fair value the improvement adds to the >roperty. Section 7. All persons who desire to object to the formation of such improvement tistrict, are hereby notified to appear and present their objections at a meeting of the City Council to be held in the Council Chambers, 321 East Fifth Street, Port Angeles, Washington, at 7:00 P.M. on December 17, 1996. Section 8. The City Clerk and Engineer are hereby directed to prepare and give notice of such hearing in the following manners: 1. By publication of this Resolution in at least two consecutive weeks of the official newspaper of Port Angeles, with the last publication to be at least fifteen (15) days prior to December 17, 1996. 2. By giving notice by mail at least fifteen days before the day fixed for hearing to the owners or reputed owners of all lots, tracts, and parcels of land or other property to be specially benefitted by the proposed improvement, as shown on the rolls of the County Assessor, tirected to the address thereon shown, which notice shall set forth the nature of the proposed mprovement, the estimated costs, and the estimated benefits of the particular lot, tract, or parcel, 2 n accordance with the form marked as Exhibit "C", attached hereto and incorporated in this ~esolution by reference. EXHIBIT A LOC: n:~projecls OS-05h~nemos~legal2.des SANITARY SEWER INSTALLATION NARRATIVE All of the Local Improvement District area is currently served with on-site septic drain field systems. Many of these systems are failing and the proposed project will serve all of the properties with a new sanitary, sewer system which will be connected to the City's public sewer facilities. There will be four main sewer lines to be installed on this project. The preliminary design locations of these sanitary sewer lines are as follows: 1. This main line is an 8 inch line with approximately 8 manholes and will begin approximately 290 feet south of Woodhaven Lane along the east property line of Lot 2 of the Woodhaven Short Plat. The sewer line will run north approximately 950 feet to the NE sA line of the NE lA of Section 14, Township 30 North, Range 6, W.W.M., then to the east approximately 940 feet to Golf Course Road, then north approximately 330 feet to the to the intersection of Golf Course Road and Melody Lane, then west approximately 270 feet along Melody Lane, and then north approximately 50 north and connecting to an existing sewer line. 2. This main line is an 8 inch line with approximately 5 manholes and will begin approximately 200 feet west of Golf Course Road on Woodhaven Lane and running west on Woodhaven Lane approximately 590 feet to the SE comer of Lot 4 of the Peterson Short Plat, then north approximately 417 feet along the east property line of said lot, then along the north line of Lots 2, 3, & 4 of Peterson Short Plat approximately 350 feet and connecting to main line number 1. 3. This main line is an 8 inch line with approximately 5 manholes and will begin approximately 400 feet east of Golf Course Road on the north side of Maddock Road. The sewer line will run west to the intersection of Maddock Road and Golf Course Road, then north approximately 1300 feet along the west edge of Golf Course Road and connecting to main line number 1. 4. This main line is an 8 inch line with approximately 2 manholes and will begin connected to the main line number 1 on the east side of Golf Course Road at the intersection of Lindberg Road and running east approximately 400 feet along Lindberg Road along the south side. EXHIBIT B CITY OF PORT ANGELES NOTICE OF HEARING Resolution of Intention Upper Golf Course Road LID No. 215 NOTICE IS HEREBY GIVEN that the City of Port Angeles, Washington proposes to create a local improvement district and to order the improvement of the area generally known as Upper Golf Course Road LID 215 by installation of sanitary sewer, Melody Lane street improvements, and all work required in connection with said improvements in accordance with Resolution No. ~ of the City Council of the City of Port Angeles passed and approved on The total estimated cost of said improvement is approximately $357,418.50 all of which is proposed to be borne by assessments against the property within the proposed improvement district specially benefitted by said improvements. A public hearing on the proposed improvements will be held before the City Council in the City Council Chambers, City Hall, 321 East Fifth Street, Port Angeles, Washington at 7:00 p.m. on , 1996. Any person who may desire to file a written protest with the City Clerk should show on such protest the lot and block or other legal description of his property.
