III APPROVAL OF MINUTES
Ms. Davison noted that in paragraph 5 on page 2, the minutes
of the April 25, 1990, meeting should read "licensed practical
nurses", not limited practical nurses.
Mr. Philpott moved to accept the minutes of the April 25,
1990, meeting, as amended. Mr. Hulett seconded the motion,
which carried 6 - 0, with Mr. Anabel abstaining.
IV PUBLIC HEARINGS
REPLAT OF GREEN'S BELLE VIEW ADDITION - LBR CONSTRUCTION
- Block 6 of Green's Belle View Addition to Port Angeles:
Request to replat block 6 of Green's Belle View Addition
to create fewer, larger homesi tes. The property is
located on Golf Course Road between 3rd and 4th streets
within an RS-7 zoninq district.
Chairman Leonard opened the public hearing. Mr. Collins
presented the Department Report, recommending approval, with
three conditions.
Dave Cummins, 130 North 3rd street, sequim, representing the
L. -app1'icant,indicated-that 'since..the'.appJ:ication was submitted,
they have received an access easement for the sewer extension,
prepared conceptual drainage plans, and proposed plat restric-
tions, limiting access to only the alley. Mr. Cummins indi-
cated that this is a rep1at, not a new subdivision, and that
the Planning commission mayor may not apply standards as if
it were a new plat. The applicant does not feel that full
curb and gutter on 3rd and 4th streets are necessary to ensure
public use and interest in the replat. The redevelopment of
the lots will make a better living area for the residents and
neighbors, and all new lots will meet current zoning

standards. Two options for street upgrade that the applicant
would agree to are plat restrictions limiting access from 3rd
and 4th streets, and signing a non-protest agreement for an
LID for future improvements of 3rd and 4th streets.
Upon questioning by the Commission, Fire Marshal Becker
indicated that the Fire Department can access the area from
both 3rd and 4th streets and no additional fire lane improve-
ments are required.
Ron Dotson, 1823 East Fourth street, indicated he was con-
cerned about the height and size of new construction in the
replatted area. He requested restrictions be placed on the
development limiting these two items.
The Planning Commission indicated that this is a replat and
the developer could place more homes on the property without
the replat than if the replat were approved.

Joe Abram, 1803 East Fourth street, a resldent to the~~
of the proposed area, had no objections to the replat. A
concern indicated by Mr. Abrams was that during the upgrade
of Third and Fourth streets, his house would still not have
a curb and gutter in front of it. Mr. Abrams requested the
Planning Commission indicate whether he would be required to
improve his portion of Fourth street at the same time the
developer of the replat does.
Leonard Wright, 1818 East Fourth street, expressed concern
about maintenance of the streets if curb and gutters are not
provided.
Mr. Collins indicated it would be in the public use and
interest to require curb and gutter along Third and Fourth
streets. An LID would be accepted if completed prior to final
replat approval but limiting access from Third and Fourth
streets is not adequate to serve public use.
Mr. Dotson again requested the Planning Commission place
restrictions on the replat which would limit the height and
size of any homes located on the property.
Mr. Cummins indicated that the applicant intends to develop
-the lots,.'but~may sell-the -lots -in-the -future.
Mr. Wright indicated concern about current City regulations
in the Zoning Code and how they protect his neighborhood on
Golf Course Road.
There being no one else wishing to speak, Chairman Leonard
closed the public hearing.
Mr. Philpott indicated that he would be in favor of requiring
curb and gutter along Third and Fourth streets, but that

areas in the vicinity do.nothave sidewalks except for Golf Course
Road.
Chairman Leonard stated that he was disappointed that staff
would propose a condition requiring the retention of signifi-
cant vegetation, as there are no current policies or regula-
tions in the city governing this issue.
It was moved by Ms. Davison that the replat be recommended for
approval subject to the following conditions, and citing the
following findings and conclusions:
Conditions:
1. Prior to final replat approval, the applicant shall
provide electrical service to the replat in accordance
with a final design approved by the Port Angeles Light
Department. The final plat shall contain the following
easements to the City of Port Angeles:
.
a. The east 7 feet of Lots 1 and 6;
b. The north 10 feet of the east 10 feet of Lots 7, 9,
and 10;
c. The south 10 feet of the east 10 feet of Lots 2 and
4.
2. Prior to final replat approval, the applicant shall:
a.
Provide sanitary sewer adequate to serve all
proposed lots within the replat area;
Upgrade Third and Fourth Streets adjacent to the
proposed replat and the interior alley to City
standards;
Prepare and implement a storm water drainage plan;
Limit access to Lots 1 and 6 so it is not directly
at Golf Course Road;
Remove all buildings within the replat area.

Findings:

vision Code, has been given.
2. . ~ RCW'. 58 .17 ~ 215 -states -that-the' legislative body may
approve an alternation to an existing subdivision if the
alteration is in the public use and interest.

The Department of Public Works reviewed the proposal and
indicated that sanitary sewer and storm drainage would
have to be addressed; that existing buildings should be
removed; that Third and Fourth streets should be upgraded
to City standards, and that access to Lots 1 and 6 should
be limited from Golf Course Road.
4. The Light Department reviewed the proposal and indicated
that electrical service should be provided and that
certain easements should be shown on the final replat.
5. The existing lots are non-conforming with width and size
requirements of the Port Angeles Zoning Code, but are
pre-existing, non-conforming and could be built on,
provided all other dimensional standards of the Zoning
Code are met.
6. Third and Fourth streets adjacent to the subdivision do
not currently meet City standards.
7. The Port Angeles SEPA Responsible Official issued a
Determination of Non-Significance for the proposal on
April 26, 1990, which became final on May 7, 1990.
8.
The proposal is to replat Green's Belle View Addition to
Port Angeles by creating ten 59 to 64 foot lots out of
seventeen 40-foot lots.
9. The subject property is described as Block 6 of Green's
Belle View Addition to Port Angeles, as recorded in
Volume 1 of plats, page 45.

Jan Fischer, 1221 East Second Street, indicated that she keeps
samples and catalogues for custom ordering; holds up to two
open houses per year; makes and distributes flower arrange-
ments and gifts; and gives lessons and decorates at customers'
homes. There have been no complaints regarding the Home
Occupation for the four and one-half years it has been in
operation in the neighborhood. Ms. Fischer works two days
per week and infrequently has people visit the home.
Audrey Hartnagel, 1303 East Second Street, indicated that this
is a nice residential neighborhood with no commercial develop-
ment. The original owner of this area wished it to remain
residential in nature. By allowing a Home Occupation, commer-
cial encroachment of the area will begin. She requested the
Planning Commission not deny the heritage of the neighborhood.
Ms. Hartnagel also indicated she had no problems with Ms.
Fischer's business, but was thinking of the future and afraid
of the precedent approval of the Horne occupation would set.
Upon questioning by the Planning Commission, Ms. Hartnagel
indicated she found out about the business via neighbors and
the posting notice for the extension of the business.

Mrs. John Gray, 1327 East Second Street, indicated that she
did not know about the business until public notice was posted
for the original Administrative Hearing on the extension. She
has lived in the area since 1955 and this is the first busi-
ness to locate in this residential area. Mrs. Gray indicated
concern regarding parking problems and increased traffic in
the alley on Second street, although she attributed a portion
of this to the stop light at First and Ennis. Mrs. Gray also
indicated that the public notices were removed on Saturday.
Randall Taylor Sundt, 1316 East Second Street, stated that if
people didn't know the use was located within the area, how
could it detract from the residential character of the neigh-
borhood. He spoke in favor of the Fischer Home Occupation
being allowed to continue at this location.
Mark FiSCher, 1221 East Second street, supported the applica-
tion and read the definition of Home Occupation from the
Zoning Code. He indicated that many neighborhoods have Home
Occupations. They have never received a specific written

Ms. Davison moved to recommend approval of the extension of
the Home occupation for five years, subject to the following
conditions citing the following findings and conclusions:

The merchandise in the premises be limited to samples and
display items only, and the products be delivered by the
applicant to the client's home.

2.
A 1AIOBC fire extinguisher be installed in the basement,
or in a location approved by the Fire Department and
serviced at least annually or more frequently as required
by the Fire Department.
Findinqs:
A. The applicant has requested an extension of this permit.
B. There have been no concerns expressed by either the
neighbors or the general public during the past two years
of operation of this Home Occupation.
C. The Home occupation does not involve equipment or
proces ses which introduce noise, smoke, dust, fumes,
vibrations, odors, or other hazards in excess of those
normally found in residential areas.
D. There is adequate paved parking on-site to provide off-
street parking for customers to the Home Occupation.
E. Home Occupation permit extensions are processed pursuant
to Article XI of the Zoning Code, Section 7.
Conclusions:
1. On an appointment basis only, as proposed by the appli-
cant, the Home Occupation will not generate sufficient
vehicular traffic to detract from the residential
character of the neighborhood.
2. The Home Occupation will not be injurious or detrimental
to abutting properties because of the existing landscap-
ing on the property and the adequate additional paved
parking area on the north which provides access from the
alley.
3. As proposed and conditioned, the Home occupation meets
the development standards set forth in the Home Occupa-
tions Chapter of the City's Zoning Ordinance.
Mr. Hulett seconded the motion, which carried unanimously.

Mr. Hulett stated that he would step down from this item, as
his wife is employed by the Clallam County Physicians'
Service, owners of the property, and left the room.
Mr. Gruver said he has had business dealings with two persons
in the audience here for this matter, and that he would step
down if anyone raised the issue of an appearance of fairness.
As no one objected to Mr. Gruver's remaining on the dais, he
remained.
Chairman Leonard opened the public hearing. Mr. Beck
presented the Department Report, recommending approval of the
Conditional Use Permit.

Chuck Turner, 1129 East Front Street, representing the appli-
cants, stated that the applicant is sensitive to the landscap-
ing issue and that staff's recommendations for buffering would
be implemented. Because the Zoning Code requires increased
setbacks from the rear property line for Office Commercial
developments, parking is required to be located at the rear
of the building.
Upon questioning by the Planning Commission, Mr. Turner
indicated that the current locations of the pharmacy, which
is located in the same block as the proposed location, is
adequate, but more space will be needed in the future for the
business.
Mr. Turner stated that the alternative to this type of
development within the DC District is apartments, which could
have a larger impact upon the residential character of the
neighborhood than a light commercial use.
Karen Mitchell, 209 South Vine Street, indicated that she has
no objections to the drug store, but was concerned about
access to Vine street from the property.
steve-.Frick. 612 -East, Second street., indicated that the only
concern would be that Second street is going to develop into
a retail/commercial corridor, similar to First, Front and
Lincoln.

There being no further testimony, Chairman Leonard closed the
public hearing.
Upon questioning by the Planning Commission, Mr. Turner
indicated that both curb cuts will be ingress/egress and must
be back 50 feet from the corner of Second and Vine.

Mr. Catts moved to recommend approval of the Conditional Use
Permit application, citing the following findings and
conclusions:
Findings:
1. The Port Angeles Zoning Code requires that prior to
acting on a Conditional use Permit, the Planning
Commission must hold a duly advertised public hearing.
2. Public notice, as required by the Port Angeles Zoning
Code, has been given.
3. The Port Angeles Zoning Code states that the Planning
Commission shall consider all applications for Condi-
tional Use Permits and may grant said permits for such
uses as by the Zoning Regulations are required to be
reviewed and which can be permitted only upon granting
of a Conditional Use Permit.
4. The Zoning Code states that the purpose of the Condi-
tional Use Permit shall be to assure that the maximum
degree of compatibility between uses shall be attained.
The proposal is to construct a 6,380 square-foot pharmacy
building on three standard Townsite lots, described as
Lots 1 through 3, Block 57, of C. C. Leighton's Subdi-
vision of Suburban Lot 24, as recorded in Volume 1 of
plats, page 94.
6. The subject property is zoned Office Commercial, which
allows "businesses selling medical supplies, goods,
instruments, medicine, and similar itemstl with a
Conditional Use Permit obtained from the Planning
Commission and City Council.

7. Chapter 17.23 of the Port Angeles Zoning Code identifies
various development standards that structures locating
within the Office Commercial zoning district must meet.
These standards include height, lot coverage, lighting,
signage, and landscaping.
Conclusions:
A. The proposed activity can be permitted through the
granting of a Conditional Use Permit.
B.
The proposal is consistent with the tests for issuance
of a Conditional Use Permit, as found in Article XI,
Section 5, of the Port Angeles zoning Code.
C.
Procedural requirements relating to public notice and
public hearing have been accomplished.

district are adequate to ensure the proposed use is
compatible with the surrounding area.

PARKING VARIANCE PKV-90(05)2 OLYMPIC MEMORIAL
HOSPITAL, 939 Caroline street: Request for a reduction
in the required number of parking spaces for expansion
of the Olympic Memorial Hospital, located in the PBP,
Public Buildings and Parks. District.
Mr. Collins indicated that the city is currently waiting for
information from the Hospital District regarding the improve-
ment of Caroline street and that the public hearing of this
matter should be opened and continued to the next regular
current planning meeting of the Planning Commission.

Ms. Davison indicated that she had an appearance of fairness
problem on this matter because of her employment at the
Hospital. Ms. Davison stepped down.
Chairman Leonard opened the public hearing. There being no
one wishing to speak to the matter, Mr. Gruver moved to
continue the public hearing to June 13, 1990, at 7:00 P.M.,
or as soon thereafter as possible, in the city Council
Chambers. Mr. Hulett seconded the motion, which carried 6 -
O.
Ms. Davison returned to the dais.

presented the Department Report, recommending approval of the
permit with three conditions.
Mr. Philpott asked Fire Marshal Becker if fire extinguishers
'need to be serviced annually, and if so, should this be a
condition of this Home Occupation and all future Home Occu-
pations. Fire Marshal Becker indicated that this, in fact,
is the case.

The Planning Commission discussed the parking requirements for
the Home Occupation and indicated that paving the lot would
not be in the public interest.

Shelly Sherf, 1121 South Pine Street, indicated she would like
to operate a small Home Occupation. She has prepared a park-
ing plan for submittal to the Department of Public Works and
indicated that a handicapped ramp is not needed for the
business.
Michael Sherf, 1121 South Pine street, said that the parking
has been taken care of and that the Department of Public Works
has approved the parking plan.
It was moved by Mr. Philpott to approve the Conditional Use
Permit, subject to the following conditions, and citing the
following findings and conclusions:
1. Prior to issuance of a building permit for the change of
use, the applicant shall provide the Department of Public
Works a non-paved parking plan, which shall be approved
by the Department and implemented by the applicant prior
to occupancy of the use.
2. Hours of operation for the Home Occupation shall be
limited to 9:00 A.M. to 9:00 P.M., by appointment only.
3.
The applicant shall provide a 1A10BC fire extinguisher
as required by the Port Angeles Fire Department, which
shall be serviced annually.
Findinqs:
1. The Port Angeles Zoning Code requires that prior to
acting on a Conditional Use' Permit, the Planning
Commission must hold a duly advertised public hearing.

3. The Zoning Code states that the purpose of a Home
Occupation is to ensure that an occupation or business
undertaken within a dwelling unit located in a residen-
tial use district is incidental to the primary use and
is compatible with the residential character of the
neighborhood.
4. - --The-subj ect 'property- -is-described as Lots 11 and 12,
Block 347 of the Townsite of Port Angeles, and is located
at 1121 South pine Street.
5.
The proposal would allow the use of a carriage house
attached to a single-family dwelling as a manicure salon,
to be operated by a single employee (the applicant), with
hours of operation from 9:00 A.M. to 9:00 P.M., by
appointment only.

6.
The subject property is zoned Residential Single-Family
(RS-7), which allows Home Occupations as a conditional
use.
7. The Port Angeles Fire Department has indicated that a
fire extinguisher will be required by the use.
8. The Home Occupations Chapter of the zoning Code allows
the Planning commission to allow hours of operation
beyond those normally allowed for a Horne Occupation.
9. The Department of Public Works found that the use of the
dead-end section of 12th street for parking of a limited
amount of cars should not impact adjacent residences.
Conclusions:
A. The proposed activity can be permitted through the grant-
ing of a Conditional Use Permit for a Home Occupation.
B. The proposal, as conditioned, is consistent with the
tests for issuance of a Home Occupation, as found in
section 17.86.080 of the Port Angeles Zoning Code.
c.
Procedural requirements relating to public notice and
public hearing have been accomplished.
Mr. Hulett seconded the motion, which carried unanimously.
V COMMUNICATIONS FROM THE PUBLIC
None.
VI STAFF REPORTS
Planning Department staff indicated that the DelHur SEPA
appeal is scheduled for May 16, 1990. However, because of
information still being received and reviewed by the Planning
Department from the applicant regarding the Planned Residen-
tial Development, and the fact that the applicant will be
applying for a subdivision also, the Department would request
that the Planning Commission consider holding a special
meeting on June 6, 1990, for both the continued hearing on the
~ ."Pl'anned'~Residential -Development -and'a-hearing on the subdi-
vision.
The Planning commission discussed the pros and cons of holding
a special meeting for this item. It was moved by Mr. Philpott
that the Commission schedule a special meeting for June 6,
1990, in order to continue the DelHur PRD application and to
hold a hearing on the subdivision at that time. Mr. Anabel
seconded the motion, which carried 5 - I, with Mr. Gruver
voting "No", and Ms. Davison abstaining.

The Planning Department also indicated that the City Attorney
had requested that the Department no longer post on telephone
poles or power poles. The Department is considering preparing
larger posting notice signs to be used only on-site and will
be submitting these items for the Planning commission I s review
in the near future.
VII REPORTS OF COMMISSIONERS
Ms. Davison indicated that a recent Home occupation bed and
breakfast in her neighborhood was required by the Department
of Public Works to stripe an existing parking lot. Ms.
Davison felt the striping detracts from the residential
character of the area and would like the Planning Department
and Department of Public Works to review this issue.
Ms. Davison also indicated that it appears from the Zoning
Code that the Office Commercial intent and the actual
permitted uses in the Office Commercial District are not
necessarily consistent.
Mr. Anabel indicated that his address has been changed to 3711
Mount Angeles Road.
The Planning Department indicated they would review the
Thunderbird Boathouse Conditional Use Permit and forward any
correspondence from the Department of Public Works regarding
the paving of the parking lot to the Planning Commission.
VIII ADJOURNMENT
It was moved by Mr. Hulett that the Planning Commission
adjourn. Mr. Anabel seconded the motion, which carried
unanimously. The meeting was adjourned at 10:25 P.M.
