BOARD OF ADJUSTMENT

I CALL TO ORDER
Chairman Lacey called the meeting to order at 7:07 P.M.
II ROLL CALL
Members Present: John Lacey, Steve Pazan, Jim Rexroat
Members Absent: Scott Lewis, Lucia McPhee.
Staff Present: Paul D. Carr, Dan VanHemert.
III APPROVAL OF MINUTES
Mr. Rexroat moved to approve the minutes of the August 5,
1985, meeting as submitted. Mr. Pazan $econded the motion,
which passed unanimously.
IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-85(7)16 - Port Angeles School District. Request for
reductions in the 25-foot rear yard to 12 feet and from
the 25-foot front yard to 0 feet; and an increase in
the maximum fence height from 6 feet to 10 feet, to
permit the construction of a tennis court. Location:
North side of Park between Chase and Lincoln Streets.
Mr. Rexroat announced that he had an appearance of fairness
conflict. Following discussion regarding the need for a
quorum to make a decision, Mr. Pazan moved to continue the
hearing to Wednesday( September 11, 1985( at 5 P.M. in the
Council Chambers. Mr. Rexroat seconded the motion, which
passed unanimously.
v-as (8) 20 - Sixto Secondez. A reduction of the
required 7-foot side yard to 5 feet and an increase in
the maximum lot coverage from 30% to 36%, to permit the
construction of an attached carport. Location: 709
East Sixth Street.
Mr. VanHemert reviewed the Department ~eport.

Mr. Secondez explained that work started in August because
he thought the hearing would be coming up soon. The pro-
posed 38-foot long carport is for a car and covered
recreation area. The carport would be 14 feet from the
neighbor's building. Chairman Lacey closed the public
hearing.
Following a discussion among the Board members, Mr. Rexroat
moved to reduce the required side yard from 7 feet to 5 feet
and to allow an increase in lot coverage to 32%, subject to
the following conditions:
1. The applicant obtain a building permit and construct a
carport in compliance with the Uniform Building Code.
2. The carport be shortened to the existing off-set on the
southwest side of the building.
3. The existing greenhouse be removed.
He cited the following findings:
A.
The variance will not be detrimental to the public
because the lot exists on a dead-end street, there will
be no fire hazard, sight distance will not be impaired,
and there is sufficient distance from the existing
building to the west.

B. The small degree of variance does not constitute a
grant a special privilege.
Mr. Pazan seconded and the motion passed unanimously.
V-85(9)23 - Jeff Sommers. A request for a reduction in
the required 25-foot front yard to 10 feet to permit
the construction of a petached carport in the RS-7,
Single-Family Residential District. Location: 4119
Fairmont Avenue.
Mr. VanHemert reviewed the Department Report.
Lacey opened the public hearing.
Chairman
Jeff Sommers noted that no one in the neighborhood wanted
Madrona Street constructed. A carport on the north side of
the property would require excavation.. Chairman Lacey
closed the public hearing.

Mr. Rexroat moved to grant the varianqe, reducing the
25-foot front yard setback to a 10-foot: setback to permit
the construction of a detached carpor1;:r provided the
applicants rededicate Fairmont and Madr~na street rights-

of-way abutting said lot. Steve Pazan seconded the motion.
The motion was withdrawn.
Mr. Sommers indicated that he was not interested in
rededicating Madrona Street. Mr. Rexroat moved to table the
matter to the October 7th meeting. Mr. Pazan seconded the
motion, which passed unanimously.
V-85(9)24 - Wayne Carpenter. Request for an increase
in the maximum 30% lot coverage to 32% to allow the
construction of an enclosed greenhouse and hot tub room
to an existing single-family home. Location: 512 West
14th Street.
Mr. VanHemert reviewed the Department Report.
Lacey opened the public hearing.

Mr. Carpenter stated he was willing to remove the existing
greenhouse to reduce the amount of lot coverage. Chairman
Lacey closed the public hearing.

Mr. Pazan moved to grant the variance for an increase in the
maximum 30% lot coverage to 32% to allow the construction of
an enclosed greenhouse and hot tub room, providing the
existing electrical meter is moved, citing that the variance
would not be a grant of special privilege and it is not
detrimental to other properties. Mr. Rexroat seconded the
motion, which passed unanimously.
V-85(9)25 - David Thomas. Request for a reduction of
the required side yard setback from 8 feet to 4 feetr
to construct a sunroom containing a spa and 3/4
bathroom. Location: 1127 South "N" Street.
Mr. Carr reviewed the Department Report. Chairman Lacey
opened the public hearing.
Mr. Thomas explained that the proposed sunroom and spa would
also serve as a heat collector. Other locations, such as
the northeast and the west between the existing buildings,
do not provide good solar heating potential. Chairman Lacey
closed the public hearing.

Mr. Pazan moved to grant the variance for reduction of the
required side yard setback from 8 feet to 4 feet to con-
struct a sunroom containing a spa and 3/4 bathroom, and
providing solar heating, citing the following findings:

1. The corner location and 79-foot wide lot constitute
special property characteristics depriving the property
of normal use rights.
2. The proposed reduction will not be detrimental to the
abutting properties or general public.
3. Granting the variance for the construction of the
addition would not be a grant of special privilege
because it is a normal residential use right.
Mr. Rexroat seconded the motion which passed unanimously.
