BOARD OF ADJUSTMENT

CALL TO ORDER
Vice Chairman Tinkham called the meeting to order at
7 PM.

APPROVAL OF MINUTES

Mr. Lacey moved to approve the minutes of the July 11,
1983, meeting as presented. Mr. Pazan seconded, and the
motion passed unanimously.

COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-83(8)15 - ROBERT AND SANDI HARTMAN. Request for a
variance to reduce the density requirements to allow
two dwelling units on a 7,000 square-foot lot in an
RMF District. Location: South side of Front Street,
150 feet east of Chase Street.
Mr. VanHemert reviewed the Department Report. Vice
Chairman Tinkham opened the public hearing.

William Lindberg reviewed the proposal and submitted
photographs, explaining that the lot is too valuable for
a single-family residence, and its location is a special
characteristic. Ken Williams, attorney representing the
Didiards, residents of the area, expressed concern about
water table and bluff slumping problems and submitted a
proposed agreement between the Didiards and the appli-
cants. Vice Chairman Tinkham closed the public hearing.

The Board discussed the aspects of the application. Mr.
Pazan moved to deny the variance application because
waiver of a lot area requirement would be a grant of
special privilege and there are no special circumstances
of the property that deprive it of any use rights. Mr.
Lacey seconded the motion, which passed unanimously.
V-83(8)16 - MARY ANN BEATTY. Request for a variance
to reduce the lO-foot rear setback for an accessory
building to 3 feet; and to increase the lot coverage
from 30% to 32%; to construct a one-car carport.
Location: 916 South Chase Street.
Mr. VanHemert reviewed the Department Report. Vice
Chairman Tinkham opened the public hearing.
Mary Ann Beatty was available to respond to questions.

Mr. Lacey moved to grant the variance, citing the
following findings:
A. The size of the pre-existing non-conforming parcel,
the orientation of the lot with regard to the alley
and the prevailing pattern in the Townsite, and its
shallow depth are special circumstances which
prohibit the exercise of the use right of covered
accessory off-street parking.
B. The variances will not grant a special privilege
because other homes in this vicinity and in the RS-7
District have carports and detached garages.
C. The carport will not cause a fire hazard, block a
view, overcrowd the parcel, or otherwise be
materially detrimental to the general public or
adjoining properties.
Mr. Pazan seconded the motion, which passed unanimously.
