A , ( of, ~N ~'4fo '\ 't!~ ~..Jo -80 .~ ~ ~j.. -.-, RESOLUTION NO. 3~- go A RESOLUTION of the City Council of the City of Port Angeles, Washington, authorizing the signing of an Interlocal Cooperation Agreement between the City and other municipalities on the North Olympic Peninsula for the purpose of sUbmitting a pre-application for community Development Block Grant funds. ~ - WHEREAS, the City Council of the City of Port Angeles recognrzes the need for improved community facilities, increased economic and housing opportunities for low and moderate income people, correcting health and safety deficiencies in public facilities and deconcentrated low income housing, and WHEREAS, the citizens of port Angeles have expressed an interest in meeting these needs, and WHEREAS, the Department of Housing and Urbah Development has financial aid available under the Small Cities Program of the Community Development Block Grant Program of 1978, now therefore, BE IT RESOLVED by the City Council of the City of Port Angeles to join Clallam County, the Town of Forks, Jefferson County, City of Port Townsend, and the City of Sequim, in the submission of an application for Small Cities Program, Community Development Block Grant funds. } ~ BE IT FURTHER RESOLVED that the City Council of the ~ty of Port Angeles will sign the Interlocal Cooperation Agreement necessary for submission of a joint application for Block Grant funds from the Department of Housing and Urban Development. INTERLOCAL COQPERATION AGREEMENT . THIS AGREEMENT is entered into this day of November, 1980, by and between CLALLAM COUNTY, the TOWN OF FORKS, the CITY OF PORT ANGELES. the CITY OF SEQUIM, JEFFERSON OOOOTY, and the CITY OF PORT TOWNSEND, all of the State of Washington. WHEREAS, the Department of Housing and Urban Development (DHUD), Seattle Area Office, has available funds for use in the rehabilitation of moderate and low-income housing and for the rehabilitation of p.ublic facilities for use as community centers; and WHEREAS, the application for such funds can be made by one jurisdiction on behalf of other cooperating cities and counties, and; whEREAS, the parties her~to deem it advantageous to the citizens which they represent to present a pre-application for DHUD funding; NOW, THEREFORE, IT IS AGREED: (1) This agreement shall be effective on the date set out above and shall continue in effect until the purpose for the Agreement has been fulfilled or until terminated, either as set out below in Paragraph (7) or by mutual agreement. (2) Jefferson County shall be the "lea~ agency" for all purposes related to the DHUD Community Development Block Grant. In its capacity as lead agency, Jefferson County shall act on behalf of the above-stated jurisdictions and shall have authority to contract with other entities for services required in the development of the final application for the said grant, if invited, and for the administration of grant monies received. It is contemplated that Jefferson County will continue to contract with the Clallam-Jefferson County Community Action Council, Inc., for both the preparation of the final application for the grant, if invited by DHUD, and for the operation of the program, if awarded. (3) The six participation jurisdictions agree to cooperate in the implementation of the Housing Assistance Plan and other certifications that will be submitted with the final application, if invited. (4) The purpose of this agreement is to obtain from DHUD through its Community Development Block Grant or from other sources: . DRAFT DMFT DRAFT DRafT .to& "".f .' ~r.' ,Ii-. Interlocal Cooperation Agreement page 2 {a) funds for the rehabilitation of housing units within the boundaries of the counties and cities which are parties hereton and to administer the distribution of tbose funds to families of moderate- and low-incomes for rehabilitation of their housing units~ and (b) funds to rehabilitate a public build1ngowned by the Town of Forks as a community center. (5) All financing for the project shall be provided by DHUD or 4It. other federal or state sources, and no local matching funds by the parties hereto are required. (6) The number of housing units assisted in the two counties and four cities will be proportioned on a basis to be determined at a later date and subsequently approved by DHUD. Assistance from grant monies may be expended on a grant, low-interest lawn ,or deferred loan payment basis. Repayment of all' loans from this program after the proposed project is completed shall be returned to .the county or city in which the assisted unit is located. These funds will be used for additional housing rehabilitation or other DHUD-approv~d community development activities under the direction of the legislative authority or an agency of the county or city in which the funds were first loaned. (7) Should any party hereto wish to withdraw from participation in this Agreement, that party shall provide ninety (90) days written notice to each other party, and shall reimburse the Lead Agency for any costs and/or expenses related to or occasioned by the party's withdrawal. Withdrawal shall be effective ninety (90) days following date of notification and payment of the costs and expenses. (8) It is not contemplated that any property or assets will be acquired by Jefferson County, as Lead Agency, or by any other party hereto, except as set out above in Paragraph (6); however, should any property and/or assets, except as provided in Paragraph (6), be acquired and held on the date this agreement is terminated or on the date any party should withdraw, each party shall receive an equal share of such property and/or assets.
