Chair Alexander called the meeting to order at 7:00 p.m.

Commissioner Nutter moved to accept the April 27, 1994, minutes as presented.
Commissioner Philpott seconded the motion, which passed 6-0.
IV. PUBLIC HEARINGS:
SHORELINE MANAGEMENT PERMIT - SMA 94(04)141 - K-PLY. 439
Marine Drive: Request to allow the construction of a 3,000 sq.ft. roof over an
existing fuel storage pile in the M-2, Heavy Industrial, District.
John Jimerson reviewed the Department Report and responded to questions from the
Commission regarding the need for the permit. Chair Alexander opened the public
hearing.

Dave Mackey, 4118 S. Bean Road, represented K-Ply and answered questions from the
Commission indicating that the excavation of approximately twenty-seven yards of
material is for support footings for the roof cover. The cover is engineered to withstand
expected weather conditions. In response to Commissioner Nutter, Mr. Mackey stated
that there is plenty of room around the fuel pile area to manage a fire in the event one
should occur but that the fuel is usually very wet and not in danger of igniting.
Commissioner Winters asked the applicant if he understood the conditions recommended
by staff. Mr. Mackey answered that he did.

To clarify discussion concerning the depth of the fill which may be at this site, Mr.
Jimerson stated that Ken Sweeney, of the Port of Port Angeles, had indicated that core
samples had been taken which could determine the depth of fill in the area.
There being no further testimony, Chair Alexander closed the public hearing.
Commissioner Winters moved to forward a favorable recommendation to the City
Council for approval of the pennit with the three conditions and findings and
conclusions as recommended by staff which are as follows:
Conditions:
A. The applicant shall retain a qualified archaeologist to monitor the excavation
activities, unless the applicant can demonstrate that the depth of the excavation
will not go beyond the depth of the fill material. Upon discovery of evidence of
possible archaeological significance, the applicant shall follow the
recommendations of the archaeologist for proceeding, consistent with all relevant
state and federal historic preservation laws.
B.
The applicant shall submit a site plan to the Planning Department identifying the
location of the disposal of excavated materials. Any materials placed within the
log pond shall comply with the requirements of the Army Corps of Engineers,
Departments of Ecology and Wildlife, and any agencies with jurisdiction.
C. The project shall comply with the National Electrical Code, including meeting the
required clearances.
Findings:
1. The approval is for construction of a 60' x 50' roof to cover a fuel storage area
within the K-Ply mill site.
2. The project involves excavation of 27 cubic yards of material. The site has been
filled to an unknown depth.
3. The site is in close proximity to S'Klallam Village sites, including one at the base
of the Daishowa Mill to the west and one at Hollywood Beach to the east.
4. The site is improved with a plywood mill including several buildings, paving, log
and fuel storage.
5. The site is zoned Heavy Industrial (M-2) and designated Heavy Industry in the
Comprehensi ve Plan.
6.
The Port Angeles Shoreline Master Program designates the site "Urban" and its'
regulations have been considered in review of this application.
7. The Port of Port Angeles has been granted a permit for fIlling in the K-Ply Pond
to the north.

Conclusions:
A.
As conditioned, the proposal is consistent with the Port Angeles Shoreline Master
Program, specifically General Regulations C.l, 2 & 4; Land Use Element D.7;
and Use Activities F.18.
B. The industrial use is consistent with the Heavy Industrial designations of the site
in the Zoning Ordinance and Comprehensive Plan.
C. As conditioned, the proposal will not be detrimental to the shoreline.
Commissioner Campbell seconded the motion which passed 6 - O.
EXTENSION OF CONDITIONAL USE PERMIT - CUP 92(02)04 -
BUDGET RENT-A-CAR. Northwest comer of Front and Oak Streets:
Request to extend a conditional use permit which allows a commercial
parking lot to be operated in the CBD, Central Business District.
Greg Patterson, 529 East Sixth Street, represented Budget Rent-A-Car. He asked that
the Commission not require paving because the lot is leased to them and the owner has
not given permission for paving in the past. The lot is used for approximately two
months a year, during the months of July and August, as overflow parking by travelers
who leave vehicles for lengthy periods of time. Approximately twelve persons who work
at the food bank across the street use the lot on a daily basis. The current lease of the
property is open ended as the property is for sale.
In response to Commissioner Nutter, Mr. Patterson answered that wheel stops are not
used as they hinder ease of movement given the various sizes of vehicles using the lot,
i.e., recreational vehicles, and an attendant is on duty when the lot is in operation to
assure orderly parking. There is no storm drainage problem as the lot is below grade and
percolates readily.
There being no further testimony, Chair Alexander closed the public hearing.
Commissioner Gennan moved to approve a one year extension of the conditional use
permit as requested, with two conditions as follows, and citing the noted f"mdings
and conclusions:
Conditions:
1. The extension shall be for a one year period, until May 13, 1995.
2.
A parking Jot attendant shall be on-duty during those times when vehicles are
being parked.

Findines:
1. The Central Business District zone allows independent parking lots as a
conditional use.
2. The use of the property as a parking lot is not consumptive of limited land
in the Central Business District and can be converted to a higher use.
3. There are other independent parking lots in the vicinity.
4. The Victoria ferries generate the need for long.term off-street parking in the
Downtown area.
5. The parking ordinance requires that parking lots providing required parking
shall be paved with concrete, asphalt or other hard surface paving. The
ordinance does not contain standards for parking lots not intended to provide
required parking.
6. The applicant has operated the parking lot at this location since 1990.
7. There have been no complaints with regard to the operation of the parking
lot.
Conclusions:
A. As conditioned, the proposed use is compatible with the surrounding
commercial uses and with the intent of the CBD zone.
B. As conditioned, the Conditional Use Permit is in the public use and interest
and is not detrimental to tbe public welfare.
C. As conditioned, the proposal is consistent with the Comprehensive Plan
Central Business District designation.
Commissioner Winters seconded the motion. In speaking to his motion, Commissioner
German agreed that this area is used minimally and as it is not the wish of the owner to
pave the area, if a requirement were made that it be paved, it probably would not be and
would cease to be utilized as overflow parking. Therefore, the vehicles now being stored
off-street would end up on the streets and in available parking lots Downtown.
Commissioner Winters added that there is no indication the use of the overflow parking
area is increasing or that the intention is to use it for other than intermittent or permanent
parking.
Commissioner Philpott stated that the lot is being used as permanent parking for at least
twelve persons now. The proposed microbrewery recently approved for the lot across
the street from the site will cause more use of the property. He concurred with the
Planning Department's recommendation for improvement to the site as the lot is
becoming a permanent parking area.

Mr. Jimerson answered questions from Chair Alexander concerning parking standards and
requirements for required parking versus parking which is not required under the City's
Parking Ordinance.
Commissioner Campbell added that the cost of the improvement may exceed the cost of
doing business if the lot were required to be improved.
Mr. Patterson answered that payment for use of the lot is based on a percentage of
revenues.
Chair Alexander indicated that he could go along with the temporary use for one more
year but further extension may be viewed as indicating permanency, and, based on
changes which may occur in the Downtown area during the next year J the use may not
be approved further or will need improvement prior to further extension. Commissioner
Nutter agreed.
The motion was called for and passed 6 - O.
V. COMMUNICATIONS FROM mE PUBLIC:

. VI. STAFF REPORTS:
Sue Roberds indicated that she had contacted the Project Maintenance Engineer for the
Washington State Department of Transportation with regard to a letter sent from the
Planning Commission expressing dissatisfaction with the repair of potholes on First Street
and had been informed that the potholes will be re-repaired within the next couple of
weeks.

PUBLIC HEARING PROCEDURE: Spokesmen for the proponents and opponents will be given an opportunity to
speak to the request. Information submitted should be factual, relevant and not merely duplication of a previous
presentation. A reasonable time (10 minutes) shall be allowed the spokesman; others shall be limited to short
supporting remarks (5 minutes). Other interested parties will be allowed to comment briefly (5 minutes each) or
make inquiries. The Chairman may allow additional public testimony if tbe issue warrants it. Brief rebuttal (5
minutes) for proponents and opponents will be heard separately and consecutively with presentation limited to their
spokesman. Rebuttal shall be limited to factual statements pertaining to previous testimony. Comments should be
directed to the Board, not the City Staff representatives present, unless directed to do so by the Chairman.
