BOARD OF ADJUSTMENT
Port Angeles, Washington

CALL TO ORDER
Chairman Lacey called the meeting to order at 7:00 PM.

Members Present: James Clevenger, James Rexroat, John
Lacey, william Lindberg, Eveiyn Tinkham
Members Absent: None
Staff Present: Dan VanHemert, Louise Frost
III APPROVAL OF MINUTES
Mr. Rexroat moved to approve the minutes of the June 1st
meeting as submitted. Mr. Clevenger seconded this motion,
which passed unanimously.

IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-8l(7)18 - ERNEST E. PROFFIT. Request for a
variance to reduce the rear yard from 25' re-
quired by Code to 16': to construct a back
porch/utility room addition to an existing
single-family residence. Location: 323 East
Thirteenth Street.
Mr. VanHemert reviewed the Department Report: Chairman Lacey
opened the public hearing.
Mr. VanHemert said a nearby property owner expressed interest
in the proposed addition. Mr. Proffit mentioned that the
house had originally been built about 50 years ago. Chair-
man Lacey closed the public hearing.

Mr. Lindberg moved to grant the variance, because it does
not appear to be detrimental to the neighborhood; nor does
it increase the encroachment into the rear yard. Mrs.
Tinkham seconded this motion, which passed unanimously.

V-81(1)2 - PACIFIC NORTHWEST COMMUNICATIONS. Re-
quest for extension of a variance of the 30-foot
height limitation to 50 feet; to construct a 50-
foot microwave tower. Location: 1017 East Front
Street.
Mr. Clevenger moved to extend the variance; ~lrs. Tinkham
seconded the motion.
Joe Fisher, representing the applicant, said they needed
the extension because they had not yet received approval
from the FCC. George Madsen said that he had protested
originally and is still in opposition. Mr. Lindberg asked
why; and Mr. Madsen said it would be detrimental to the
area. The City is trying to beautify the Downtown, and
recently passed a Sign Ordinance which he considers an in-
fringement on his rights.
On call for the question, the motion to extend the variance
for an additional six-month period passed unanimously.

V-8l(7)19 - DANA SIEBEL. Request for variance re-
ducing the front yard setback from 25' required by
Code to 7'; to construct a single-family residence.
Location: Southwest corner, Jones and Water Street.
Mr. VanHemert reviewed the Department Report. Mr. Lindberg
asked why the variance was before the Board if no permanent
structure could be erected over an easement; and Mr. Van-
Hemert said anyone could apply. Mrs. Tinkham asked what
tests could be done to assure the stability of the bank; and
Mr. Lindberg mentioned that the Building Department usually
insists on soils tests for areas near the edge of the bluff.
Mr. Clevenger said it appears that the Department considers
that a street still exists, even though the south half of
the right-of-way has been vacated; and pointed out that the
easement retained by the City leads nowhere. Chairman Lacey
said that if the variance is granted, the Building Depart-
ment could deny a permit because of requested construction
over an easement. He then opened the public hearing.

Gary Velie, representing the Applicant, said the City still
retains the north half of the right-of-way, which could be
used for utilities, if necessary, but the existing utilities
are located in the alley. In this particular case, there is
probably no reason for the easement. The primary purpose
for the 25-foot front setback is for sight distance, which
is not needed here. The Applicant has had soils tests done
by Western Testing Labs, and is willing to comply with all
of their recommendations. The proposed house would not
block a view. The purpose of the variance is to capitalize
on the view; and if the house were set back the required 25
feet, much of the view would be lost. There will be no

detriment to anyone else in the neighborhood. Chairman
Lacey observed that the proposed house would block the
view of the duplex on the east side of Jones Street. Mr.
Velie responded that any structure on the subject lot
would block the view for that duplex. Chairman Lacey
closed the public hearing.
Mr. Lindberg asked the applicant if a delay for one month
to enable the board to obtain an interpretation from the
City Attorney would be detrimental; to which Mrs. Siebel
responded yes.
Mr. Lindberg moved to grant the varlance for the following
reasons:
1. The required front yard setback is from the street,
which does not apply here.
2. The location of the house does not appear to be
detrimental to others.
Mr. Lindberg then attached the following conditions to his
motion for approval:

A. The easement problem to be worked out with the City
Attorney; i.e., receive assurance that the City doesc
not have any use for the property;
B. Soils analysis should be done and followed, to be
satisfactory to the Building Department.
Mr. Clevenger seconded this motion, which passed unanimously.
VI STAFF REPORTS
Chairman Lacey noted the answer from the City Attorney to an
earlier question regarding denying building permits to cer-
tain builders.
