BOARD OF ADJUSTMENT

I CALL TO ORDER
Chairman Lacey called the meeting to order at 7:10 P.M.

Members Present: Jim Rexroat, John Lacey, Lucia McPhee.
Members Absent: Scott Lewis, Steve Pazan.
Staff Present: Paul D. Carr, Dan VanHemert.

IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-8S (2) 2 - Daniel & Janet Gouin request for
reconsideration of a variance which the Board
originally heard in February, 1985, requesting
reduction of the required side yard setback of 7
feet to S feet, to allow a single-story addition
to be constructed onto an existing residence.
Location: 823 East Sixth Street.
Mr. VanHemert reviewed the Department Report. Chairman
Lacey opened the public hearing.
Dan Gouin explained previous submittals and the.arrangement
of the usable floor space in the house. The Board members
asked Mr. Gouin several questions regarding alternative
configurations and special circumstances related to the
property. Following further discussion, Chairman Lacey
closed the public hearing.
Ms. McPhee moved to grant a variance reducing the side yard
setback from 7 feet to 5 feet to allow a single-story
addi tion to be constructed onto an existing residence,
citing as findings:
A. The request is not unreasonable nor a special privilege,
given the similar conditions of surrounding properties.

The arrangement of the house precluded other options.
Mr. Rexroat seconded the motion, which passed 2 - 1 with
Chairman Lacey voting "Noll.
V-85(6)14 - Ray T. Barnes. Request for a reduction of
the required 25-foot front yard setback to 22 feet, to
permit a small addition to an existing single-family
residence. Location: 104 Columbus Street.
Mr. VanHemert reviewed the Department Report.
Lacey opened the public hearing.

Mr. Barnes explained the need for the variance. Following
questions from the Board, Chairman Lacey closed the public
hearing.
Mr. Rexroat moved to grant a variance reducing the front
yard setback from 25 feet to 22 feet to permit a small
addition to an existing single-family residence, citing the
following findings:
A.
The corner location and the situation of the property
in an area which has numerous setbacks resulting from
inaccurate plats are special circumstances which deny
the property the use right of a small addition.
B. Since special circumstances related to the property
exist, the variance will not grant a special privilege
to the subject property.
C. The addition will not be materially detrimental or
injurious to nearby properties or the public welfare.
Ms. McPhee seconded the motion which passed unanimously.
III MINUTES
Ms. McPhee moved to correct the May 6, 1985, minutes to
re-adopt the April 1, 1985, minutes. Chairman Lacey
seconded the motion, which passed 2 - 0, with Mr. Rexroat
abstaining.
Ms. McPhee then moved to approve the minutes of May 6, 1985,
as corrected. Mr. Rexroat seconded the motion, which passed
2 - 0 with Chairman Lacey abstaining.
VI STAFF REPORTS
Mr. VanHemert invited the Board to suggest potential revisions
to the residential chapters of the Zoning Code for the Plan-
ning Commission's Consideration.
