CALL TO ORDER
Chairman Hulett called the meeting to order at 7 PM.

APPROVAL OF MINUTES

Mr. Anderson moved to approve the minutes of the June 22,
1983, meeting as submitted. Mr. Cornell seconded and the
motion passed unanimously.
Mr. Cornell moved to approve the minutes of the June 28,
1983 meeting as submitted. Mr. Banner seconded and the
motion passed 5 - 0, with Mr. Anderson abstaining.
Mr. Anderson moved to approve the minutes of the July 6,
1983, meeting as submitted. Mr. Cornell seconded the
motion, which passed unanimously.
IV HEARINGS
CONDITIONAL USE HEARING - RAMSEY. Application for a
Conditional Use Permit to operate a mobile steam
pressure cleaning business as a Home occupation.
Location: 1032 East Fourth Street. (Continued from
June 8, 1983.)
Mr. Carr reviewed the Department Report; Chairman Hulett
opened the public hearing.
There were no comments. Chairman Hulett closed the
public hearing.

Mr. Anderson moved to recommend approval of the Condi-
tional Use Permit for a two-year period subject to the
following conditions:

1. Business vehicles are not parked on the street.
2. No more than two business vehicles and one business
utility trailer be parked or stored at the site.
Citing as findings of fact compliance with the Home
Occupations Chapter of the zoning Ordinance. Mr. Puckett
seconded the motion, which passed unanimously.
STREET VACATION HEARING - LAMB. Petition to vacate
that portion of Fifth Street west of Tumwater Truck
Route. Location: Fifth Street, west of the Truck
Route. (Continued from June 8, 1983.)
Ms. Ross excused herself on the appearance of fairness
and left the hearing room. Mr. Carr reviewed the
previous actions on this request. Chairman Hulett opened
the public hearing; received no testimony and closed the
public hearing.
Mr. Cornell moved to recommend vacation of the Fifth
Street right-of-way subject to the original conditions
imposed by the Planning Commission and citing the
original findings of fact of the Planning Commission.
Mr. Anderson seconded the motion, which passed 5 - O.
[Ms. Ross returned to the hearing room.]
CONDITIONAL USE HEARING - GLASS.
Conditional Use Permit to operate
as a Home Occupation. Location:
(Continued from June 8, 1983.)
Application for a
a "Bed & Breakfast"
l08 South Oak Street.
Mr. VanHemert reviewed the Department Report. Chairman
Hulett opened the public hearing.
In response to questions from the Commission, Mr. Glass
explained that there would be some walk-in trade, but
primarily reservations, and a maximum two to three day
stay per customer. Chairman Hulett closed the public
hearing.
Ms. Ross moved to recommend approval of the Conditional
Use Permit for a one-year period, subject to the follow-
~ng conditions:
1. That a fire alarm system and fire extinguishers be
installed, per the Fire Department requirements.
2. That at least four additional off-street parking
spaces, approved by the Public Works Department, be
provided on the parcel.

3. Exits shall conform to the Uniform Fire Code
requirements.
4. Food handling activities shall comply with Health
Department requirements.
Mr. Anderson seconded the motion, which passed 5 - 1,
with Mr. Cornell voting "No" because the proposed
operation exceeds the size and scope intended for "Bed &
Breakfastll operations in single-family residential zones
and could generate additional traffic.
CONDITIONAL USE HEARING - WELLS. Application for a
Conditional Use Permit to establish a mail order and
retail sales business of hunting firearms and related
equipment as a Home Occupation. Location: 321 East
Ninth Street.

Ms. Ross moved toremove the Wells Home Occupation Condi-
tional Use Permit (CUP-83(6)8) from the table. Mr.
Puckett seconded and the motion passed 4 - 1 with Mr.
Anderson voting IINo". Mr. Cornell had left the hearing
room on the appearance of fairness. Mr. Puckett moved to
recommend granting of the Home occupation Conditional Use
Permit subject to the following conditions:
1. That the hours of operation be limited to between 9
AM and 5 PM, Monday through Saturday.
2. That the operation comply with the Uniform Fire Code
and the Uniform Building Code.
3. That the existing security equipment be maintained.
Ms. Ross seconded and the motion passed 4 - 1 with Mr.
Anderson voting "No" because the use of an accessory
building exceeds the scope of a Home Occupation.
CONDITIONAL USE HEARING - TUCKER. Application for a
Conditional Use Permit to conduct a mental health
counseling practice as a Home Occupation. Location:
218 Whidby Avenue.
Mr. VanHemert reviewed the Department Report; Chairman
Hulett opened the public hearing.

Paul Tucker explained that reducing the hours of opera-
tion to 8 PM would not cause him a problem, group ses-
sions of a maximum of eight is optimum for a therapist,
smaller numbers, such as four, do not function properly;
he anticipates 15 to 20 people per week, with approxi-
mately 3 days per week of operation. Chairman Hulett
closed the public hearing.

Mr. Anderson moved to recommend granting the Conditional
Use Permit for a period of one year, subject to the
following conditions:
1. No more than eight persons per session.
2. The hours of operation be from 8 AM to 10 PM.
3. The business operate three days per week.
4. There be a maximum of 15 clients per week.
Mr. Cornell seconded the motion. Following discussion,
Ms. Ross moved to amend the motion by removing the third
and fourth conditions and adding a new condition limiting
the operation to one group session per week. Mr. Puckett
seconded the motion which passed 5 - 1, with Mr. Cornell
voting "No". Chairman Hulett requested staff restate the
motion for the convenience of the audience. Mr. Carr
read the amended motion as follows: Motion to recommend
approval of the Conditional Use Permit for a Home Occupa-
tion for a one-year period, subject to the following
conditions:
A. There be not more than eight persons per group
session.
B. The hours of operation be from 8 AM to 10 PM.
C. No more than one group session per week.
On call for the question, the amended motion passed 6 -
0; the Commission citing the following findings of fact:
1. That the Home Occupation does not involve equipment,
and therefore will not introduce smoke, dust, fumes,
and other obnoxious conditions to this residential
area.
2. With the limited hours of operation and group sizes,
the Home Occupation will not significantly increase
local vehicular traffic, pedestrian traffic, or human
activity in this neighborhood.
3. The Home Occupation will not be injurious or
detrimental to adjoining properties.
4. It will not endanger the public health, morals,
safety or welfare, and is in the public interest.
CONDITIONAL USE HEARING - LUND. Application for a
Conditional Use Permit to construct a duplex in an RS-9
District. Location: Second lot behind house at 4103
South "Cn Street, commonly known as "c" Street
Extension
Mr. Carr reviewed the Department Report. Chairman Hulett
opened the public hearing.

Mike Grooms opposes the duplex because the density is too
high, and he is concerned about storm drainage onto his
property. Guy Lund explained that he will utilize the
existing sanitary sewer for storm drainage, and felt that
a duplex would be more desirable for the area. George
Bower opposes more mUlti-family development in the area
and is concerned about increased traffic. Mike Grooms
and Robert Kingery expressed concern about the impact
from children living in a duplex. Chairman Hulett closed
the public hearing.
The Commission discussed the compatability of adding
another duplex, given the existing number of duplexes and
apartments in this area. Following the discussion, Ms.
Ross moved to recommend granting the Conditional Use
Permit for a duplex provided a soils report is submitted
prior to construction. Mr. Puckett seconded the motion.
On call for the question, Ms. Ross and Mr. Puckett voted
"Yes" and the other four members voted "No", causing the
motion to fail and the permit not to be approved. The
majority vote cited as its findings of fact for the "no"
vote:

A. The area needs street and road improvements before
there are additional non-single-family dwelling units
constructed in the area.
B. There are other areas in the City that are available
for duplex construction.
C. There is an over-concentration of duplexes in this
area of the City.
Mr. Banner stated that his "No" vote was based upon a
lack of additional conditions in the motion and no
consideration of the drainage problem. Following
additional discussion, Mr. Banner moved to reconsider the
permit in order to amend the original motion. Ms. Ross
seconded the motion. On call for the question, the vote
split 3 - 3. Therefore, the motion to reconsider failed
and the original vote upheld.
CONDITIONAL USE HEARING - HARTNAGEL BUILDING SUPPLY.
Application for a Conditional Use Permit to establish a
retail lumber yard in the CAD District. Location:
819-833 East Front Street.
Mr. Carr reviewed the Department Report. Chairman Hulett
opened the public hearing.

Jerry Mills of Hartnagel Building Supply explained that
there would be approximately one or two semi's per week
utilizing the alley and they would be empty at the time.

His 2~ ton trucks would not use the alley; however, the
public might. Chairman Hulett closed the public hearing.
Mr. Anderson moved to recommend granting the Conditional
Use Permit, subject to the following conditions:
1. The requirements of the Fire Department, as stated in
the attached memo, are met.
2. A plot plan showing necessary drainage and curb-cuts
and sidewalk improvements, if any, is submitted prior
to fencing and paving of the site.
3. A site-obscuring fence is constructed in accordance
with the CAD Zone requirements.
4. Every effort to be made to prevent usage of the alley
by customers.
Mr. Anderson cited the following findings of fact:

A. The five lot size and location on the intersection of
two arterials is suitable for a lumber yard.
B. The lumber yard is generally compatible with existing
commercial development along First and Front Streets,
and complies with Commercial Policy No.7.
C. Provided the conditions are attached, the lumber yard
can be compatible with the adjacent properties.
Mr. Cornell seconded the motion, which passed unanimously.
CONDITIONAL USE HEARING - OLYMPIC DESIGN. Application
for a Conditional Use Permit to construct a duplex in
an RS-7 District. Location: 1014 and 1016 Madrona
Street.
Mr. Carr reviewed the Department Report. Chairman Hulett
opened the public hearing.
George Casaday explained the proposal, noting that two
single-family residences could be built, one on each lot,
because the lots were legal lots of record. Robert
Kingery spoke in favor of this duplex application,
because the duplex is smaller, has a lower building
profile, and the soil conditions are better than the
other duplex application. Chairman Hulett closed the
public hearing.

Ms. Ross moved to recommend approving the Conditional Use
Permit for a duplex, citing that the proposed duplex
would have less density than two single-family residences.
Mr. Puckett seconded the motion. On call the for the
question, the motion passed 4 - 1, with Mr. Anderson
voting "No" for the reasons stated in the Lund hearing,
and Mr. Cornell abstaining.

The Planning Commission moved to continue items 8, 9 and
10 to their July 27th Planning Commission meeting because
it was after 10:00 P.M.
Interpretation: Boarding Home for the elderly in the
PBP District.
CONDITIONAL USE HEARING - NICOLAS. Application for a
Conditional Use Permit to operate a boarding home for
the elderly in a PBP District. Location: 424 East
Third Street.
CONDITIONAL USE HEARING - ALWINE PROPERTIES, INC.
Application for a Conditional Use Permit to establish a
storage building/wholesale transpoer point in the CAD-R
District. Location: Northwest corner of Front and
Ennis Streets.
V COMMUNICATIONS FROM THE PUBLIC
None
VI STAFF REPORTS
. Mr. Carr distributed previous land use technical reports.
VII REPORTS OF COMMISSIONERS
Ms. Ross inquired if the 10:00 P.M. rule could be
abolished. The Commission discussed it briefly.
Mr. Anderson noted the number of cars for sale on the Pay
IN Save Parking lot.
The remaining Commissioners had no comment.
VIII ADJOURNMENT
The meeting adjourned at 10:25 P.M.
