PLANNING COMMISSION
November 18, 1987

CALL TO ORDER
Chairman Lemon called the meeting to order at 7:04 P.M.

APPROVAL OF MINUTES
Jim Hulett moved to approve the October 28th Minutes
of the Planning Commission as read. Richard Wight
seconded the motion which passed 3 - 0 with Ted Puckett
abstaining.
IV.
PUBLIC HEARINGS
CONDITIONAL USE PERMIT - CUP 85{7)3 - SOVDE
Extension Request - Location: 1511 West Sixteenth
Street: Request for extension of a Conditional
Use Permit allowing a duplex to be located in
the RS-7, Single-Family Residential District.
(This item is continued from the October 14th
meeting) .
Paul Carr reviewed the staff report. Chairman Lemon opened
the public hearing. There being no one present, Richard
Wight moved to continue the request to the December 9th
meet ing. Jim Hulett seconded the mot ion which passed unan-
imously.

explained that the vacation would allow for parking and
a weigh scale north of the present scaling facility and
make the property oriented more north and south where it
is now divided by the alley and the street. He felt it
would be a better use of the property which is presently
unusable.
Chairman Lemon closed the public hearing. Jim Hulett moved
to recommend approval of the street vacation with the condition
that an easement for utilities be retained for both the 3/4 Alley and
4th Street for Truck Route transmission lines and resident ial
serv ice;
and cited the following findings:
A. Vacation will improve the usability of the adjacent
property by allowing the assemblage of a larger parcel.
B. Development of the parcel into a single industrial
office use site will strengthen this Light Industrial District
and increase the tax base of the community.

REZONE REQUEST RZ 87(11)2 PRESSLEY, Location:
1017 West Seventeenth Street: Request for rezone
of property presently designated RS-7, Single-Family
Residential, to RMF, Residential Multi-Family.
Paul Carr reviewed the staff report. Ted Puckett quest ioned
the use in association with the existing Residential Multi-
Family zoning in the area. Mike Lemon inquired as to the
staff1s concerns as to expansion of the Residential Multi-
Family zoning in the area with an approval of this request.

Paul Carr explained the >>olicy on split lots of the same
ownership. There was considerable discussion on the definition
of a boarding home.
Chairman Lemon opened the public hearing. Gladys Pressley,
the applicant, stated that she presently has a permit for
6 elderly people at 909 South "N" Street. She is making
this application with the intent of a boarding home for
geriatric care patients. She has an option on the surrounding
property on which she plans to build a home for herself.
The outside appearance of the home will not change from
the present quality. Mrs. Pressley stated there have been
no objections from any of the neighbors.
In response to a question from Ted Puckett, Mrs. Pressley
said she will have 10 patients but can have up to 12 by
state standards. The residents would be totally under
her care. She is not required to have a nurse, only a
First Aid and Cardiopulminary Resuscitation (CPR) card.
Chairman Lemon closed the public hearing. There was discussion
between the Commissioners as to a possible amendment of
the Zoning Code to allow boarding homes conditionally in
the single-family districts instead of requiring rezones
for the use.

Dick Wight moved to recommend approval of the rezone proposal
from RS-7 to RMF, Residential Multi-Family, with the follow-
ing findings:
1. The mixture of uses in this area is providing an indication
that multi-family zoning would be more appropriate in compliance
with Land Use Objective No.1;

2. The similarity of the two residential districts and
thus general compliance with Land Use Objective No.2;
3. Stress the general compliance with Residential Policies
Nos. 15 and 16.
Ted Puckett seconded the motion which passed 4-0.
The Commission took a 10 minute break.
(Ted Puckett left the meeting).
The meeting resumed at 8:40 P.M. Due to lack of a quorum,
Jim Hulett moved to adjourn the meeting until 5:30 P.M.,
November 19th. Dick Wight seconded the mot ion which passed
3-0.
Meeting adjourned at 8:45 P.M.
