HomeMy WebLinkAbout35-80 0' ,/ . . ,/ . :JlS" 1.:l.I".r(J, '" RESOLUTION NO. dS- 86 A RESOLUTION authorizing the Lighting Department to apply for an exemption from Section 133 under PURPA WHEREAS, the Lighting Department, City of Port Angeles is a jurisdictional utility under the provisions of the Public Utility Regulatory Policies Act (PURPA) of 1978, and, WHEREAS, the Department is required to comply with the provisions of Section 133 of the aforesaid Act unless an exemption is granted on application filed prior to December 31, 1980, and, WHEREAS, this City Council is the legally authorized policy governing entity for the Department, and, WHEREAS, all meetings and activities of this Council are opened to the public, and, WHEREAS, this Council believes that good information with regards to costs of providing service must be readily avail- able on a timely basis to everyone concerned, and, WHEREAS, the Department has provisions for public review of all cost and ratemaking information, and, WHEREAS, we believe that the Department has rates in effect which are cost-of-service based, are non-discriminatory between classes of customers, and, WHEREAS, We, the City Council of the City of Port Angeles, Washington, believe that the general purpose of Section l33 is being fulfilled at the Department, that mandatory reporting of the required information would not further that purpose but would add a significant cost burden to the customers of this utility, and that Congress could not have intended that a system with only 8000 customers be subject to this information reporting, and, WHEREAS, the Department desires to seek an exemption from Section 133 under the provisions of Subpart 0 of the Act, -- . - . . I i " NOW, THEREFORE, BE IT RESOLVED by the City Council of Port Angeles, as follows; Section I: That the Department shall prepare and file prior to December 31, 1980, an application for exemption from the June 30, 1982, proviison of Section 133 of PURPA. Section II: That this Council recognizes the efforts of the Federal Energy Regulatory Commission (FERC) to assure that all sides are fairly represented at rate proceedings and share in FERC's endorsement of the objectives of the national energy legis- lation. However, the extensive gathering of data for this utiltiy will not particularly further public involvement in the ratemaking process, but instead would create a significant cost burden to be passed on to the ratepayer. Therefore, we respectfully request the Federal Energy Regulatory Commission to act favorably on the Department's exempt application. Section III: That the appropriate grounds for exemp- tion are as follows: a) The Department maintains a policy of developing sufficient data to manage the utility and to address ratemaking and social issues facing it. b) The Department has implemented alternate manage- ment procedures having substantially the same purposes of the Act and requirements of Section 133 as same pertains to non-generating utili ties. c) The Department is primarily a distribution utility having as its sales a large percentage of high load factor cus- tomers. Section IV: That the Department's staff shall re- write and re-phrase these findings as appropriate to formalize the application for filing.
