BOARD OF ADJUSTMENT

I CALL TO ORDER
Chairman Rexroat called the meeting to order at 7 PM.
II ROLL CALL
Members Present: Robert Hill, John Lacey, Jim Rexroat,
Steve Pazan, Evelyn Tinkham.
Members Absent: None.
staff Present: Paul D. Carr, Dan VanHemert.
III APPROVAL OF MINUTES

Mr. Lacey moved to approve the minutes of October 10,
1983, as submitted. Ms. Tinkham seconded, and the motion
passed 3 - 0 with Chairman Rexroat and Mr. Hill
abstaining.
IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-83(11)20 - JAMES WALTON: Request for a variance to
allow a 5' reduction in the minimum setback require-
ment to construct a deck onto a single-family resi-
dence in the RS-7 Zone. Location: 333 Viewcrest.
Mr. VanHemert reviewed the Department Report. Chairman
Rexroat opened the public hearing.
Mr. Walton was available for questions. Chairman Rexroat
closed the public hearing.
Ms. Tinkham moved to grant the variance to allow a 5-foot
reduction in the setback to 20 feet, citing the following
findings of fact:

A. The slope on the parcel, its orientation and dimen-
sions, and corner location are special circumstances
requiring that a variance be granted to restore the
year-round recreational use of the rear yard.

B. Since both ground level decks and second story patios
are common use rights in the RS-7 Zone and in the
vicinity the variance will not grant a special
privilege not shared by other properties in the area
or in the District.
C. The balcony will be sufficiently distant from other
properties so as not to be injurious to abutting lots
or materially detrimental to the public welfare.
Mr. Hill seconded the motion which passed unanimously.
V-83(11)21 - DANIEL and MARI DAVIDSON: Request for a
variance to allow a 6' reduction in the minimum set-
back requirement to construct a bay window onto the
front of a single-family residence in the RS-7 Zone.
Location: 1120 West 16th Street.
Mr. VanHemert reviewed the Department Report. In re-
sponse to a question from Mr. Lacey, Mr. VanHemert ex-
plained that the building was constructed prior to the
Zoning Ordinance. Chairman Rexroat opened the public
hearing.

Mr. Davidson explained that the bay window was canti-
levered out from the existing wall and contained a window
seat but did not contain any floor area. Chairman
Rexroat closed the public hearing.
Mr. Lacey moved to grant a variance to allow a 6-foot
reduction in the minimum setback requirement, citing the
following findings of fact:
A. The variance will not grant a special privilege to
the parcel not shared by other properties in the
vicinity and zone because the bay window, as explained
by applicant during the hearing, is not a significant
expansion of living space of the dwelling and other
incidental structural components can intrude into the
required front-yard setback.
B. A bay window is a minor addition, most appropriate
for the front of a building and the location and pre-
existing status of the house with respect to the
zoning Code is a special circumstance.
C. The addition will not have an injurious effect on
neighboring properties or be materially detrimental
to the public welfare.

Mr. Pazan seconded the motion which passed unanimously.
