BOARD OF ADJUSTMENT

I CALL TO ORDER
Chairman Lewis called the meeting to order at 7:10 P.M.
II ROLL CALL
Members Present: John Lacey, Jim Rexroat, Scott Lewis,
Steve Pazan, Lucia McPhee
Members Absent: None
Staff Present: Dan VanHemert
III APPROVAL OF MINUTES
Mr. Pazan moved to approve the minutes of January 7, 1985,
as submitted. Mr. Rexroat seconded the motion, which passed
unanimously.
IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-84(ll)20 - RICHARD AND LAURA SCHOENFELDT - A variance
requested of the 6' maximum fence height to 8'j and the
7' side yard setback requirement to 3', to allow the
construction of an 8' fence and detached accessory
building in the RS-7 District. Location: 435 East
Park. (Continued from January 7, 1985.)
Mr. Lacey moved to continue this application, at the request
of the applicants, until April 1, 1985. Mr. Rexroat seconded
the motion, which passed unanimously.
V-85(2)2 - DANIEL AND JANET GOUIN - Request for a
variance in the required 25' front yard setback to 16';
and a side yard variance from the required 7' to 5', to
allow a single-story addition to be constructed onto an
existing residence. Location: 823 East Sixth Street.
Mr. VanHeffiert presented the Department Report. Ms. McPhee
asked about the location of a future sidewalk, to which Mr.
VanHemert responded that it would be inside the curb with a

parking strip between the sidewalk and the curb. Chairman
Lewis opened the public hearing.
Dan Gouin stated that the variances would not be a special
privilege because many homes in the immediate vicinity en-
croach upon their required yards. In response to a ques-
tion, Mr. Gouin stated that there was a small outbuilding
adjacent to the alley and a lean-to in the west yard, which
would be removed for the addition. Chairman Lewis closed
the public hearing.
After extensive discussion of the neighborhood characteris-
tics, Mr. Pazan moved to approve the front setback from 25
to 16 feet for the following reasons:
1. Lot and house orientation are special circumstances
which deny the property the use right of a modest
addition.
2. Since other homes in this vicinity encroach upon their
front yards, the front setback variance will not grant
a special privilege to the subject lot.
3 .
The addition will not be materially detrimental to
adjoining properties or the public welfare.
Ms. McPhee seconded the motion, which passed unanimously.
Mr. Pazan moved to deny the side yard variance. Mr. Lacey
seconded this motion, which passed 3 - 2, with Mr. Rexroat
and Ms. McPhee voting "No".
V-85(2)3 - EUGENE LYKKEN - Request for a variance of
the required 10-foot rear yard requirement to 4 feet,
for a detached accessory building. Location: 804 East
Third Street.
Mr. VanHemert reviewed the Department Report.
Lewis opened the public hearing.
Chairman
Eugene Lykken, 804 East Third Street, reviewed the history
of the woodshed. Chairman Lewis closed the public hearing.
Mr. Lacey noted that the woodshed was not visible from the
alley because of a 6-foot fence. Mr. Lacey then moved to
approve the variance, citing the following findings of fact:
1 .
Lot location on a corner and adjacent to a Playfield,
lot dimensions, and orientation are special circum-
stances of this property denying its reasonable
utilization.

2. The variance will not be a grant of special privilege
not shared by other properties in this vicinity or in
the RS-7 District.
3. The woodshed will not be materially detrimental to the
general public or injurious to adj acent properties,
utilities or improvements in this vicinity or in the
RS-7 District.
Mr. Rexroat seconded the motion, which passed unanimously.
V-84(5)8 - JAMES SULLIVAN - An extension request of a
variance granting a reduction of the east side yard
setback from 7 feet to 3'1011; and of the west side yard
from 7 feet to 1 foot to allow construction of a second
story to an existing residence. Location: 1221 West
Fifth Street.
Mr. Lacey moved to grant a six-month extension, subject to
the original conditions. Mr. Rexroat seconded the motion,
which passed unanimously.

V-85(2)4 - CLYDE BUGHER - Request for a reduction in
the required 75-foot lot width for a duplex in the RS-7
Zone to 50 feet. Location: 1022 West Fourth Street.
Because of a possible appearance of fairness conflict,
Chairman Lewis left the hearing room. Vice-Chairman McPhee
announced a five-minutes recess. After the recess, Vice-
Chairman McPhee reconvened the meeting.
Mr. VanHemert reviewed the Department Report. Vice-Chairman
McPhee opened the public hearing.

Ken Williams, representing the applicants, stated that his
clients are near retirement and live away from the house for
six-month periods. They need a caretaker. Mr. Williams
then reviewed the conditions of the approved Conditional Use
Permit and the criteria for granting a variance. He stated
the special circumstances are teh large size of the parcel,
its location over the bluff which contributes open space to
the community, and alley access only on which no on-street
parking is permitted. Also, the existing structure does not
block a view. Since there are special circumstances, the
variance is not a grant of special privilege. In response
to a question from Mr. Lacey, Mr. Williams reviewed the
evolution of the duplex.

Craig Miller, representing the neighbors, circulated a peti-
tion which was submitted at the Conditional Use Permit hear-
ing, and stated that the variance would grant a special
privilege to this property because all other duplexes in the
RS-7 District and in the vicinity occupy 75-foot wide lots.
The variance application must meet all three criteria for
granting that variance. Vice-Chairman McPhee closed the
public hearing.
After extensive discussion, Mr. Rexroat moved to deny the
variance because all other duplexes in this vicinity and in
the RS-7 District, constructed since the adoption of the
present Zoning Ordinance, occupy 75-foot wide or greater
parcels, and therefore, the variance will convey a special
privilege to this parcel inconsistent with limitations upon
other uses of property in the area and RS-7 District. Mr.
Lacey seconded the motion, which passed unanimously.
Chairman Lewis returned to the hearing room.
