BOARD OF ADJUSTMENT

I CALL TO ORDER
Chairman Pazan called the meeting to order at 7:00 P.M.

III APPROVAL OF MINUTES

Mrs. Tinkham moved to approve the November 1, 1982,
Minutes as submitted; Mr. Rexroat seconded the motion,
which passed unanimously.
IV COMMUNICATIONS FROM THE PUBLIC
None.
V VARIANCES
V-82(12)14 - IRVING HANSEN. Request for a variance
to reduce the IO-foot setback from alley for a
detached garage to 0 feet; to construct a two-car
detached garage. Location: 525 West Fourth Street.
Mr. VanHemert reviewed the Department Report. The Board
questioned Mr. VanHemert about other buildings on the
alley which were three feet or closer to the property
line. Chairman Pazan opened the public hearing.
Mr. Hansen explained that putting the garage on the alley
would enable his trailer to enter from the east side. If
he places the garage back ten feet, that IO-foot area may
become a parking space. Mrs. Trillingham said it was not
right to use a neighbor's land for turning and backing
into a garage. Chairman Pazan closed the public hearing.

Mr. Rexroat moved to not grant the variance because there
are alternative locations for the garage that comply with
the code, there are no special circumstances of the
property that would require granting a variance, and

granting the variance would be a special privilege. Mrs.
Tinkham seconded the motion, which passed unanimously.
V-82(12)15 - WALLACE COMEGYS. Request for a variance
to reduce the required lO-foot setback for a detached
accessory building to 4 feet; to construct a storage
shed. Location: 603 South "E" Street.
Mr. VanHemert reviewed the Department Report; Chairman
Pazan opened the public hearing.
Mr. Comegys explained that there were only two places to
place a structure on his corner lot, but at the southerly
location, the neighbor's house is very close, while at
the proposed location, the neighbor's house is
approximately 60 feet away. Chairman Pazan closed the
public hearing.

Mrs. Tinkham moved to grant the variance citing the
following findings of fact:
A. The lot shape, reduced building area, the absence of
an alley, and the corner lot location are special
circumstances of the lot limiting the use right of an
accessory storage building.
B. The variance is not a grant of special privilege
because this lot does not have the flexibility
enjoyed by other residential properties in the
placement of accessory storage buildings.
C. The storage building will neither be materially
detrimental to adjoining properties and improvements
nor to the general public.
Mr. Rexroat seconded the motion, which passed
unanimously.
V-82(12)16 - GEORGE C. RAINS, JR. Request for a
variance to increase the maximum lot coverage from
30% to 33.2%; to construct a detached garage.
Location: 130 West 13th Street.
Mr. VanHemert reviewed the Department Report, noting that
a variance had been granted for this application before,
but the time had expired before Mr. Rains had applied for
the building permit. Chairman Pazan opened the public
hearing.

Mr. Rains was available to answer any questions.
Chairman Pazan closed the public hearing.
Mr. Rexroat moved to grant the variance for the following
reasons:

A. The slope at the rear of the lot, toget~er with the
orientation of the existing garage, deny the property
the use right of covered off-street parking and
therefore are special circumstances related to the
property.
B. Most Residential lots in the vicinity and RS-7
District have either a garage or carport, and some,
particularly in the older, built-up areas, exceed the
maximum ldt coverage requirement. Consequently, the
granting of this variance will not convey a special
privilege to this property.
c. The garage will not create a fire hazard, block a
view, reduce air circulation, shadow adjacent
properties, or otherwise have a detrimental impact on
nearby properties, utilities and the general public.
Mrs. Tinkham seconded the motion, which passed
unanimously.

V-82(12)17 - GREGG HOWARD. Request for a variance to
reduce the required 25-foot front yard to 20 feet; to
construct an addition to an existing single-family
residence. Location: 429 West sixth Street.
Mr. VanHemert reviewed the Department Report; Chairman
Pazan opened the public hearing.
Mrs. Howard explained that their proposed additions would
be in line with the existing porch and all the other
existing houses. The lot to the east is unbuildable;
they need more room. To the south is a better place to
expand because of the southern exposure. Chairman Pazan
closed the public hearing.
Mr. Rexroat moved to grant the reduction from the
required 25-foot front yard to 20 feet to permit two
additions because it would not be materially detrimental
to the public, would not be a special privilege because
it conforms to the setbacks of the existing houses in the
area, and it would not create fire or traffic problems.
Mrs. Tinkham seconded the motion, which passed
unanimously.
