APPROVAL OF MINUTES
Commissioner Nutter moved to reorder the agenda and continue approval of the
minutes to the end of the meeting to allow a correction to be made to the draft minutes.
The motion was seconded by Commissioner King and passed 5-0.
PUBLIC HEARINGS:
CONDITIONAL USE PERMIT - CUP 97-17 - SORENSON, 924 Georgiana:
Develop an off-street parking lot not associated with a pennitted use on the
same site in the CA, Commercial Arterial District
Senior Planner Sawyer reviewed the Planning Department's report on the application
recommending approval of the conditional use permit and answered questions regarding
staff s recommended conditions of approval. Vice Chair Reed opened the public hearing.
Rob Sorenson, 1217 East Second Street, agreed with the staffs recommendation and was
available for questions. The proposed off-street parking lot will be for parking in association
with the commercial structure directly south of the alley at 917 East Front Street.
There being no further comments from the public, Vice Chair Reed closed the public
hearing.
Commissioner Souders moved to approve the conditional use permit as proposed with
the conditions, findings and conclusions as follows:

including the Uniform Building, Fire and Electrical Codes as adopted by the City of
Port Angeles.
2.
A detailed lighting and landscaping plan consistent with P AMC 17.23.020 D, E, and
G needs to be submitted to the Planning Department for approval and improvements
shall be installed prior to issuance of a Certificate of Occupancy for any use requiring
these spaces for compliance with the City's Parking Ordinance. The landscaping
plan shall include a solid 4' minimum height fence along the property line adjacent
to the parking stalls in order to shield automobile headlights from the adjacent
residence.
3.
The applicant shall provide the Planning Department with evidence the subject lot
is a legal non-conforming lot of record established in accordance with or prior to
adoption of the City's Zoning and Subdivision Ordinances.
Findings:
Based on the information provided in the October 8, 1997 Staff Report for CUP 97-17,
(including all of its attachments), comments and information presented during the public
hearing, and the Planning Commission's discussion and deliberation, the City of Port
Angeles Planning Commission hereby fmds that:
1.
The applicant, Robert Linkletter (representing Robert Sorensen) applied for a
conditional use permit for an off-street parking lot to be located at 924 East
Georgiana Street as proposed in the October 8, 1997 Staff Report for CUP 97-17
(Attachment A).
2. The Comprehensive Plan Land Use Designation for the subject property IS
Commercial.
3. The subject property is zoned CO, Commercial Office.
4. A Determination of Non-Significance was issued for this proposal on October 3,
1997 and (Attachment B of the October 8, 1997 Staff Report for CUP 97-17).
5. An off-street parking lot is a conditionally permitted use in the CO zone.
6. The subject lot is 40' wide and 140' in depth.
7. The proposed parking spaces are to be used to meet the parking requirements of an
office use located at 917 E. Front Street.
8. Per P AMC 17.96.070 approval of a conditional use permit is valid for a period of one
year from the date of its original approval.
Conclusions.:.
Based on the information provided in the October 8, 1997 Staff Report for CUP 97-17

including all of its attachments, comments and information presented during the public
hearing, the Planning Commission's discussion and deliberation, and the above listed
findings, the City of Port Angeles Planning Commission hereby concludes that:
A. The Comprehensive Plan's Land Use Element Policies A2, Dl, and E3 are directly
relevant to the proposed project.
B. As conditioned, the proposed use is consistent with the intent of the Comprehensive
Plan's Commercial Land Use Designation, the Comprehensive Plan's Land Use
Element Policies A2, D1 and E3, and the regulations of the City's Zoning Ordinance,
and the CO zone.
C. As conditioned the proposed project is in the public use and interest.
The motion was seconded by Commissioner King and passed 5 - 0 .
OTHER BUSINESS

b.etw.e.e~" and He" Streets.: Request for vacation of City right-of-way.
Planner Sawyer reviewed the Planning Department's report recommending approval of the
request for vacation of public right-of-way as proposed. Vice Chair opened discussion to the
public.
Arnold Schouten, 1601 South "e" Street, agreed with staffs analysis that the reason for the
street vacation request was largely due to snow damage that resulted during the 1996-97
winter storms. In an effort to replace the destroyed warehouse, review of the site and the
constraints of the zoning designation and lot size was considered which resulted in the
request for vacation of the right-of-way. It is desirable to seek a rezone to Industrial Light
for the property given its historical use, and consolidate the property ownerships which are
along both sides of Sixteenth Street at this location. However, given the restrictive setback
requirements of the IL zone, yacation is being requested to accommodate redevelopment
under the IL zone designation. He has spoken with all of the abutting property
owners/neighbors who are largely in favor of the proposal as it will result in a more normal
neighborhood setting than has been in the past given its location as a neighbor to a retail
lumber facility. He will work with Mrs. Radke who expressed minor concerns regarding
to resolve her concerns to her satisfaction.
Commissioner King moved to recommend that the City Council approve the street
vacation as proposed with the following conditions, findings, and conclusions:
Conditions of ApprOYal:
1.
The proposed street vacation is subject to the recommendations ofthe City's Public
Works Department (Attachment B of the October 8, 1997 Planning Department Staff
Report for STY 97-03) which include:

a.)
City standard cul-de-sac or other Fire Department and Public Works
approved turnaround will be required at the proposed easterly terminus of
16th Street along with the required additional right-of-way. Sixteenth Street
will be closed and access will not be allowed from the site;
b.) City standard curb, gutter, and sidewalk will be required at "C" Stret. lfused
as an entrance, a City standard concrete driveway will be required;
c.) Overhead and underground utility easements will be required for power
transmission and the 6 inch water main will remain. Underground utility
easements will be required for the sewer main and 2 inch water main in the
proposed street vacation area. (These easements will not be required if a
sewer c1eanout and 2 inch water cross tie are constructed in the 16th Street
right of way easterly of the vacated area);
2. The proposed street vacation is subject to the recommendations of the City's Light
Division (Attachment C of the October 8, 1997 Planning Department Staff Report
for STY 97-03) as follws:
1.
A 17-foot wide easement is required along both sides of the existing power
line. This will insure that any new buildings will have proper clearance from
the utility.
2.
Unobstructed access shall be maintained to the existing power poles.
3. The City shall be allowed to trim trees and/or remove danger trees in the
easement.
3. The proposed street vacation is subject to the recommendations of the City's Fire
Department (Attachment D of the October 8, 1997 Planning Department Staff Report
for STY 97-3) as follows:
a.) An approved turnaround or access road approved by the Port Angeles Fire
and Public Works Departments shall be required at the west end of 16th
Street adjacent to the east end of the proposed street vacation. The access
road shall be graded to reduce the existing vertical grade, have a minimum
unobstructed width of 20 feet continuing to a public street, and be of an all
weather surface.
b.) A fire hydrant shall be provided at the west end of 16th Street adjacent to the
east end of the proposed street vacation.
Findings.:
1.
The applicant for the requested vacation is Arnold Schouten, the application/petition
is attached as Attachment A of the October 8, 1997 Planning Department Staff
Report for STY 97-03.
2. The requested vacation is for that portion of 16th Street abutting Lots 11-14, Block

429 and Lots 7-10, Block 442 (identified in Attachment A of the October 8, 1997
Planning Department Staff Report for STY 97-03).
3.
The street vacation is categorically exempt from threshold detennination and
Environmental Impact Statement requirements per Section 197-11-800 (2) (h) of the
Washington Administrative Code.
4.
The subject right-of-way and adjoining properties are currently designated on the
City's Comprehensive Plan Land Use Map as Commercial. Lots 11, 12, and 13 of
Block 429 and Lots 8, 9, and 10 of Block 442 are zoned Commercial, Neighborhood
and Lot 14 of Block 429 and Lot 7 of Block 442 are zoned RS-7.
5.
There is a major electrical transmission line located in the subject right-of-way.
6.
The subject right-of-way is currently improved.
7.
The Public Works, City Light, and Fire Department's comments are included as
Attachments B, C, and D ofthe October 8, 1997 Planning Department Staff Report
for STY 97-03.
8.
The Comprehensive Plan Land Use Policy B3 and Transportation Policy B 18 as
listed in the October 8, 1997 Planning Department Staff Report for STY 97-03
directly relate to the proposed vacation.
Conclusions.:
A. The vacation as conditioned is consistent with the Comprehensive Plan's Land Use
Policy B3 and Transportation Policy B 18.
B. As conditioned, the proposed vacation will allow a redevelopment of the adjacent site
with improved site design and reduced impacts on the adjacent residential area.
C. As conditioned, the proposed vacation will not have an adverse impact on the public
health, safety and welfare.
Commissioner Souders seconded the motion, which passed 5 - O.

of "P" ~tre.et: A petition requesting vacation of a portion of "p" Street
situated between Fourteenth Street and Milwaukee Drive. (Continued
discussion from September 24, 1997.)
Vice Chair opened discussion continued from the September 24, 1997, Planning Commission
meeting with the applicant Mr. Walkhoff, and City Engineer Gary Kenworthy.
Bob Walkhoff, P.O. Box 121, Carlsborg, WA , explained that he and City Engineer
Kenworthy have come to an impasse regarding the condition of vacation that he exchange

an area of his property at the intersection of"P" and Fourteenth Street in exchange for the
requested "P" Street right-of-way being requested for vacation.
Gary Kenworthy, Port Angeles City Engineer, provided a visual display to better explain
the request The display indicated the intersections of "P"/Fourteenth Streets and
Milwaukee/Fourteenth Streets and the preferred development of those areas. The
intersections are very high angle and require specific spacing requirements. He provided
information regarding specific urban design spacing standards for intersecting streets which
indicated the spacing between minor arterials should be a minimum of 3001. He is willing
to compromise to reduce that distance to 273' but doesn't feel that further compromise is
wise or necessary. The proposal to exchange property south of the intersection of"P" and
Fourteenth Street is in an effort to support the vacation proposal and to prepare for the
anticipated future realignment of rights-of-way in the area. The subject right-of-way is not
intended for use in the future and could be vacated.
Mr. Walkhoffrepeated his objection that the City is asking for more property than is needed
to realign the roadway in his opinion. He does not really need the "P" Street right-of-way
property but could use the additional area to ensure privacy to his adjoining properties. He
requested that the amount/area of property being requested as an exchange in this issue be
reduced to where the distance between the proposed realigned Fourteenth and Milwaukee
Street intersection would be only about 223t.

Mr. Kenworthy reiterated his rationale for the property exchange proposal and that his
reasoning is based upon acceptable urban traffic engineering design standards. If the
intersections cannot be straightened out with the vacation proposal, there is really no public
interest in vacating the property. The proposed compromise would allow the desired
realignment of the intersection. This seems to be an opportune time to acquire/exchange
property for the proper realignment of the intersection. Future development in the area will
require construction of the rights-of-way to the urban design standards being referenced in
this issue.
Mr. Walkhoff is willing to work with the City in this issue but does not want to lose as much
property as would be necessary to complete the transaction as proposed by the City Engineer.
He believes his proposed redesign of the intersection would be more logical and was
unwilling to accept the City Engineer's adjusted proposaL
Following discussion between Commission members that no further compromise seems
possible, Commissioner Souders moved to recommend that the City Council deny the
vacation petition citing the following findings and conclusions:

The applicant for the requested vacation is Bob Walkhoff. The application/petition
is attached as Attachment A of the September 24, 1997 Planning Department Staff
Report for STY 97-02.

2. The requested vacation is for the vacation of"P" Street south of 14th Street and north
of Milwaukee Drive (identified in Attachment A of the September 24, 1997 Planning
Department Staff Report for STY 97-02).

The street vacation is categorically exempt from threshold detennination and

7. The Public Works. City Light, and Fire Department's comments are included as
Attaclnnents B, C, and D of the September 24, 1997 Planning Department Staff
Report for S TV 97-02.
8. The Comprehensive Plan Land Use Policies B3 and C3, Transportation Policy B 18,
and Conservation Policy B3 as listed in the September 24, 1997 Planning
Department Staff Report for STV 97-02 directly relate to the proposed vacation.

The applicant stated that he is unwilling to comply with the recommended condition
of approval recommended by the City's Public Works Department which includes
dedication of adjacent property identified in Attachment D of the September 24,
1997, staff report for STV 97-02.
Conclusions:
A. The vacation as conditioned is consistent with the Comprehensive Plan's Land Use
Policies B3 and C3, Transportation Policy B18, and Conservation Policy B3.
B. As conditioned, the proposed vacation would result in an improved configuration for
future improvement of the intersection.
C. The proposed vacation will have an adverse impact on the public health, safety and
welfare.
The motion was seconded by Commissioner Nutter and passed 5-0.
Vice Chair Reed noted that this is a recommendation to the City Council and stated for the
record that it is the Commission's intent that the applicant understand his options in this
Issue.
. APPROVAL OF MINUTES
Following review of the amended minutes which contained a revision to the vote on the
Putman conditional use permit at the September 24, 1997, meeting, Commissioner Nutter

Commissioner Nutter reported that the non-motorized transportation survey has been
completed. Some 960+ responses were received out of a mailing of around 10,000 pieces.
She considered this a fantastic response and will keep the Commission members informed
of the committee's progress. She also noted that she will not be in attendance at the October
22nd meeting.
