A RESOLUTION of the City Council of the City of Port Angeles, Wasbington,
authorizing the regular property tax levy for 2010 at one hundred percent of
the 2009 regular property tax levy and declaring that the one percent levy
increase available for 2010 is banked for future use.
WHEREAS, pursuant to RCW 35A.33. l 35, the City Manager is required to provide the
City Council with current information on estimates of revenues from all sources, together with
estimates submitted by tbe Finance Director, for consideration of the City's total anticipated
financial requirements for the ensuing fiscal year, and the City Council is required to determine
and fix by ordinance the amount to be levied by ad valorem taxes; and
WHEREAS, the City Council has conducted public hearings on expected resources and
expenses for 2010; and
W HEREAS, after such hearings and after duly considering relevant evidence and factors,
the City Council, in Resolution No. 21-09, adopted October 6, 2009, made a finding that there
is substantial need under RCW 84.55.0101 and authorized a levy limit factor for the 2010
property tax levy of a one percent increase over the property tax levy for 2009, plus any amount
resulting from the addition ofnew construction, improvements to property, annexations, and any
increase in the value of state-assessed property and refunds made; and
WHEREAS, the City Council, after such hearings and after duly considering relevant
evidence and factors, also has determined that, due to the severe recession currently affecting the
local economy and the hardship that would be created by an increase in taxes, that the overall
best interests of the community require that the regular property tax levy for 2010 will be one
• hundred percent of the 2009 regular property tax levy— not one hundred one percent of the 2009

• regular property tax levy — plus any amount resulting from the addition of new construction,
improvements to property, annexations, and any increase in the value of state-assessed property
and refunds made,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Angeles that:
Section 1. A regular tax levy is hereby authorized for 2010. The dollar amount of
the regular tax levy for 2010 shall be one hundred percent of the City's 2009 regular property tax
levy amount, which is an increase of 0% and $0.00 from the 2009 regular property tax levy.
Section 2. The regular property tax levy for 2010 authorized in Section 1 above is
exclusive of revenue resulting from the addition of new construction, improvements to property,
annexations, any increase in the value of the state-assessed property, and refunds made.
Section 3. The City Council hereby ratifies and confirms its finding that tbere is
substantial need under RCW 84.55.0101 to increase its levy limit by one percent over the 2009
levy; and the City Council hereby ratifies and confums its authorization for a levy limit factor
for the 2010 property tax levy of a one percent increase over the property tax levy for 2009, p(us
any amount resulting from the addition of new construction, improvements to property,
annexations, and any increase in the value of state-assessed property and refunds made.
Section 4. For in the regular property tax levy to be collected in the 2010 tax year,
the City Council authorized an increase of one percent over the highest lawful levy for 2009.
Tbat one 1 percent increase equals an increase of $40,020.00 over the regular property tax levy
for 2009. The City Council has elected not to levy in 2010 any portion of available increase.

� Pursuant to RCW 84.55.092, the increase available for, but unused in, 2010 is banked and
protected for future levy capacity.
