L/i-lt 2 A RESOLUTION of the City of Port Angeles ordering the sale of certain surplus real property. 3 e 4 5 WHEREAS the below described real property has been 6 adjudged surplus in that the said property shall no longer be 7 needed for any municipal purpose after the opening of the City's 8 corporation yard in 1979; and 9 WHEREAS it appears to be in the best interest of the 10 City of Port Angeles that such surplus property be sold; and 11 WHEREAS an appraisal of said real property shall be 12 obtained by the city staff; and 13 WHEREAS it is necessary to establish an appropriate 14 procedure for the sale of said surplus property to insure that the 15 City shall receive fair value therefor; now therefore 16 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT 17 ANGELES as follows: 18 Section 1. That certain real property owned by the City 19 of Port Angeles and commonly referred to as the site for the 20 street and water department shops, located at the intersection of 21 Seventh and Peabody Streets in the City of Port Angeles, said 22 location being more particularly described as follows: 23 Lots 1, 2, 3 and 4, Block 229, Townsite of Port Angeles, located in Clallam County, State of Washington. 24 ~ 25 is hereby declared surplus and shall be sold for not less than 26 the amount established as the value by an independent appraiser. 27 Section 2. Sale of the above referenced real property 28 shall be deferred, however, until such time as the Clallam County 29 Housing Authority shall have enjoyed an exclusive opportunity to 30 acquire said real property for its current "Turnkey Project. 1~ 31 32 -1- .~ 1 In furtherance of this objective, the City Manager is hereby 2 authorized and directed to enter into an agreement with said 3 Housing Authority, which agreement shall specify that the City of ~ 4 Port Angeles shall not sell any portion of said real property 11 12 13 14 15 16 17 18 19 20 21 22 23 24 e 25 26 27 28 29 30 31 32 5 prior to July 1, 1979, to any person, firm or corporation other 6 than such as may be designated by said Housing Authority, provided 7 that said person, firm or corporation shall have been previously 8 awarded a contract to construct a "Turnkey" housing project for 9 said Housing Authority; provided further, that said agreement and 10 sale shall reserve salvage rights to the City of Port Angeles. Section 3. In the event that the sale referred to in Section 2, above, does for any reason not occur the sale of said real property shall be by means of sealed bids at a date desig- nated by the City Council. Section 4. Prior to such sale by bids, the City Clerk is directed to notify the public by posting and by publishing newspaper notice of the sale of said property at least once during each week for two (2) consecutive weeks; provided, that the date of the first publication shall be not less than fourteen (14) days prior to the date of said sale and the last publication shall be at least five (5) days prior to the date of said sale, and each notice shall contain the following information: A. Property location: 7th and Peabody, more particu- larly described as Lots 1, 2, 3 and 4, Block 229 Townsite of Port Angeles, located in Clallam County, State of Washington. B. The date, place and hour of sale. C. The entire tract is to be sold; no bids for any portion thereof will be considered. D. That said property shall be sold for not less than the appraised value. E. That all bids shall be in writing specifying the name and address of the bidder, the amount bid, and the legal description; that said bids shall be deposited with the City Clerk not later than the close of business on the day preceding the sale. -2- .. c'"" e 18 19 20 21 22 23 24 e 25 26 27 28 29 30 31 32 1 F. That each sale shall be consumated upon such terms as the City Manager may deem prudent. G. That title shall be conveyed by quitclatm deed, and the City shall not furnish title insurance. H. That the City reserves the right to reject any and all bids. 2 3 4 5 Section 5. On the date specified for the sale by bids, 6 the City Manager is authorized and directed to open only those bids 7 received in accordance with the provisions of subsection E of 8 Section 4 hereof. Upon rejecting all bids in an amount less than 9 that specified in Section 1, the City Manager shall determine which 10 of the remaining bids are in the form specified in subsection E of 11 Section 4. After ascertaining the highest bid, the City Manager 12 shall thereupon announce the name of the highest bidder and the 13 amount bid. In no event shall the City Manager accept a bid for 14 any single lot, but the entire tract shall be sold as one unit. 15 Section 6. Upon receipt of the purchase price, the 16 Mayor and City Clerk are hereby authorized and directed to execute 17 the conveyance as specified in subsection G of Section 4.
