CONDITIONAL USE PERMIT APPLICATION - CUP 90(04)8 -
GEORGE GUND III. 1430 Park View Lane: Request for a
conditional use permit to allow the construction of an
assisted living facility of approximately 21, OOO! square feet,
with up to 28 units, at the site of the existing Park View
Villas residential development, located within a CSD,
Community Shopping District.
Chairman Leonard opened the public hearing. Grant Beck reviewed the
Department Report recommending approval of the proposed project.
Pat Downie, 1538 West Eighth Street, representing the applicant,
was present to answer any questions. Mr. Downie further explained
the proposed expansion of the Park View Villas campus.
Wilma Beaty Cox, Federal Way, Washington, project manager of the
Park view Villas project, gave a detailed explanation of the
amenities which would be available to the residents of the new
assisted living facility, as well as the distinction between an
assisted living facility and the Park View villas residential
development. Ms. Cox st~ted that the basic difference between an
assisted living unit and a retirement development, such as Park

View Villas, is the difference between active older people and
those requiring minimum to moderate assistance in their daily
routines. The assisted living facility will not be a nursing home,
it is not licensed for that, she said. Each unit has minimum
kitchenettes, and are self contained. There will be a common
dining room, common areas such as a sun room, living room, game
room, etc., which may be used if the residents wish, she added.
Jim Hulett asked Ms. Cox what the number of staff would be at any
one time, and if the landscaping would be continued to this
facility in order to blend in with the existing site.
Ms. Cox answered that it would be difficult to estimate the number
of staff present at anyone time because some of the housekeeping
staff from the Park View villas development may be used at the
assisted living site. In answer to the landscaping query, the plan
would replicate the Park View Villas landscaping so that the two
facilities could blend into a campus affair with flow between the
two developments by way of a covered walkway.

Donna Davison asked what types of health care professional staff
would be available at the new facility.
Ms. Cox answered that Limited Practical Nurses, Registered Nurses
and Certified Nursing Assistants would probably be available.
Ray Gruver questioned whether the 28 units proposed would all be
single units.
Ms. Cox stated that they would be mostly one bedroom units,
suitable for a husband and wife, or single residents, with a few
studios. The facility would be one-story due to the nature of its
residents. She further said that they do not anticipate expansion
of the facility in the future.
There being no further questions or comment from the audience,
Chairman Leonard closed the public hearing.
Following brief discussion, Ray Gruver moved to recommend approval
of the conditional use permit as proposed citing the findings and
conclusions as listed in the staff report, as follows:
Findinqs:
1.
The Port Angeles zoning Code requires that prior to acting on
a Conditional Use Permit, the Planning commission must hold a
duly advertised public hearing.

2. Public notice, as required by the Port Angeles Zoning Code,
has been given.

3. The property sUbject to the permit application is described as
a portion of Parcel 3 of Short Plat #SHP 88(1)4 as recorded in
Volume 18 of Short Plats, page 86. The property is located at
1538 West Eighth Street, at Park view Villas.
4. The Port Angeles Zoning Code allows "homes for the elderly" as
a conditional use in the CSD-C2 Zoning District (Article VI) .
5. The Port Angeles Zoning Code states that the Planning
Commission shall consider all applications for Conditional Use
Permits and may grant said permits for such uses as by the
Zoning Regulations are required to be reviewed and which can
be permitted only upon granting of a Conditional Use Permit.
6. The Zoning Code states that the purpose of the Conditional Use
Permit shall be to assure that the maximum degree of
compatibility between uses shall be attained.
7.
The application is to construct an approximately 21,000
square-foot assisted living building to provide up to 28
living units.
Conclusions:
A. The proposed activity can be permitted through the granting of
a Conditional Use Permit.
B. The proposal, as conditioned, is consistent with the tests for
issuance of a Conditional Use Permit as found in Article XI,
section 5 of the Port Angeles Zoning Code.
C. Procedural requirements relating to public notice and public
hearing have been accomplished.
Donna Davison seconded the motion which passed unanimously.
V. PLANNING STUDIES
1. Adoption of Bylaw amendments submitted at the March 28, 1990,
regular meeting.
Following lengthy discussion concerning the limitation of
testimony at public hearings, Bob Philpott moved to approve
the bylaw amendments as proposed, limiting testimony and
clarifying testimony given. Ray Gruver seconded the motion.
Larry Leonard spoke against limiting support testimony to 2
minutes. He indicated support testimony should be 5 minutes.

Bob Philpott amended his motion to adopt the bylaw amendments
as proposed with the exception that support testimony would be
limited to 5 minutes rather than the proposed 2 minutes. Ray
Gruver concurred. The question was called and the motion
carried unanimously.
2. Adoption of a resolution of appreciation for Jerry Cornell
and Jerry Glass.
The Commission unanimously concurred to adopt a resolution
noting recognition of the dedication and service of past
Commissioners Cornell and Glass to the City of Port Angeles.
3. Review of Mobile Home Park standards in the City of Port
Angeles (memo of September 18, 1989).
The Commission reviewed the need and demand survey prepared by
staff noting mobile home parks located within the City and how
the city looks at citing mobile homes within the city's
residential single-family districts.

Grant Beck noted that City land use regulations as they relate
to mobile home citings within the City do not restrict mobile
and manufactured homes from locating in the City's residential
single-family districts. Therefore, the city does not
restrict mobile and manufactured homes to mobile home parks.
Donna Davison moved to accept the report and thank staff for
their work in preparing the report in response to a request
from the State Department of Community Development regarding
the need and demand for mobile homes within the City of Port
Angeles. Ray Gruver seconded the motion, which passed
unanimously.
4. Review of an ordinance before the city Council regarding the
establishment of Ad Hoc Committees by the Planning Commission
(memo of April 11, 1990).
Following discussion, Bob Philpott moved to adopt the
ordinance as prepared by the City Attorney's office to aid in
the establishment of Ad Hoc Committees by the Planning
Commission. Roger Catts seconded the motion which passed
unanimously.

Code (continued from the March 28, 1990, regular meeting).

range meeting.

6. Update on the zoning Code amendment process.
The Commission reviewed the proposed ordinance as prepared by the
City Attorney clarifying the authority of the City Council,
Planning Commission, and Planning Director with regard to certain
land use matters and establishing an appeal period for amending the
Zoning Code.
It was decided that because the information had just been received
for review, to set a public hearing for action on the ordinance for
the May 23, 1990, meeting. The Commission indicated that they
would note any requested modifications to the ordinance at the May
9, 1990, meeting.
VI. COMMUNICATIONS FROM THE PUBLIC
None.
VII. STAFF REPORTS

Mr. Beck noted that John Nelson had requested the Council take
action on Parking Variance #PKV 90(02)1 previously acted on by the
Commission (in March, 1990) but which the Council had continued
indefinitely. The Council has placed the item on the May 1, 1990,
agenda.
Mr. Beck gave a brief review of the discussions and meetings staff
has had with the developer of Park View Villas and the neighbors in
regard to the landscape condition of approval in order for the site
to obtain a permanent certificate of occupancy. He noted that the
neighbors had reviewed the plan as proposed and made noted changes
which had been passed on to the developers for implementation.
Also noted was the sidewalk that had been placed in the 50-foot
buffer area by the developers which was being contested by the
neighbors.
Mr. Beck stated that a parking variance and possible shoreline
permit for Olympic Memorial Hospital would be on the Commission's
May and June agendas for review.

Mr. Beck said that there had been some concern expressed by a
petitioner in the Schneider Annexation Request (ANX 88(06)1) in
regard to the Rezone Request (REZ 90(02)1), which would rezone the
newly annexed property to light industrial from single-family
residential. The petitioner objected to his property being left
out of the rezone to light industrial. Mr. Beck stated that the
matter would be discussed at the City council meeting May 1, 1990.

Mr. Beck updated the commission regarding the status of the Del Hur
Planned Residential Development indicating that a mitigated
Determination of Non-Significance had been issued. If this
determination is appealed, the Planning commission would take
action on the appeal
