CONDITIONAL USE PERMIT - CUP 95(11)16 - EPISCOPAL RETIREMENT
HOMES OF WASHINGTON. 510 East Park Avenue: A proposal to allow the
development of a 40-bed elderly care facility in the RS-7, Residential Single Family
zone.
Senior Planner David Sawyer reviewed the Planning Department's memorandum which provided
amended findings and conclusions should the Commission concur with the staff s memorandum of
December 13, 1995, by approving the permit as requested. Staff explained that the City's State
Environmental Policy Act (SEP A) Responsible Official, Brad Collins, revised the mitigated
determination of non-significance (MONS) due to comments received during the required public
comment period by adding a third mitigation measure requiring sidewalk improvements to the south
side of Park Avenue from the project site to Peabody Street. Staff's December 13 memorandum was
revised based upon the revised SEP A mitigation measures and Planning Commission discussion from
that meeting.
Chair Nutter noted and thanked the Public Works Department for the memorandum received
regarding testimony received during the December 13 public hearing concerning speeding along Park
Avenue and the request for a lower speed limit/enforcement action in the area.
Following limited discussion, Commissioner Souders moved to approve the conditional use
. permit as requested with the following conditions:

Conditions:
1. The applicant shall submit for approval to the Planning Department a landscaping plan
for the entire site including an identified recreation area and a permanent solid fence
or evergreen screening four feet in height to be established and maintained within
three feet of all property lines not adjacent to the existing church facility.
2. The proposed use shall meet all requirements of the Port Angeles Municipal Code
including fire and building code requirements.
3. The applicant shall meet all of the conditions required by the City Engineer in his
memorandum dated November 28, 1995, including the provision of sidewalk along
the Park Avenue frontage, standard driveways, drainage, including detention, and
parking, aU per City standards.
4. The applicant shall meet all of the conditions required by the City Fire Department in
their memorandum dated November 22, 1995, including access to within 150 feet of
all parts of the proposed structure and fire sprinklers and alarm system.
5.
The applicant shall apply for and receive a license to operate the proposed facility
from the State Department of Health and any other appropriate state licenses and/or
permits prior to occupancy of the facility.
6. A short plat shall be approved by the City creating the proposed subject site prior to
building permits.
7. The applicant shall receive a clearing and grading permit for the proposed project
prior to construction activity.
8. An on-site storm water detention system approved "by the Public Works Department
shall be required.
9. Sidewalk to City standards shall be constructed along the southern edge of the City
right of way along the property frontage and west to Peabody Street.
10. All lighting on the site shall be directed to reflect away from adjoining residential
property.

Findings:
Based on the information provided in the staff report (including all of its attachments),
comments and information presented during the public hearing, and the Planning
Commission's discussion and deliberation, the City of Port Angeles Planning Commission
hereby finds that:
1. The applicant, Episcopal Retirement Homes of Washington has applied for a
conditional use permit to operate a 50 bed nursing/rest home for the elderly at 510
East Park Avenue.
2. Section 17.08.095(E) of the Port Angeles Municipal Code (PAMC) defines/reads
"Rest Home, Nursing Home, Home for the Elderly - a private home or institution for
the care of the aged or the infirm~ a place of rest and care for those suffering bodily
disorders. "
3. A ''Rest Home, Nursing Home, Home for the Elderly" is a conditionally permitted use
in the RS-7 zone per P AMC Section 17.10,. 040( 1).
4.
Chapter 17.16 P AMC establishes special requirements for nursing/rest home
conditional use permits.
5. The City's Zoning Map identifies the property as RS-7, Residential Single Family.
6. The Comprehensive Plan identifies the subject site in the border area between Low
Density Residential (LDR) to the west and Open Space (OS) to the east.
7. A Mitigated Determination of Non-Significance (MDNS #654) was issued for the
project on December 6, 1995. Comments were received prior to the expiration of
the comment period on December 21, 1995. As a result of comments received, a
revised MONS was issued to reflect said comments. There were no appeals received
during the following appeal period which expired on January 2, 1996.
8. The proposed bedroom units do not include permanent kitchen facilities.
9. The current RS-7 zoning and Low Density Residential Comprehensive Plan
designation of the property al10ws the development of 15 single-family homes or a
combination of up to 21 single-family homes and duplexes or accessory living units
with no restrictions on the number of bedrooms per unit.

The 1990 Federal Census indicates 2.34 persons per household in the City of Port
Angeles.

Conclusions:
Based on the infonnation provided in the staff report including all of its attachments,
comments and information presented during the public hearing, the Planning Commission's
discussion and deliberation, and the above listed findings, the City of Port Angeles Planning
Commission hereby concludes that:
A. As proposed, the application qualifies as a "Rest Home, Nursing Home, Home for the
Elderly" perPAMC Section 17.08.095, E.
B. As proposed, the bedroom units do not meet the Port Angeles Municipal Code
definition of a "dwelling unit."
C. As conditioned, the proposed use is consistent with the City's Comprehensive Plan
including but not limited to Land Use Element Goal A, Policy Nos. 1 and 2, Goal C,
Policy Nos 1 and 2, and Housing Element Goal A, Policy NO.1.
D. As conditioned, the proposed use is consistent with the City's Zoning Ordinance
including Chapter 17.16 and the intent of the RS-7 zone
E. As conditioned the proposed project is not contrary to the public use and interest.
. Commissioner Philpott seconded the motion, which passed 4 - O.

REPORT OF COMMISSION MEMBERS
Chair Nutter thanked the City Departments responsible for the upgrade to the lighting in the
Council Chambers on behalf of the Planning Commission. She noted the infonnation
presented on the Wmter Planning Conference on January 19, 1996, and urged those who wish
to attend to contact staff to make those arrangements. Commissioner Souders asked that the
conference be videotaped for future reference and as an aid to new commissioners.

Following discussion it was decided to request the City Council to appoint a volunteer
committee consisting of an individual from the Clallam Transit Authority, the Olympic
Peninsula Bicycle Coalition, the Jet Set Soroptomists, the City's Park Board, the State
Department of Transportation, two or three at large members and a volunteer member of the
Planning Commission, to form an ad hoc committee which will meet a minimum of two times

per year at times to be decided by members of the Committee whose task it will be to identify
and recommend bicycle and pedestrian routes throughout the City. Such non-motorized
routes may be separate from or adjoining motorized vehicular routes as exemplified by the
current Waterfront Trail facilities. Planning Director Collins will assist when possible and the
Public Works and Parks and Recreation Departments will be invited to provide assistance and
expertise.
The Commission also concurred to request the City Council to appoint a citizen committee
consisting of a volunteer from the Port of Port Angeles, the Downtown and Uptown Business
Associations, one or two citizens from the neighborhoods (5) defined in the Comprehensive
Plan, to define and identify view corridors including staff from the Public Works, Parks and
Planning Departments as requested.
Commissioner Philpott indicated material presented to the Commission entitled "Growth
Management and Affordable Housing" from the Washington Center for Real Estate Research
merely to afford another definition of the term "affordable housing" as there are so many
definitions at the present time.
The Commissioners expressed interest in a meeting with the County Planning Commission
in the near future to discuss items of common interest to both groups.
