I CALL TO ORDER
Chairman Lemon called the meeting to order at 7:05 P.M.
II ROLL CALL
Members Present: Jerry Glass, Jim Hulett, Bob Philpott,
Donna Davison Ness, Mike Lemon.
Members Absent: Ted Puckett, Dick Wight.
Staff Present: Paul D. Carr, Otto Miller.
III APPROVAL OF MINUTES
Mr. Philpott moved to approve the minutes of the August 12,
1987, meeting as written. Mr. Glass seconded the motion,
which passed 3 - 0 with Mr. Hulett and Ms. Davison Ness
abstaining.
IV PLANNING STUDIES
Retail Stands
Mr. Miller reviewed the changes in the previous draft. The
Commission discussed the desirability of allowing retail
stands in certain areas of parking lots. The Commission
concluded that retail stands could be allowed in parking
lots because they could always be denied on a case-by-case
basis, depending upon specific findings.
Suzette Calleja explained that $500,000 in liability would
cost approximately $250 per year. The Commission decided
that the retail stand section should be deleted from the
existing Right-of-Way Use Permit when the new Ordinance is
adopted.
The Commission also discussed procedures for reviewing
retail stand permit applications, focusing upon public input
and the appeals process. One suggestion to ensure input
from the Downtown Association was to place them on the
mailing list for applications.
In conclusion, the Planning Commission provided the staff
the following direction:

1.
Consider expanding retail stands to commercial areas
other than the CBD.
2. Contact the Park Board to see if retail stands would be
allowed in parks on a long-term basis, rather than just
special events.
3. Clarify how a permit is processed and how a decision is
appealed.
4. Check with the City Attorney regarding the legal rights
of the adjacent property owners with respect to retail
stand permits.
Mr. Glass moved to place the item on the next long -
range Planning Commission meeting. Mr. Hulett seconded the
motion, which passed unanimously.

Mr. Glass moved to place the item on the next long-
range meeting. Mr. Hulett seconded the motion, which passed
unanimously.
V REPORTS OF COMMISSIONERS
Mr. Hulett noted that the blacktop across the railroad
tracks on Marine Drive has still not been installed.
Mr. Lemon inquired about the progress on the information on
the Raab variance. Mr. Carr explained that it was still
being prepared.

None.
