BOARD OF ADJUSTMENT
Port Angeles, Washington
April 4, 1983
I CALL TO ORDER
Chairman Pazan called the meeting to order at 7:00 p.m.
II ROLL CALL
Members present: Bob Hill, Jim Rexroat, Steve Pazan,
John Lacey, Evelyn Tinkham.
Members Absent: None
Staff present: Paul Carr, Dan VanHemert.

APPROVAL OF MINUTES.

Mrs. Tinkham moved to accept the March 7, 1983, minutes
as read. Mr. Lacey seconded the motion which passed
unanimously.

COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-B3(4)5 - T. E. McGINITIE, JR. Request for a variance
of the rear yard setback from the required 10 feet in
the RS-7 Zone to 0 feet; to relocate and reconstruct a
garage on the east property line. Location: 1111
South Laurel Street.
Mr. VanHemert reviewed the Department Report. Chairman
Pazan opened the public hearing.

Mr. McGinitie noted that his neighbors have no problem
with the proposed variance. In response to questions,
Mr. McGinitie explained that he will be removing ten feet
from the alley side of the garage, but needs to extend
the building along the rear property line in order to
have a wide enough garage. The Board and Mr. McGinitie
discussed various alterations to the proposed building.
Chairman Pazan closed the public hearing.

Mr. Lacey moved to grant the variance subject to the
restriction that the new portion be not less than three
feet from the east property line and not less than ten
feet from the alley, citing the following findings of
fact:
A. The shorter lot, the alley adjacent to the side yard,
and the lot orientation are special circumstances
related to the lot shape and surrounding land uses
which restrict the privilege of covered off-street
parking in a detached accessory building on this lot.
B. Since a 10-foot side yard adjacent to an alley must be
maintained, the lot immediately to the east may have a
detached accessory building within 3 feet of the rear
yard of the subject parcel, and the variance restores
the use right of covered off-street parking, it will
not bestow a special privilege inconsistent with the
limitations upon other properties in the vicinity and
zone.
C. As modified, the variance will not be detrimental to
the public welfare, injurious to public improvements
and nearby private properties.
Mr. Rexroat seconded the motion, which passed 5 - O.
The Board and Mr. McGinitie then discussed the effect of
their decision.
VI STAFF REPORTS

VII ELECTION OF OFFICERS
Mr. Rexroat was elected Chairman. Mrs. Tinkham was
elected Vice Chairman.

REPORTS OF BOARD MEMBERS
Mr. Hill noted he would not be able to attend the May
meeting.
