APPROVAL OF MINUTES
Commissioner Nutter moved to approve the October 8, 1997, regular meeting minutes
noting a typographical error. The motion was seconded by Commissioner Hewins and
passed 5-0 with Commissioners German and Craver abstaining.
PUBLIC MEETING:
REZONE REQUEST - REZ 97-01- SCHOUTEN, 1601 So. "e" Street
Rezone property zoned CN, Commercial Neighborhood, to IL, Industrial
Light, property zoned RS-7, Residential Single Family, to IL, and a property
designated as CN to RS-7. The rezone is in association with the
redevelopment/consolidation of an existing lumber mill/retail sales use.
Planning Director Collins reviewed the Planning Department's report recommending that
the Planning Commission forward a favorable recommendation to the City Council with
regard to the application for rezone of 12 properties.
Commissioner Reed asked why Lot 13, Block 442, is being proposed for rezone to RS-7, and
if a Comprehensive Plan amendment would be required for the proposal.
Director Collins responded that the property owner of Lot 13 favors the rezone as his
property is zoned commercial but is developed with a single-family residence. A
Comprehensive Plan amendment would be incorporated into the City's 1998 review of the
Comp Plan and would be viewed as being in error not to have been designated as such in the
original 1995 amendments as the property has been a functioning millworks since 1906.
Commissioner Hewins wondered why a CA, Commercial Arterial designation was not
sought for the property rather than a rezone to IL, Industrial Light, for this use. It would
seem that the CA would allow for the "e" Street corridor to maintain its commercial
classification.

Director Collins responded that the primary reason is due to the surrounding zones. The IL
zone allows for the existing use to continue) identifies it as being a permitted use and is
found immediately south of the area. The extension of the industrial zone is a more
consistent approach rather than creating a fairly spot zone of Commercial Arterial which is
not located anywhere else in this vicinity.
There being no further comment or discussion, Commissioner Reed moved to recommend
that the City Council approve the proposed rezones to IL and RS- 7 citing the following
findings and conclusions in support ofthat recommendation:

1. The proposed rezone request is to change the existing site's zoning from CN to IL
(Lots 11-13 of Block 429 and Lots 8-12 of Block 442), rezone the three properties
to be added to the site from RS-7 to IL (Lots 14 and IS of Block 429 and Lot 7 of
Block 442)) and rezone one existing CN property located adjacent to the
southernmost portion of the site from CN to RS-7 (Lot 13 of Block 442). Please see
the October 15, 1997 Staff Report for REZ 97-01 Attachment C.
2.
The Comprehensive Plan designates the majority of the site as Commercial and the
site extends into the marginal area between the Commercial designation and the
Industrial designation.
3. The subject area is presently developed with the Angeles Millworks retail lumber
yard and supply store and two single family residences. One of the residences eill
be be demolished and the property included in the applicant's redeveloped site. The
remaining residence is included in this rezone request to change its zoning
designation to match the zoning of the adjacent residences.
4. The retail lumber yard and building supplies store use of the property has been in
existence since 1906. The proposed redevelopment is a result of snow damage to the
current faciities that occurred during last year's winter storms.
5. The City adopted a new Comprehensive Plan in 1994 and amended it in 1995 and
1996, including changes in land use designations for the subject site in 1994 and
1996.
6. A retail lumber yard and building supplies store is not a permitted use in the current
CN zoning.
7. A retail lumber yard and building supplies store is a permitted use in the IL zone
which is adjacent to the south of the existing site.

The subject location has several types of land uses and land use designations
surrounding the site.

to reflect this area's predominant existing uses.
10. Although, the subject site is not located in either the harbor area or the near the
airport, the proposed rezone would be an extension of the existing II.., zone directly
adjacent to the south of the subject site.
11. The SEP A Responsible Official issued a Detennination of Non-Significance for the
proposal on October 10, 1997 (please October 15, 1997 Staff Report for REZ 97-01
Attachment B. ).
12. The posted public comment period for this application ran from September 22 to
October 8, 1997. During this time the Planning Department received one letter of
comment from Helen Radke who owns Lots 16 and 17 of Block 429. Ms. Radke's
letter supporting the proposal is attached as October IS, 1997 Staff Report for REZ
97-01 Attachment D.

A.
The proposed rezone is consistent with the Comprehensive Plan Land Use Policies
Al and 2, DI, G2, and H4 as listed and reviewed in the October 15, 1997 Staff
Report for REZ 97-01.
B. The proposed extension north of the II.., zone will help facilitate the redevelopment
of the site which will in turn allow the existing use to remain economically viable
and increase its compatibility with the surrounding land uses.
C. The rezone is in the public use and interest and is compatible with the surrounding
zoning and land uses.
D. The original reasoning for the placement of the land use designations and the Land
Use Map's concept of imprecise boundaries, justifies a correction by the City of the
Comprehensive Plan's Land Use Map rather requiring an amendment of the
Comprehensive Plan.
E. The rezone would enable an existing business to be rebuilt.
The motion was seconded by Commissioner King.
Commissioner Nutter asked the applicant if there is anything new to report on the site
development and application processes he is going through. Mr. Shouten responded that
everything is moving along and there is nothing new to report. She then asked members of
the audience who were there as neighbors in the area if they had any specific concerns.
Mrs. Carol Foss, 909 West 16th Street, asked if the site would retain access to 16th Street
such that traffic would still be moving through the area from the millworks site. Mr.
Schouten offered to speak to the Fosses regarding their concerns.

On call for the question, the motion passed unanimously.

Mr. Collins thanked the Commissioners for taking the time to conduct the special meeting
to enable the applicant to continue to process this emergency request. He also informed the
Commissioners that the City Council will return the Calkins annexation request to them at
the October 22 meeting for a second review and further recommendation.

Commissioner Nutter reminded everyone that she will not be able to attend the October 22
meeting.
