PROJECT SW08-01 RELATING TO: PORT ANGELES LANDFILL POST-CLOSURE CONSULTING ENGINEERING SERVICES AND PERMIT COMPLIANCE SERVICES"" THIS AMENDMENT NO. 4 is made and entered into this day of skin by and between THE CITY OF PORT ANGELES, a non-charter code city of the State of Washington, (hereinafter called the "CITY") and Aspect Consulting, LLC., a Washington Corporation (hereinafter called the "CONSULTANT"). WHEREAS, the CITY entered in to an AGREEMENT with the CONSULTANT on October 27, 2008, (the AGREEMENT) and WHEREAS, the CITY desires to amend the AGREEMENT to amend the Scope of Work, Budget, and Time of Performance. NOW, THEREFORE, in consideration of the representations and the terms, conditions, covenants and agreements set forth in this AMENDMENT, the original AGREEMENT is hereby amended as follows: 1 REVISED SCOPE OF WORK The amended scope of professional services to be performed and the results to be achieved by the CONSULTANT pursuant to the AGREEMENT shall be amended to read as shown in the attached Exhibit A to Amendment 4. The Scope of Work shall include all services and material necessary to accomplish the work. 11 TIME OF PERFORMANCE The work for all Tasks shall be completed by April 30, 2016. All work shall be completed in accordance with the schedule set forth in Exhibit B of this Amendment. III MAXIMUM COMPENSATION The CONSULTANT'S total compensation and reimbursement are stated in the attached Exhibit B of this Amendment. The maximum compensation amount, referenced in Section VI of the Agreement, is amended from $438,218.72 to 632,746.64, an increase of$194,528.92. The budget for any Task may be further adjusted by mutual agreement without an amendment to the Agreement, as long as the maximum compensation amount of$632,746.64 is not exceeded. The original landfill area was closed in 1983 under WAC 173-301. The second area was closed in 1990 under WAC 173-304. Both the 301 and 304 cells are unlined. The third developed area was lined, and is approximately 11 acres total. This area was closed in October 2007 under WAC 173-351. The landfill is now completely closed. All waste is transferred to a site in eastern Oregon. The Port Angeles Landfill (PALF) is now regulated by a Landfill Post Closure Permit issued by Clallarn County Department of Environmental Health and Human Services (CCEHS) on August 29, 2008. The Post-Closure Permit references the March 2008 Port Angeles Landfill Post Closure Plan. The Post-Closure Plan details the monitoring and maintenance requirements for the landfill in its post-closure period. This scope of work is based on those requirements. Amendment 4 to the Professional Services Agreement SW08-01 extends the work in support of PALF Post-Closure Permit compliance through April 2016. The tasks that will be performed as part of this amendment are summarized in the following scope of work. The budget for these services is presented in Exhibit B on a per-task basis. Project invoices will be submitted to the City allocating incurred labor and expense costs at the task level. Consultant travel to the City will be at the request of the City, and will be a reimbursable expense to be charged against the applicable task. TASK 1 —COMPLIANCE AND REPORTING SUPPORT This element of work will provide regulatory reporting and permit coordination for landfill post closure operations. Work will include assisting the City with the preparation of routine reports for submittal to CCEHS, to the Washington State Department of Ecology (DOE) and other regulatory agencies. Reporting will be compiled so as to achieve compliance with the Landfill Post Closure Permit and the Criteria for Solid Waste Facilities (WAC 173-351). Professional Services Agreement, Page 3 2/6/2014 SW08-01, Amendment No. 4 Task 1.1 — Groundwater Reports Objective: To assist the City with regulatory reporting related to groundwater monitoring as required by CCEHS and DOE. Activities: 1. Preparation of the Semiannual Groundwater Monitoring Results Reports for 2014 and 2015 (two reports per year). The City will perform the groundwater sampling and provide the Consultant with a copy of all relevant field forms and analytical data. The Consultant will perform the following: a) Compile and maintain a database of the leachate, seawall fluid, and groundwater monitoring analytical results. b) Compare the groundwater data to the groundwater quality standards and perform appropriate statistical comparisons. c) Create time series plots, trilinear diagrams, stiff diagrams, and potentiometric maps. d) Calculate cation/anion balances, groundwater flow directions, and rates of flow. e) Evaluate the leachate and seawall fluid data. f) Prepare a written report, signed and stamped by the Consultant, summarizing the methods, results, and recommendations for the monitoring program. g) Provide a CD with the written report that includes electronic deliverables of source files. 2. Preparation of the Annual Groundwater Monitoring Reports for 2013, 2014, and 2015. The annual reports will be prepared by the Consultant and will include the following for both the 351 and 304 compliant landfill cells: a) A summary of engineering and monitoring activities for the previous year. b) Tables of the leachate, seawall fluid, and groundwater monitoring results. c) Comparison of the groundwater data to groundwater quality standards, and notification of any exceedances. d) Review of time series plots for select leachate indicator parameters. e) Statistical comparisons and notification of any exceedances of the Upper Prediction Limits (UPLs), or statistical increases in analyte concentrations. f) Analysis of well geochemistry based on trilinear plots of major element composition, stiff diagrams, and cation/anion balance. Professional Services Agreement, Page 4 215/2014 SW08-01, Amendment No. 4 g) Calculation of groundwater flow rate and direction based on potentiometric surface contour maps of groundwater level data. h) An evaluation and recommendation of leachate indicator parameters to be used for subsequent statistical analyses. i) Update of UPI-s to include recent groundwater quality data. j) A summary of the results and recommendations for subsequent monitoring activities. k) A CD that includes electronic deliverables of source files. Assumptions: 1. The City will collect all groundwater samples and will contract for all required laboratory analyses. The City will provide the Consultant with copies of all laboratory and field data sheets for the sampling period. 2. One round of comments from the City will be required to finalize the Semiannual and Annual reports. In addition, there are likely to be comments from the regulatory Agencies to which Consultant must respond. 3. The results of the semiannual reports will be discussed via a conference call and a meeting will be held with the City to discuss the results of the annual reports. The seawall was constructed in 2006 and 2007, and the monitoring and maintenance requirements are detailed in the Post-Closure Plan, Appendix 13, Operations and Maintenance Plan for Toe Protection and Beach Nourishment. Activities: 1. Review of pre- and post- project transects, and transect analysis reports. Review of visual inspection reports and vertical and oblique aerial photography. 2. Compile a single report summarizing the 2012, 2013, and 2014 beach survey transect data, including a summary of the 2012 beach nourishment. Professional Services Agreement, Page 5 2/5/2014 SW08-01,Amendment No. 4 3. Technical support in negotiations with the Corp of Engineers regarding permitting issues. 4. Preparation of the 2015 Annual Beach Morphology Monitoring Report. The Annual Report will analyze all transect data, visual inspection data and aerial photography to determine the changes in beach morphology due to the seawall. Make recommendations for replacement of beach nourishment material, if necessary. Assumptions: 1. The City will contract separately with the surveyor to provide transect data. Data will be provided to the Consultant. 2. The City will provide visual monitoring data to the Consultant. 3. The City will contract separately for aerial photography, and will provide the data to the Consultant. 4. A beach monitoring site visit will be made by the Consultant on an annual basis (2014 and 2015). 5. One round of comments from the City will be required to finalize the Beach Survey Transect Summary Report and the 2015 Annual Beach Morphology Monitoring Report. Deliverables: Draft and final versions of the following reports: Pre-construction Beach Morphology Monitoring Report 2015 Annual Beach Morphology Monitoring Report Task 1.5— Operations Support for the Landfill Gas (LFG) System Objective: To assist the City with the operation and maintenance of the LFG collection system, flare system, leachate collection system, and other related engineered systems. Activities: 1. Review the LFG collection system monitoring data, including blower and flare performance, following each event (monthly). Analyze the LFG collection data to optimize methane collection and flare operations. 2. Recommend target flows for each of the individual LFG collection points during the next event via email each month. 3. Provide a quarterly status update summarizing LFG collection efforts in the 304- and 351-compliant landfill cells. The quarterly memoranda will include descriptions of the following: a. Work performed during the reporting period; b. Results of performance analysis, including the following (as necessary): i. LFG migration monitoring and control; ii. LFG collection monitoring and concentrations; iii. Leachate monitoring and control; and iv. Cover system monitoring and maintenance. c. Recommendations, including the following (as necessary): L Strategic changes in LFG collection; ii. Strategic changes in flare operations; and iii. Equipment modifications, repairs, and/or upgrades. 4. Annual site visit to inspect the condition of the LFG collection and leachate collection systems. Assumptions: 1. Includes up to one additional as-needed site visit per year(2014 and 2015). 2. Includes a contingency for response to cell stabilization effects on LFG collection and/or flare operations. Deliverables: Monthly e-mail deliverables.
