Re-adoption of certain taxes, charges and fees from 1/1/00

Summary: With the v~ter' s passage ofInitiative-722, one ofthe salient provisions is that the City
refund taxes, charges, and fees adopted between 7/2/99 and 12/31/99; however, the Initiative does
not prescribe any time lines or procedures for refunds. It is staff s position that the applicable taxes,
charges, and fees were appropriately justified for budgetary purposes on 11/17/99 and are just as
valid today. Rather than incur additional expense to the public to refund fees and reinstitute higher
fees to cover committed and future operations and improvements, staff believes there is no
prohib}tion to the City Council re-adopting said ordinances to be in effect retroactive to their original
effective dates.
Recommendation: Adoption of the enclosed Ordinances providing for revised water rates,
revised wastewater rates, initiation of the second 1/4% real estate excise tax, increasing
miscellaneous Department operational fees, increasing system development charge for water and
sewer facility capital costs, and providing for an increase in the monthly Medic One charge.
Backeround / Analysis: The passage of Initiative -722 had several provisions which affected,
the financial condition of cities; of which the above section concerning refunds of adopted taxes,
charges, and fees in the second half of 1999 has a significant impact. Since the Initiative had no
effective date in its wording, the effective date is 30 days after voter adoption or December 7th. After
this December date the City should either stop collecting the above fees and taxes, or reaffirm those
fees through Council action. Since the voter approval provision for enacting fees and taxes was
nullified by the court decision involving Initiative-695, this decision falls back upon the policy
determination of the City Council.
While there will be legal challenges to the above Initiative-722, it is staff s recommendation that we
not wait for these unknown outcomes, but instead choose a positive approach to addressing the needs

of our community. Accordingly, we recommend that a readoption of the taxes, charges, and fees
are justifiable and in the public's interest and benefit. I have attached pages 79 - 83 ofthe November
21, 2000 Council packet as a staff memo detailing the specifics of justification for the various
increases noted above. When we consider the costs of handling refunds at over $43,000 and the
compounded effect of instituting higher utility rate increases over a two year period than lesser .
increases planned for a three year period to accomplish capital and operational commitments, it just
plain makes sense that we proceed with a readoption. I believe the main policy consideration as an
elected official is whether you are following the general will of the people as they have entrusted
such leadership and advantage of special knowledge to the City Council to represent them for the
greatest benefit of the community. We can not base our decisions solely in a vacuum of single
decisions, but must invoke the collaborative knowledge of all such decisions as a guide for public
policy. The City has maintained its property tax increase at under 2% as intended by the people's
vote on Initiative - 722. The City has not proposed any new fee increases as intended by the people's
vote on Initiative-722. The City has maintained a three year projection of 8% water/wastewater rate
increases, but also has done so with the mandates of environmental impacts, health requirements,
and sound operational concerns that are also in the best interest of the rate payer. Upon further
analysis, we believe the public will support the Council's decision as being ajustifiable increase to
better serve the needs 6rthe community.--o_.

INITIATIVE 722
Once again Washington voters have handed local governments a challenge by approving Initiative -
--722.-The p-assage of 1-722 will have signi.f!cant impact on the City's revenue. Section 1 of the
initiative invalidates any tax and fee increases adoptecl"betweeri July2, 1999; arid December 31,
1999. Cities would be required to refund those taxes and fees. Section 3 sets the limit on property
tax increases, starting with the 1999 valuation level, to the lower of 2% per year or implicit price
deflator.
On November 17, 1999, as part of the budget process and after conducting public hearings, the City
adopted tax and fee increases which included: property tax - regular levy, Medic I fees, Real Estate
Excise Tax, Water and Wastewater rates, building permits, and miscellan~ous fees in Parks and
Recreation, Planning, Police, Finance, and Public Works Departments.
The following is a summary of tax and fee increases adopted during the 2000 budget process:
Regular Property Tax Levy
The City Council approved a 1.4% or $43,117 increase in the property tax levy for year 2000. The
increase was at the same level as the implicit price deflator. In our opinion, the City complied with
the limitation in property tax increases. However, according to Section 1 ofI-722, it would appear
that if a taxing district increased its property tax revenue, other than any increases resulting from the
addition of "new construction," in its 1999 levy for taxes collected in 2000, then that increase would '
need to oe deducted before calculating the 2000 levy. The assessor will have the primary
responsibility for calculating the levy in 2000, for collection in 2001, and will have to determine
what the highest lawful levy of the last three years is, without any "tax increase" in the 1999 levy.
Since the City already levied 2000 taxes, the assessor will determine the adjustment necessary in the
2000 levy for collection in 2001 to implement the refund due from any "tax increase" that is
nullified. At this time we have to wait for legal interpretation of this issue.

Water and Wastewater Rates
On November 17, 1999, the City Council approved a three year plan for increases in water and
wastewater rates as a result of a cost of service study that was conducted prior to the passage of
Initiative 695. The 1999 Budget included $40,000 for a rate study and in August 1999, the City
executed a contract with Economic and Engineering Services (EES) to complete this study. Rate
reviews for utilities are usually done every three years and for these utilities were done in 1992 and
again in 1995. Water and Wastewater rates were increased in order to meet capital projects, increases
in operating costs, and bond requirements. In some cases, improvements in infrastructure has

provided improvement in services to customers.
Medic One Fee
As a result of increasing costs for providing emergency and advanced life support services, the
special need to replace one of our Medic One response vehicles, and the restrictive growth ability
of pmnicipal resources, the City increased Medic One charges by 50 cents per month. The last rate -
. 3h~ge occ.!lrre~Lin 1995;-when the rate wen~ from $2 to $3 per month.
In the proposed 2000 budget, the new impact to the Fire Department was replacement ofthe second-
out emergency medical response unit at a cost of$130,000. Because of the high cost, there were no
replacement reserves allocated for this equipment. Additionally, our future needs in terms of medic
support personnel and response operations would impact our ability to maintain this level of service
without additional revenue. The inflationary costs that impact medical supplies was estimated at
more than 15% since the last fee increase. The projected revenue yield from this increase was
estimated at $60,000 per year.
Real Estate Excise Tax - Second 1/4%
The Real Estate Excise Tax is authorized by RCW 82.46.010 and RCW 82.46.034. The
implementation ofthe second 1/4% REET was a viable option for increasing revenues dedicated to
achieving needed capital project construction and meeting the planning goals envisioned under the
State's Growth Management Act. These funds are separately accounted and designated for street and
parks capital projects. It was planned to use receipts from the REET to pay the debt service on a $2
million loan from the Public Works Trust Fund. This loan was used to reconstruct and improve 8th
Street. The estimated revenue 'from REET #2 is $100,000 annually.

Other Fee Increases
As part ofthe budget for the year 2000, a recommendation was made to update the fees charged for
services by various City departments. The approved increases in fees were generally consistent with
inflation/cost of living rates since the fees were adopted or last revised. The fee increases adopted
by Ordinance 3034 are summarized as follows:
1. Finance Department. The only change was increasing fees for NSF checks from $15 to $20.

Parks and Recreation Department.
A. Cemetery charges for market-driven Increases as reflected by other municipal
cemeteries.
B. Some of the swimming pool fees for inflationary increases, as an example instruction
classes increased from $2.00 to $2.50 and adult annual passes from $140 to $150 for
City residents.
C. Lincoln Park, City Pier, and Civic Field fees were increased to reflect inflation.
D. Vem Burton fees were increased consistent with inflation for commercial use but not
, for non-profit use.

Planning Department. Across the board increases in the $25 to $100 range were approved
for most ofthe various permit fees.
4.
Public Works and Utilities Department.
A. Building permit fees were approved to reflect the 1997 Building Code.
B. Utility inspection and service fees, right-of-way use fees, clearing and grading fees, and
." fees for othermiscellaneous pef!!lits were adopted for accross-the-board increases based
',- on a-'16% increase in construction costs-over the last -three years-as -reflected by the
Engineering News Index.
C. The Water and Sewer System Development charges were also increased to be consistent
with the above index.

5. Fire Department. A $35/hour charge was implemented for inspections outside normal
business hours and reinspections for Fire Code compliance.
6. Police Department. Only charges for case file photographs, gun shipments, and police escort
services were increased by $1.50 to $15.00 to reflect actual costs. A $1 bicycle license fee
was eliminated.
Recommendations
Several cities, including Seattle, Pasco, Carnation, Burien, and Bainbridge Island, filed suit to legally
challenge 1-722. They are likely to request an injunction on implementation of the initiative. It is
recommended that cities should wait until legal issues surrounding the initiative have been resolved
before considering developing a policy for refunding taxes and fees other property taxes. Since the
County Assessor is responsible for setting the limit on property taxes, we must be prepared for ,
reduced revenues if the Assessor calculates that our property taxes are more than 102% of the 1998
for 1999 levy. To be on the safe side, our city reserved $135,000 in the General Fund for possible
refunds and we have not spent $100,000 in REET. The possible refunds for water and wastewater
rates will have to be from the reserves.
The Initiative does not include a specific effective date, so the effective date is December 7,2000,
30 days after the Initiative is approved. This means that after December 7, unless a statewide
injunction has been placed on implementing 1-722 we have to stop collecting taxes and fees adopted
between July 1999 and December 31,1999.

The uncertainty over enacting taxes and fees this year was lifted when 1-695 was declared
unconstitutional in its entirety. As a result, cities and towns may raise taxes and fees without a
public vote this year. That also means that taxes or fees adopted between July 2, 1999 and
December 31, 1999, could be re-enacted or reaffirmed without a public vote. Some cities are
considering making the effective date retroactive in order that any refund that may have to occur will
be limited as much as possible. This is also our recommendation to the Council, assuming that this
is available by law.

WHEREAS, on November 17, 1999 the City Council passed Ordinance 3029, which
evised rates for water service; and
WHEREAS, Initiative Measure 722 provides that any tax increase adopted between July
~, 1999 and December 31, 1999 is null and void and of no effect, and therefore, if such provision

13.44.055 Resale Rate. In circumstances under which the Director deterrillnes pursuant to
AMC 13.32.020F that it is appropriate to allow a customer to furnish City water to a subsequent
urchaser for the purpose of resale or transfer of the water outside of Port Angeles, the r~tes. and
onditions for such water shall be as follows:
A. The regular monthly metered rate for the water service at which the water is obtained

B. A surcharge shall be paid for water consumption in excess of 100,000 gallons at the

A. Purpose. The City Council has determined that it is reasonable and in the public
interest to enact and impose a fee schedule for the rental and use of facilities at the Port Angeles
Senior Services and Community Center.
B. Definitions.
1. "Category I" This category shall be defined as any City sponsored, co-
sponsored or City supported activity whereby the City either plans, conducts, controls or offers some
degree of activity participation. This category will include youth/older adult sponsored activities
such as AARP, Senior Services, and school related activities pursuant to the Park/School Agreement
and Senior Services Agreement.
2. "Category II" This category shall be defined as any non-profit group or
organization or community function that separates community activities from "for profit" activities
of private enterprise or political or religious organizations.

3.70.900- Waiver of Fees. Under appropriate circumstances, the fees imposed pursuant to
this Chapter may be waived by the department head who is responsible for the fee being waived,
provided that such waiver shall be subject to approval ofthe City Manager, and provided further that
such waiver shall only occur in circumstances in which the waiver is constitutionally appropriate
as being for the necessary support of the poor or infirm or in circumstances in which the City has
made a mistake or incurred some other risk of liability exposure such that waiver of fees is
legitimate quid pro quo or consideration for resolving a legal dispute or potential claim against the

3.70.905 - Money Back Guarantee Program. In order to assure that specified development
permit applications are processed within a reasonable amount of time, the City hereby adopts the
Money Back Guarantee Program. Under this program, applications for building permits, other
construction permits, subdivisions, short plats, boundary line adjustments, conditional uses,
unclassified uses, shoreline substantial development permits, approvals required by the
Environmentally Sensitive Areas Ordinance and Wetlands Ordinance, site specific Jezones,
variances, right-of-way use permits, street vacations, and clearing and grading permits shall be
processed in accordance with the time frames set forth in this section, provided that the following
development permit applications shall be specifically excluded from the Money Back Guarantee
Program: planned residential developments, projects for which a SEP A determination of significance
has been made, and building permits for projects with fees calculated on construction valuation costs
greater than $300,000.

1. Once the City determines a deyelopment permit application to be complete, the
City has sixty days to review an application that does not require a public hearing.
2. Once the City determines a development permit application to be complete, the
City has 120 days to review an application that does require a public hearing.
3. The sixty and 120-day review periods shall not include any period for which the
City has asked the applicant in writing to provide additional information, beginning with the date
of the written request until the date the City receives the information. The review time shall also be
tolled or held in abeyance whenever the City asks in writing for additional information or whenever
the City is waiting for a required determination or other action by an agency with jurisdiction.
4. If the City fails to complete its permit application review within the time limits
identified in subsections 1-3 above, then the applicant shall be entitled to a full refund of application
fees paid to the City. In the event a refund is required, the City must still complete its review of the
application.
5. The permit applicant may waive the time limits set forth in this section.
Section 2 - Severability. If any provisions of this Ordinance, or its applicati()n to @x--,-

NOW, THEREFORE, the City Council of the City of Port Angeles does hereby ordain

Section 1. Ordinance 3036, a copy of which is attached hereto, is hereby re-adopted in
ts entirety.
Section 2. Effective Date. This Ordinance shall take effect five days after the date of
ublication; provided, however, that the monthly Medic I charge increase shall remain in effect from
e date established by Ordinance 3036.
