BOARD OF ADJUSTMENT

I CALL TO ORDER
The meeting was called to order by Chairman Pazan at 7:05
P.M.
II ROLL CALL
Members Present: James Rexroat, Steve Pazan, John Lacey,
Evelyn Tinkham.
Members Absent: James Clevenger.
Staff Present: Paul D. Carr, Dan VanHemert

APPROVAL OF MINUTES

Mrs. Tinkham moved to approve the minutes of December 6,
1982, as submitted. Mr. Rexroat seconded the motion,
which passed unanimously.

COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
Chairman Pazan moved Master's Baptist Church to first on
the agenda.
V-83(1)2 - THE MASTER'S BAPTIST CHURCH. Request for a
variance to reduce the required 35-foot setbacks to 27
feet, and the 25,000 sq.ft. minimum lot size to 19,500
sq.ft.; to use the existing single-family structure as
a church meeting place and the adjacent lot for
parking. Location: 520 Golf Course Road.

Mr. VanHemert reviewed the Department Report. Mr. Lacey
inquired about lighting and vegetation requirements on
the west and south sides. Mr. VanHemert explained the
Zoning Code requirements and the practical effect of
topography. Chairman Pazan opened the public hearing.

Ralph Blankenship, RR 1, Box 4606, Forks, was available
to answer any questions from the Board. There were no
comments; accordingly, Chairman Pazan closed the public
hearing.
Mrs. Tinkham moved to grant the var~ance, citing the
following findings of fact:
A. The corner location, orientation of the existing
structure, and surrounding land uses are special
circumstances of the property.
B. Since the existing residential structure exceeds the
minimum yard requirements for a single-family home
the variance will not be a grant of special privilege
not shared by other properties in the vicinity or
RS-7 District.
C. The degree of the requested variance and requirements
of the Conditional Use Permit will reduce any impact
on adjacent lots and the general public. The
variances, therefore, will not be materially
detrimental to the public welfare or surrounding
properties.

Mr. Lacey seconded the motion, which passed unanimously.
[The Board took a 5-minute recess.]
V-83(1)2 - GLENN C. SMITHSON. Request for a variance
to reduce the required 15-foot side yard and rear yard
in the M-2 Zone to 0 feet and approximately 10 feet
respectively; to construct a cooler for an existing
tavern. Location: 1440 Marine Drive.
Mr. Lacey moved to table this application to February 7,
1983, because the applicant was not present. Mrs.
Tinkham seconded the motion, which passed unanimously.
VI STAFF REPORTS

VII REPORTS OF BOARD MEMBERS

Following discussion, the Board unanimously moved to re-
quest the City Council take appropriate steps to vacate
the Board seat presently occupied by James Clevenger and
appoint a new member.
