I CALL TO ORDER
Chairman Lacey called the meeting to order at 7:07 P.M.
II ROLL CALL
Members Present: John Lacey, Steve Pazan, Jim Rexroat.
Members Absent: Lucia McPhee, Scott Lewis
Staff Present: Dan VanHemert
III MINUTES
Mr. Pazan moved to approve the minutes of the November 4,
1985, meeting as submitted. Mr. Rexroat seconded the
motion, which passed unanimously.
IV VARIANCES
V-85(12)32 - N. ROTELLO - Request for a variance of the
required 7-foot side yard setback to 3 feet, to extend
a second-story deck in the RS-7 District. Location:
l28 Eash Vashon.
Mr. VanHemert reviewed the Department Report. Chairman
Lacey opened the public hearing.
Mr. Rotello said there is a house at the rear of the lot to
the west. His lot also has a moderate slope from the alley
to the street. A side yard variance was granted for a
garage on a lot to the west. Chairman Lacey closed the
public hearing.
Mr. Rexroat moved to deny the variance for the following
reasons:
1. There are no special circumstances related to
topography, lot shape, size or location and a carport
can be constructed in the rear yard.
2 .
The use of 4 feet of the 7-foot required side yard is a
special privilege not shared by other properties in
this vicinity and in the RS-7 District.

The balcony/carport may be injurious to the lot
to the west,. Vehicles using the carport may cause
unnecessary light, fumes and noise.
Mr. Pazan seconded the motion, which passed unanimously.
V-85(12)33 - Hendricks - Request for a variance of the
required 7,000 square-foot lot requirement for a
single-family residence in the RS-7 District.
Location: 1039 West 12th Street.
Mr. VanHemert reviewed the Department Report.
Lacey opened the public hearing.
Chairman
Mr. Hendricks reviewed the reasons for the variance. Carol
Boardman, 1847 Finn Hall Road, noted that the subject lot
had been erroneously segregated in 1971, three months after
the adoption of the Zoning Ordinance, creating the non-
conforming lot. Chairman Lacey closed the public hearing.
Mr. Pazan moved to grant the variance, citing the following
findings of fact:
1.
The variance will not be a grant of special privilege
to this property because there are other substandard
lots in the Townsite and in the RS~7 District and all
other properties in this immediate' vicinity have the
right to one single-family house in the event that a
home is destroyed.
2. The variance will not detrimentally affect surrounding
properties or utilities or have em impact on the
general public.
Mr. Rexroat seconded the motion, which passed unanimously.
