BOARD OF ADJUSTMENT
Port Angeles, Washington
July 2, 1984
I CALL TO ORDER
Vice-Chairman Lewis called the meeting to order at 7:13 P.M.
II ROLL CALL
Members Present: John Lacey, Scott Lewis, Steve Pazan.
Members Absent: Jim Rexroat, Evelyn Tinkham.
Staff Present: Dan VanHemert.
III APPROVAL OF MINUTES
Mr. Lacey moved to approve the minutes of the June 4, 19B4,
meeting as submitted. Mr. Pazan seconded the motion, which
passed unanimously.
IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-84(5)8 - James O. Sullivan. A variance request to
reduce the 25' rear yard setback returement to 71 and
the 71 side yard to 31 to allow the construction of a
second story addition to an existing residence; and a
variance of the 7' side yard setback to 2' to permit
the construction of an attached carport. Location:
1221 West Fifth Street. (Continued from June 4, 1984.)
Mr. VanHemert explained that the Applicant has requested a
one-month continuance. This application was continued to
the August 6, 1984, meeting.
V-84(6)9 - Harold Layman. A request for a variance in
the lot size from 7,000 sq.ft. to 5,719 sq.ft., and a
front yard variance from 25' to 4' to allow the
creation of a building lot. Location: 1056 Fairmount
Avenue. (Continued from June 4, 19B4.)
Mr. VanHemert presented the Department Report.

Harold Layman, 20 Baak Road, explained that the lot size and
front yard variances are needed to replat the existing two
lots, creating a new building site. Mr. Layman stated that
annexation of a 30-foot strip has been requested and if it
is approved the lot area variances would not be necessary.
Vice-Chairman Lewis closed the public hearing.
After discussion, Mr. Lacey moved to approve the front yard
variance from 25 feet to 18 feet for the existing dwelling
unit for the following reasons:
1. Because it is a pre-existing nonconforming structure,
the variance is not a grant of special privilege.
2. The variance will not be detrimental to the general
public or create a hazard.
Mr. Pazan seconded the motion, which passed 2 - 1, with
Vice-Chairman Lewis voting "NO".
Mr. Pazan moved to deny the lot size variances because the
variance would create two non-conforming lots from one legal
parcel and is therefore a grant of special privilege. Mr.
Lacey seconded the motion, which passed unanimously.
V-B4(7)13 - Larry Lahr. Request for a variance to
allow a small addition onto an existing residence,
requiring a reduction in the 25' front yard setback to
111:2', in the RS-7 Zone. Location: 904 West 13th
Street.
Mr. VanHemert presented the Department Report. Vice-
Chairman Lewis asked where the front yard was measured from.
Mr. VanHemert explained that the front yard is measured from
the front property line, not the curb. Vice-Chairman Lewis
opened the public hearing.
Mr. Lahr explained that the house is small and the addition
is to the existing kitchen. Several other homes are closer
to "B" Street than his house. Vice-Chairman Lewis closed
the public hearing.
The Board and staff discussed the designation of required
yards on corner lots. Mr. Lacey moved to re-orient the
front yard to 13th Street and grant a side yard variance
adjacent to fiB" Street from 13 to 11 feet. There being no
second, the motion died. A five-minute recess was taken.
After the recess, Mr. Pazan moved to approve a front yard
variance from 25 feet to 11~ feet, citing the following
findings of fact:

1. The lot orientation and corner location are special
circumstances of the lot which restrict the use right
for an addition to a residential structure.
2. The variance of the front yard will not constitute a
grant of special privilege since there are houses
closer than 25 feet to "B" Street in this area, and
others in the RS-7 Zone encroach upon required yards
and a 25-foot setback off 13th Street is a condition.
3.
The variance will not
obstruction or traffic
materially detrimental
injurious to properties
cause a fire hazard, view
problem; thus will not be
to the public welfare or
in the vicinity.
Mr. Lacey seconded the motion, which passed unanimously.
The Board requested a legal opinion regarding the applica-
tion of a more stringent yard requirement as a condition of
granting a variance.
