I. CALL TO ORDER
Chairman Glass called the meeting to order at 7:07
II. ROLL CALL

APPROVAL OF MINUTES
The minutes of the April 8, 1987 meeting were approved
as submitted.
IV.
PUBLIC HEARINGS
PROPOSED AMENDMENTS TO THE RETAIL STAND ORDINANCE
Otto Miller reviewed the information prepared for the meeting
on retail stands. He indicated that the meeting would be
to discuss any possible changes the Commission may wish to
make to the existing ordinance.
Chairman Glass questioned Mr. Miller on the time period involved
in making amendments to the present ordinance. Mr. Miller
stated the Department would like to have any amendments in
ordinance form to present to Council in July, 1987.
There was much discussion on the pros and cons of retail
stands: competition between retailers and retail standsj
whether to allow only push carts or just retail standsj whether
to restrict the activity to Railroad Avenue or also in the
adjacent downtown districts; an established distance between
stands and a set distance from public parks, schools and
public buildings.
The Commission generally agreed to take a closer look at
the existing ordinance to review cart/stand sizes and items

which may be sold. There was concern expressed over the
safety devices attached to the carts and how safe they are
to pedestrians. Proliferation, congestion and competition
were discussed.
Commissioner Wight suggested limiting the activity to Rail-
road/1st Street, from Lincoln to Cherry Streets. There was
discussion on "sectionizing".
The Commission directed staff to prepare wording limiting
the sale of food items: pre-packaged foods, no high hazard
foods/ i.e., fresh fish, limiting the variety of commodities
sold per stand to minimize competition...only hats...only
flowers, etc.
The Commission agreed to discuss the size, style, area of
permissibility within the CBO and wording as to allowable
commodities for sale at the next long-range meeting, May
27, 1987.
V. REPORTS OF COMMISSION MEMBERS
Michael Lemon expressed much concern with the construction
occurring at the optometrists' offices at 9th and Lincoln
Streets. He stated that he felt there has been too much
expansion of the facility to date and indications new con-
struction is about to expand the offices further. He expressed
concern over th fact that clientele have to back into the
alley on the south side of the office in order to exit that
parking area and that the lot is nearly 100% covered with
building. There is very little parking for the office staff
and particularly the public.
The Commission requested written explanation as to the Board
of Adjustment findings in granting the Raab Variance, V 87(4)7,
for new construction at 9th and Lincoln Streets.
The Commission questioned where in the ordinances selling
on private property is addressed, such as selling wood from
trucks in the Albertson's food store parking lot.
Donna Davison moved to adjourn the meeting at 9:40 P.M.
Jim Hulett seconded, meeting adjourned.
