BOARD OF ADJUSTMENT

I CALL TO ORDER
Chairman Pazan called the meeting to order at 7:05 P.M.
II ROLL CALL
Members Present: James Rexroat, Steve Pazan, John Lacey,
Evelyn Tinkham.
Members Absent: James Clevenger
Staff Present: Dan VanHemert
III APPROVAL OF MINUTES of September 13, 1982

Mrs. Tinkham moved to approve the minutes of the
September 13th meeting as submitted. Mr. Lacey seconded
the motion, which passed unanimously.
IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-82(10)12 - CHARLES L. BEAUDETTE. Application for a
variance to reduce the front yard setback from 25' to
10'; to construct a detached two-car garage.
Location: 431 East Fifth Street.
Mr. VanHemert reviewed the Department Report; Chairman
Pazan opened the public hearing.

Mr. Lacey asked why the applicant could not build a
detached garage on the rear one-third of the lot and
access on the alley. Mr. VanHemert answered that the
alley is only marginally developed adjacent to the lot,
has an over-head power line down the middle, and is un-
stable. Charles L. Beaudette, 3807 South Peabody, stated
the garage, because of the ravine to the north, would
require location closer to the front property line than
the 15-foot setback recommended by the Department. In
response to a question from Mr. Lacey, he stated that the
garage would be entered from the south side and an
existing curb cut would, in part, be used.

Lyle Beaudette, P. O. Box 2131, Port Angeles, added that
the garage would have to be between 12 to 14 feet from
the front lot line. Chairman Paz an closed the public
hearing.
Mrs. Tinkham moved to approve the variance from the
required 25-foot front yard setback to 13 feet, citing
the following findings of fact:
A. Peabody Creek, its associated Ravine, the unstable
soil conditions, and lack of an improved alley on the
property are special circumstances related to this
parcel which limit the privilege of covered off-
street parking, a normal accessory use right of a
single-family residential property in the vicinity
and zone.
B. Since most single-family homes in the RMP District
and within this vicinity have accessory covered
off-street parking, the variance does not grant a use
right beyond that commonly enjoyed by other proper-
ties and therefore is not a special privilege.
C. The variance will not be materially detrimental to
the public welfare or other properties in this
vicinity. A sight distance, traffic and circulation
problem will not be created.
Mr. Lacey seconded the motion, which passed unanimously.
VI STAFF REPORTS
Amendment to By-Laws, re: Attendance
Mr. VanHemert reported that the City Council had con-
curred with the recommendation of the Board regarding
attendance policy. He then reviewed the proposed amend-
ment to the Board By-Laws.
Mrs. Tinkham moved to consider the adoption of the
amendment to the By-Laws at the November 1st or subse-
quent meeting. Mr. Lacey seconded the motion, which
passed unanimously.
