CALL TO ORDER
Chairman Anderson called the meeting to order at 7 PM.

APPROVAL OF MINUTES
Mr. Brewer moved to accept the minutes of the January 13th
meeting as submitted. Mr. Downie seconded the motion,
which. passed unanimously.
IV
HEARINGS
REZONE HEARING ~. P.I.C.O. Application to rezone
62,637 square feet (1.4 acres) from RMF (Residen-
tial Multi-Family) and PBP (Public Buildings and
Parks), to OC (Office Commercial). Location: East
side of Peabody, both sides of Fourth Street.

Chairman Anderson said this matter was continued from
January 13th due to a 2 - 2 tie vote. The public hearing
had been held. Mr. Bennett excused himself from consid-
eration of this matter on the appearance of fairness and
left the hearing room. Mr. Downie said he had reviewed
the tape of the January 13th meeting, the model and map
submitted at that meeting.
Mr. Brewer moved to recommend approval of the rezone, cit~"
ing the following findings of fact:
l. Commercial use of the property would be more appro-
priate than multi-family.
2. If rezoned to Office Commercial, it could restrict
potential strip zoning on Peabody Street.

3. The functional relationship of the site to the Court
House is important to the type of use proposed.
Mr. Wight seconded this motion; and on call for the ques-
tion, Messrs. wight, Downie and Brewer voted "yes", with
Mrs. Thompson and Chairman Anderson voting "no".
STREET VACATION HEARING - P.I.C.O. Petition to va-
cate Fourth Street, both sides, between Peabody and
Vine Streets. Location: Fourth Street, east of
Peabody Street and west of Vine Street. (Continued
from January 13, 1982.)
Mr. Carr reviewed the Department Report, explained the ease-
ment requested by the telephone company and for Fire Depart-
ment access, and the trail easement. Chairman Anderson
opened the public hearing.
Ed Warren, Pacific Northwest Bell, requested a 20-foot
easement to reach the two existing manholes and lines, ob-
serving that the proposed plan exhibited appears to place
this access within the trail access.

Prank Platt said an access easement would be given to the
telephone company. The proposed structures will not inter-
ferewith the Fire Department access. .
In response to Mr. Downie's question of using the parking
lot aisles for Fire Department access, Fire Marshal Gary
Braun said a 20-foot width, with a vertical clearance of
l3 feet, is required. His Department does not want to lose
access to the Ravine.
Mr. Downie asked about the proposed pedestrian trail. Mr.
Platt responded that a public access trail to Peabody Creek
would be dedicated, and they will prepare a trail along the
Creek and grant a public easement over it.
Mr. Wight inquired if the right-of-way could be privately
used, without cost, if it were not vacated. Mr. Carr re-
plied that such use customarily involves a lease agreement
and fee. Chairman Anderson closed the public hearing.
Mr. Wight favored allowing the Applicant to use the right-
of-way, while still retaining City ownership.

Mr. Downie moved to recommend approval of the vacation of
Fourth Street between Peabody and Vine Streets, subject to
the Applicant dedicating an easement for public access to
the pedestrian trail system, the exact location of which to
be determined at the time of the building permit; and sub-
ject further to the City retaining a 20-foot easement, cen-
tered over the existing telephone utilities, across the

vacated right-of-way, for telephone maintenance access and
Fire Department access; for the following reasons:
1. Vacation could enhance development of an area;
2. Provision of a pedestrian trail easement in Pea-
body Creek Ravine would implement the Comprehen-
sive Parks and Recreation Plan.
Mr. Brewer seconded this motion, adding that no buildings
or fences be .allowed to restrict Fire Department access.
On call for the question, Messrs. Downie and Brewer voted
"yes", with Mrs. Thompson, HI. Night and Chairman Anderson
voting uno".

CONDITIONAL USE HEARING - HANSON. Application for
a Conditional Use Permit to operate a bookkeeping
and tax service as a Home Occupation. Location:
2139 West Seventh Street. (Continued from January
13,1982.)

Mr. Brewer moved to recommend approval of the Conditional
Use Permit to operate a bookkeeping and tax service busi-
ness as a Home Occupation for an initial period of one
year, citing the following findings:
1. The equipment to be used in the Home Occupation will
not generate excessive noise.
2. There will be no significant increase in local ve-
hicular traffic.
3. The Home Occupation will not injure adjoining prop-
erties; or endanger the public health, safety or
welfare.
Mr. Bennett seconded this motion, which passed unanimously.

CONDITIONAL USE HEARING - HAHN. Application for a
Conditional Use Permit to operate a beauty shop as
a Home Occupation. Location: 538 West Sixth Street.
(Continued from January 13, 1982.)
Mr. VanHemert reviewed the Department Report; Chairman
Anderson opened the public hearing.
Judy Hahn suggested that two customers could be there at
one time, inasmuch as she has a corner lot, and there is
off-site parking on both Sixth and Cedar. Mr. VanHemert
suggested that the Applicant might keep the driveway clear
for customer vehicles: and Mrs. Hahn replied that it was
very narrow. Her neighbors have no objections, and are
aware of the proposed on~street parking. Chairman Anderson
asked how many customers Mrs. Hahn expected per day, and
was told that the most that could be handled would be 16.
Chairman Anderson closed the public hearing.
Mr. Downie moved to recommend approval of the Conditional
Use Permit for a beauty shop as a Home Occupation, for a
period of one year, as being within the guidelines of the
Home Occupations Ordinance, subject to the limitation of
no more than one customer vehicle parked on Sixth Street
and no more than one customer vehicle parked on Cedar
Street. He cited the following findings of fact:
1. The equipment used in the beauty shop will not in-
troduce excessive noise, vibrations and odor into
the residential neighborhood.
2. The Home Occupation will not affect nearby properties.
3. It will not endanger the public health, safety, morals
or welfare: and is in the public interest.
Mr. Brewer seconded this motion. On call for the question,
the motion passed 5 - 1, with Mr. Bennett voting "noli out
of concern for the proliferation of beauty shops as home
occupations: they could create hardship on the businesses
located in commercial districts.
Mr. Downie requested the Department survey the number of
beauty shops operating in residential districts.

REZONE HEARING - OLSON. Application to rezone 17,500
square feet from RMF (Residential Multi-Family) to OC
(Office Commercial). Location: Northeast corner of
Sixth and Peabody streets. (Continued from January
13, 1982.)
Mr. VanHemert reviewed the Department report; Chairman
Anderson opened the public hearing.
Carl Olson said the existing commercial use on the parcel
complies with the purpose of the Office Commercial Dis-
trict; and cited Commercial Policies which he considers
pertinent to his application. His intention is to encour-
age offices in a Court House cluster, and his location
would complement the existing OC District at Fourth and
Peabody. Office space in the Court House area is not
available. Peabody Street should contain Court House re-
lated businesses. An office building would be less ob-
noxious than apartments.
Mr. Downie asked about the possibility of this being a spot
rezone. Staff reviewed the characteristics of a spot re-
zone. Chairman Anderson closed the public hearing.

Mr. Bennett said his major concern was a spot rezone. Mr.
Wight said Office Commercial zoning appears to be compatible
with the existing RMF zoning surrounding it. Mr. Downie said
that the subject parcel may be better suited to multi-family
use than commercial; and Mr. Wight suggested that if rezoned
to OC, multi-family uses could be established.
Mrs. Thompson moved to recommend denial of the rezone from
RMF to OC for the following reasons:
1. The property in question is outside the present com-
mercial tiT" and the proposed uses in the Office Com-
mercial District at this location would not comply
with Commercial Policies Nos. 2, 6 and 18.
2. A rezone of this property may expose Peabody Street,
in the intermediate term, to strip commercial de-
velopment, contrary to Commercial Policies Nos. 2,
and 4; and it may also cause the premature eastward
extension of the Lincoln Street leg of the commercial
liT".

3. Strip commercial development adjacent to Peabody
Street would adversely affect the residential develop-
ment in the immediate vicinity by cutting off a three-
square-block small residential district.
4. There is ample land available for the permitted com-
mercial uses in the OC District in existing commer-
cial zones in the City.

5. The size of the proposed rezone may be considered a
spot rezone.
Mr. Bennett seconded this motion. On call for the ques-
tion, the motion passed 5 - 1, with Mr. Wight voting "noli.
TEMPORARY USE HEARING - HIGH TIDE SEAFOODS. Request
for extension of a Temporary Use Permit for a fish
processing operation in the CBD Zone. Location: The
pier at the foot of Oak Street. (Continued from
January 13, 1982.)
Mr. VanHemert reviewed the request for extension. Chairman
Anderson opened the public hearing.
Jim Shefler said that High Tide Seafoods has a month-to-
month lease which is renewed annually. It occupies the dock
frontage and the west half of the water side of the building.
Chairman Anderson closed the public hearing.
Mr. Bennett moved to recommend extension of the Temporary
Use Permit for an additional year, subject to all of the
original conditions. Mrs. Thompson seconded this motion,
which passed unanimously.

COMMUNICATIONS FROM THE PUBLIC
Tom Sparks asked if contract rezones would be discussed this
evening. Mr. Carr responded that they would be covered dur-
ing a joint meeting between the Commission and the City
Council.
VI STAFF REPORTS
1. Beauty Shop in OC District - Interpretation.
Mr. Carr reviewed the Department memorandum regarding a re-
quest for interpretation of establishing a beauty shop in
the Office Commercial District. Mr. Downie asked if per-
mitting such uses in that District would reduce the prolif-
eration of beauty shops as home occupations. Mr. Carr re-
plied that since they were already permitted in all other
commercial zones, it probably would have little effect.
Mr. Bennett said beauty shops should not be included as
permitted uses in the OC District, which was created pri-
marily for medical services and attorneys' offices.

Mr. Bennett moved to interpret that a beauty shop was not
compatible with the permitted uses in the Office Commer-
cial District. Mr. Brewer seconded this motion, which
passed unanimously.
2. Real Estate Office as Home Occupation.
Mr. Carr then discussed the question of allowing a one-
person real estate office as a home occupation. After con-
siderable discussion, the Commission felt the matter would
require close consideration.
3. County Annexation Procedure.
Mr. Carr reviewed the .proposed procedure forwarded from the
City Council regarding County concerns in annexations.
Following a discussion, Mr. Bennett moved to recommend ap-
proving the annexation procedures proposed by the County
Planning Department. Mr. Downie seconded this motion, which
passed unanimously.
4. Joint Meeting.
Chairman Anderson asked if the members would be available
for the proposed joint meeting with the Council and Commis-
sion for February 9th. All except Mr. .Bennett would be
available.
VII REPORTS OF COMMISSIONERS
Mrs. Thompson: Asked about the inventory of desirable
street ends for public use. Mr. VanHemert said he has
visited possible areas with the Park Department, but
that Department has not given the Planning Department
a formal list of such areas.
Mr. Wight: Nothing.
Mr. Bennett: Nothing.
Chairman Anderson: Said there were four cars "for sale"
parked on the Pay 'N Save lot; and the Locomo sign was
back on the street today.
