BOARD OF ADJUSTMENT

CALL TO ORDER
Chairman Pazan called the meeting to order at 7 PM.

Members Absent: Jim Clevenger, Jim Rexroat
Staff Present: Dan VanHemert, Louise Frost
III APPROVAL OF MINUTES
Mr. Lacey moved to approve the minutes of the April 12th
meeting as submitted. Mrs. Tinkham seconded this
motion, which passed unanimously.

IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-82(6)4 - W. A. ROBERTS. Request for a variance to
reduce the side yard setback from 7' to 4'; and to
reduce the rear yard setback from 25' to 16'.
Location: 1212 West Fourth Street.
Mr. VanHemert reviewed the Department Report; Chairman
Pazan opened the public hearing.
W. A. Roberts, 1212 West Fourth Street, said the
requested variances will not be detrimental to the
area. The house to the west is located on two lots and
straddles their common line. He has not received
complaints from any of the neighbors. Chairman Pazan
closed the public hearing.
Mrs. Tinkham moved to approve the side and rear yard
variances for the following reasons:

A. The available building space on the lot is limited
by the bluff; therefore, topography is a special
circumstance related to the lot which limits use
rights.

B. Since other structures in this vicinity and RS-7
Zone encroach upon rear and/or side yards, and
similar variances have been granted, the variances
would not be considered a grant of special
privilege.
C. The variances will not be detrimental to the public
welfare or injurious to nearby properties and
utilities.
Mr. Lacey seconded this motion, which passed
unanimously.
V-82(6)5 - DENNIS C. ALWINE. Request for a variance
to reduce the side yard setback from 131 to 8'; to
reduce the alley setback from 25' to 10'; to move an
existing house onto a vacant lot and construct an
attached garage. Location: 916 South Race Street.
Mr. VanHemert reviewed the Department Report; Chairman
Pazan opened the public hearing.
Dennis C. Alwine, 1234 East Front Street, said he would
be available to answer any questions. There being no
questions from the Board or comments from the audience,
Chairman Pazan closed the public hearing.
Mr. Lacey moved to approve the side and rear yard
variances, citing the following findings:
A. Peabody Creek Ravine ~s a special circumstance which
limits the use right of the parcel as a residential
lot.
B. Other lots in the RS-7 Zone and vicinity may be used
for single-family residential purposes, including
accessory covered off-street parking; therefore, the
variances are not a grant of special privilege.
c. Granting the variances will not create a sight-
distance problem, traffic impediment, or other
material detriment to the public welfare or
properties in the vicinity.
Mrs. Tinkham seconded this motion, which passed
unanimously.

V-82(6)6 - THOMAS R. DEENEY. Request for a variance
to reduce the 8t side yard setback to 5'; to extend
an existing garage. Location: 1138 Highland Avenue.
Mr. VanHemert reviewed the Department Report; Chairman
Paz an opened the public hearing.
Thomas R. Deeney, 1138 Highland Avenue, requested a
continuance of this matter to the July meeting since
he just returned from out of town. Chairman Pazan
closed the public hearing.
Mrs. Tinkham, at the request of the applicant, moved to
continue this matter to the July Board meeting. Mr.
Lacey seconded this motion, which passed unanimously.
V-82(6)7 - KENNETH M. LANE, DEBRA J. BROOKS.
Request for a variance to reduce the front setback
from 251 to 19' for an existing residence.
Location: 1403 South Cedar Street.

Mr. VanHemert reviewed the Department Reportj Chairman
Pazan opened the public hearing.
Kenneth M. Lane said he needs the 8-foot addition to
make a larger bedroom and living room. Chairman Pazan
closed the public hearing.
Mrs. Tinkham moved to grant the front yard variance,
citing the following findings:
A. The lot dimensions and corner location are special
circumstances of the lot which restrict the use
rights for residential purposes more than those
enjoyed by other properties in the immediate
vicinity and RS-7 District.
B. Because minor front yard encroachments exist within
this area and also elsewhere in the RS-7 District,
this variance does not constitute a grant of special
privilege.
c. The variance will not cause a fire hazard, view
obstruction, traffic problems within this vicinity,
or other material impact on the public welfare and
abutting properties.

Mr. Lacey seconded this motion, which passed
unanimously.

V-82(6)8 - RONALD E. BRADSHAW. Request for a
variance to increase the present 31.4% lot coverage
to 34.8%; to permit construction of 336 square-foot
addition to the recreation room area. Location:
1638 West Twelfth Street.
Mr. VanHemert reviewed the Department Report; Chairman
Pazan opened the public hearing.
Karen Renfroe, representing Ronald E. Bradshaw, said
most of the lots in the immediate block are larger than
the standard Townsite lot. Other lots in the block have
as much lot coverage. Mr. Bradshaw needs the larger
quarters for his children and possibly foster children
in the future. He would like a continuance of this
matter until the July meeting when he can be present.
Mr. Lacey mentioned that no other house in the immediate
block even equals the present square-footage of the
Bradshaw residence, according to the County Assessor's
records. Ms. Renfroe responded the Bradshaws have a
large family. Chairman Paz an closed the public hearing.
Mrs. Tinkham moved to continue this matter to the July
Board meeting. Mr. Lacey seconded, and the motion
passed unanimously.

STAFF REPORTS
Mr. Lacey moved to set the July meeting date for Monday,
July 12th. Mrs. Tinkham seconded, and the motion passed
unanimously.
VII REPORTS OF BOARD MEMBERS
Mrs. Tinkham: Reported on a planning workshop she
attended. She suggested that neighborhood meetings be
held to educate the public as to what the City is
doing for them. She also requested that findings of
fact for her motions on Board hearings be prepared by
the City Attorney.
