BOARD OF ADJUSTMENT

I CALL TO ORDER
Chairman Rexroat called the meeting to order at 7 PM.
II ROLL CALL
Members Present: James Rexroat, John Lacey, Steve Pazan,
Evelyn Tinkham, Robert Hill
Members Absent: None
Staff Present: Paul D. Carr, Dan VanHemert

APPROVAL OF MINUTES

Mr. Lacey moved to approve the minutes of the July 15,
1983, meeting be approved as submitted. Mr. Paz an
seconded the motion, which passed 3 - 0 with Mrs. Tinkham
and Mr. Hill abstaining.
Mrs. Tinkham moved to approve the Minutes of the August
1, 1983, meeting be approved as submitted. Mr. Pazan
seconded the motion, which passed 4 - 0 with Chairman
Rexroat abstaining.
IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
No. V-83(2)3 - RICHARD C. McCOY. Request to extend a
variance to reduce the required 25-foot rear yard to
16 feet; to construct an unenclosed carport.
Location: 1506 South Cedar Street.
Mr. VanHemert reviewed the Department Report. Chairman
Rexroat opened the public hearing.
Mr. McCoy explained the reason for the delay. Chairman
Rexroat closed the public hearing.

Mrs. Tinkham moved to grant an extension for six months.
Mr. Lacey seconded the motion, which passed unanimously.

No. V-83(9)17 - JIMMIE & DARLENE JONES. Request for
a variance reducing the required front and rear yard
setbacks to 0 feet; to build a garage. Location:
924 East Tenth Street.
Mr. VanHemert reviewed the Department Report. Chairman
Rexroat opened the public hearing.
Darlene Jones explained that the maximum variance was
requested because the prospective owners may move the
garage. The Board, Staff and applicant discussed
alternative garage locations. Chairman Rexroat closed
the public hearing.
Mr. Lacey moved to grant a variance for a garage of 26
foot east-west dimension, 24 foot north-south dimension,
with the entrance on the east side of the building, and
the curb cut on Tenth Street, citing the following
findings of fact:
A. The triangular shape, narrow depth, and absence of an
alley are special circumstances related to this lot.
B. With minimum setbacks as prescribed above, the
variances will not grant a special privilege to this
parcel not shared by other properties in this
vicinity and zone.
c. With adequate driveway for parking and sight
distances, the proposed garage will not present a
traffic hazard and thus be materially detrimental to
the surrounding properties and the general welfare.
Mr. Hill seconded the motion, which passed unanimously.
VI STAFF REPORTS
Mr. VanHemert explained that the Beatty variance granted
last meeting was for 32% and apparently through an
oversight, the applicant now needs a 35% lot coverage
variance. Following a brief discussion, the Board
decided to wait until hearing from the applicant before
setting a special meeting to consider the issue.

REPORTS OF BOARD MEMBERS
Mr. Lacey asked if the Planning Commission could
investigate granting extensions for a one-year period
instead of six months in their revision to the Zoning
Ordinance.
There were no other Board reports.
