A RESOLUTION of the Council of the City of
Port Angeles, retaining special legal
counsel for certain services in connection
with :representatioD. of the City in the
United States District Court in the case
of City of Port Angeles vs. ITT Rayonier,
Inc., et al.

WHEREAS the efforts.of the City to enforce the provisions
5 of Ordinance 1709 have been frustrated to the extent that the
6 defendant in Clallam County Superior Court Cause No. 25784 has
7 removed the action to the United States District Court for the
8 Western District of Washington; and
WHEREAS said removal has significantly increased the
10 workload of the City Attorney and created logistical problems in
9
11 the prosecution of said action; now, therefore:

THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO RESOLVE
13 AS FOLLOWS:

The firm of Hillis, Phillips, Cairncross, Clark and
15 Martin, attorneys, of Seattle -is hereby appointed and retained as
16 special legal counsel to represent the City of Port Angeles in the
17 above-referenced matter; provided, that such representation shall
18 be limited to researching, briefing and arguing motions to remand
19 to state court and issuance of a preliminary injunction in Cause
20 No. C78-5l9 presently pending in said United States District Court,
21 and compensation for said services shall not exceed the amount
22 heretofore discussed by and between Mr. Lou Peterson of said firm
23 and the City Attorney.

PASSED by the City Council of the City of Port Angeles,
25 Washington, at a special meeting thereof held on the 12th day of
26 September, 1978.
