I CALL TO ORDER
Chairman Hulett called the meeting to order at 7:00 PM.

III APPROVAL OF MINUTES of May 25/ 1983

Mr. Anderson moved to approve the minutes of the May 25,
1983, meeting as submitted. Ms. Ross seconded the
motion, which passed unanimously.
IV HEARINGS
CONDITIONAL USE HEARING - WELLS. Application for a
Conditional Use Permit to establish a mail order and
retail sales business of hunting firearms and related
equipment as a Home Occupation. Location: 321 East
Ninth Street.
Mr. Cornell left the room, due to an appearance of
fairness.
Mr. Carr reviewed the Department Report; Chairman Hulett
opened the public hearing.
Mr. Holm asked about fire protection requirements for
gunpowder storage. Gary Braun, City Fire Marshal,
reviewed the Uniform Fire Code.
Mr. Puckett asked about shooting firearms on the site.
Mr. Wells, the applicant, noted that there would be no
discharge of firearms and the amount of powder and
ammunition stored would be determined by the Fire Code.
Chairman Hulett closed the public hearing.

After discussing home occupations in accessory buildings,
Mr. Holm moved" to table the application, which motion
died for lack of a second. Ms. Ross moved to approve the

Home Occupation permit, which motion also died for lack
of a second. Mr. Holm moved to table the application to
review an amendment to the Zoning Ordinance regarding
Home Occupations in accessory buildings. Mr. Banner
seconded the motion, which passed 3 - 2.
Ms. Ross moved to set a public hearing for June 22, 1983,
for an amendment to consider Home Occupations in acces-
sory buildings. Mr. Holm seconded the motion, which
passed 5 - 1.

Interpretation - Lumber Storage in the CSD-Cl
District.

Mr. VanHemert reviewed the Department Report and explained
that while the use as an open lumber yard may be occurring
in a vacant lot, the construction of a storage building
to house a pre-existing nonconforming use is contrary to
Article XI, Section 1 of the zoning Ordinance, which re-
quires that all new buildings, including their use,
comply with the zoning regulations. After extended dis-
cussion, Ms. Ross moved that a lumber storage building is
compatible with the uses in the CSD-Cl District as a Con-
ditional Use. Mr. Banner seconded the motion, which
passed 5 - 2. Messrs. Cornelland Holm, the dissenting
votes, expressed reservations about the compatibility of
a lumber yard in a Cl District near residential develop-
ment.
CONDITIONAL USE HEARING - ANGELES MILLWORK. Applica-
tion for a Conditional Use Permit to use a building to
be constructed for lumber storage. Location: 1601
South "C" Street.
Mr. VanHemert reviewed the Department Report for the Con-
ditional Use Permit. Chairman Hulett opened the public
hearing.

Robert Eshom, owner of Angeles Millwork and Lumber Co.,
stated that would be no more movement of lumber or
vehicles, and considerably less dust and noise if a
lumber storage building were constructed. It will
protect the lumber from the natural elements. Paul
Pendergrass, an employee of Angeles Millwork and Lumber
Co., described the height and size of the building,
noting that the views from the surrounding apartments
will not be obstructed. Chairman Hulett closed the
public hearing.

Mr. Cornell asked about traffic on 16th Street. Mr.
Eshom said the volume would not change. Mr. Puckett
asked whether other land on the Millwork's property could
be used for lumber storage; for example, the building
housing the grain store. Mr. Eshom said the structure
was not suitable.
Ms. Ross moved to recommend approval of the Conditional
Use Permit, subject to compliance with the Uniform Fire
Code, citing the following as findings of fact:
1. The storage building will lessen fire danger.
2. It will be a visual improvement and provide security.
3. It is a needed use in this area of the City.
4. Since it is an existing use, the building will reduce
negative impacts on nearby properties.
Mr. Anderson seconded the motion, which passed
unanimously.

CONDITIONAL USE HEARING - BROWN. Application for a
Conditional Use Permit to establish a bookkeeping
service as a Home Occupation. Location: 622 South
Valley Street.
Mr. VanHemert reviewed the Department Report; Chairman
Hulett opened the public hearing.
Philomena Brown stated that there will not be an addition
to the house for the office, and the fire extinguishers
are installed. Chairman Hulett closed the public
hearing.
Mr. Anderson moved to recommend approval of the Conditional
Use Permit subject to the condition that fire extinguishers
are installed in accordance with Fire Department require-
ments, citing the following findings of fact:
1. The Home Occupation will not result in the generation
of excessive noise, fumes, smoke, dust or introduce
adverse conditions into this residential
neighborhood.
2. It will not increase traffic over that normally
experienced on Valley Street.

3. The Home Occupation will not be injurious to the
adjoining properties or endanger the public health,

safety and welfare, and it lS ln the interests of the
general public.
Mr. Holm seconded the motion, which passed unanimously.
SHORT PLAT APPEAL - ALLEN.

Mr. VanHemert advised that a sidewalk adjacent to Peabody
Street has been required as part of preliminary approval
of Short Plat No. 'SP-83 (3) I because Peabody is an arterial
near the High School, and two properties directly south
of this property have sidewalks. Art Dunker, representing
the applicant, reviewed the Peabody Street L.I.D. when
sidewalks were installed on the east side of Lincoln
Street and on the west side of Chase Street. There is an
underground telephone trunk line on the west side of
Peabody Street and a telephone pole near the alley which
must be relocated. Mr. Cornell asked whether the side-
walk could be installed on private property or in the
public right-of-way. He was told that sidewalks are
constructed in the right-of-way.
The Commission then discussed utilities adjacent to the
property and ownership of the unimproved Peabody Street
right-of-way. Mr. Cornell moved to continue this appeal
until June 22, subject to a request to the City Attorney
to determine the ownership of the Peabody Street right-of-
way. Ms. Ross seconded this motion, which passed
unanimously.
Mr. Anderson returned to the hearing room.
REZONE HEARING - LINDBERG/HARTMAN. Request to rezone
42,000 square feet from CAD (Commercial Arterial
District) to RMF (Residential Multi-Family). Location:
South side of Front Street, West of Peabody Street.
Mr. Carr reviewed the Department Report. In response to
a question, he explained that single-family homes and
duplexes are specifically prohibited in the commercial
districts. Chairman Hulett opened the public hearing.

Bill Lindberg, representing the applicant, said the
topography makes commercial development impractical~ the
uses have remained residential, though the property is
commercially zoned; and there is no direct access to
Front Street. Chairman Hulett closed the public hearing.

Mr. Cornell moved to recommend rezoning the property to
RMF citing the following findings of fact:
1. The proposed rezone complies with the multi-family
Residential policies of the Comprehensive Plan.
2. The present residential uses have not weakened the
CAD Zone; therefore, the requested down-zone would
not weaken it.
3. Residential uses may strengthen the CAD Zone.
4. There are site-specific topography conditions which
make the area less desirable for commercial use.
5. High-density residential development may benefit the
Central Business District.
Ms. Ross seconded the motion, which passed unanimously.

CONDITIONAL USE HEARING - MORGAN/SINNES. Application
for a Conditional Use Permit to operate a Retail Stand
for the sale of prepared seafoods and soft drinks.
Location: 131 East Railroad Avenue.
Mr. VanHemert reviewed the Department Report; Chairman
Hulett opened the public hearing.
Dan Sinnes, 219 South Liberty, described the proposed
retail stand, the site, and the prospective customers.
Mr. Holm asked about disguising the trailer. A facade
will be constructed around the trailer and hitch.
Chairman Hulett closed the public hearing.
Ms. Ross moved to recommend granting the Conditional Use
Permit, subject to the following conditions:
1. A fire extinguisher, refilling procedures and testing
procedures be in accordance with the requirements of
the Fire Department.
2. That the retail stand, trash receptacles, tables and
chairs not be placed on the sidewalk and be set
sufficiently back from the sidewalk so as not to
cause a pedestrian obstruction.
3. That skirting be installed and the hitch hidden.

4. That prior to operation, a County Health Department
permit must be issued.
She cited the following findings of fact:

A. The retail stand at this location will not be a
burden to public utilities, streets, or pose a
pedestrian hazard.
B. The retail stand will reinforce the emerging tourist
and pedestrian nature of Railroad Avenue and enhance
the economic vitality of the Central Business
District.
C. Located in the Central Business District, the stand
will comply with the Comprehensive Plan and Zoning
Ordinance.
Mr. Puckett seconded the motion, which passed 5 - 2.
Messrs. Banner and Cornell cast dissenting votes, because
the proposed use would create an appearance that was not
compatible with the Downtown image.
CONDITIONAL USE HEARING - RAMSEY. Application for a
Conditional Use Permit to operate a mobile steam
pressure cleaning business as a Home Occupation.
Location: 1032 East Fourth Street.
STREET VACATION HEARING - LAMB. Petition to vacate
that portion of Fifth Street west of Tumwater Truck
Route. Location: Fifth Street, west of the Truck
Route.
CONDITIONAL USE HEARING - GLASS. Application for a
Conditional Use Permit to operate a "Bed & Breakfast"
as a Home Occupation. Location: 108 South Oak Street.
The above three items were continued to the July 13th
meeting on a unanimous vote of a motion by Mr. Cornell
which was seconded by Ms. Ross.
V COMMUNICATIONS FROM THE PUBLIC
None.
VI STAFF REPORTS
Interpretation - Welding Shop in the CSD-Cl District.
Mr. VanHernert distributed a memo regarding a welding
shop, an unspecified use in the Cl District.
Mr. Holm moved to interpret that a metal fabricating shop
is neither a permitted nor a conditional use in the
CSD-Cl District. Mr. Cornell seconded the motion which
passed unanimously.

VIII REPORTS OF COMMISSIONERS
Mr. Anderson expressed concern about the sale of used
cars at Ninth and Lincoln.
Chairman Hulett questioned the dirt pile adjacent on the
north side of Front Street.
Mr. Cornell suggested considering revising the practice
of putting the Chairman's vote with the majority when the
Chairman does not actually cast a vote.
Mr. Holm questioned whether the hearings could not con-
tinue after 10:00 for the convenience of the applicants.
Mr. Anderson explained that the rule eliminated extremely
late meetings.
Other Commissioners: None.
