WATER MAIN MONITORING AND CONVEYANCE OF PUBLIC FACILITIES
LOWER ELWHA KLALLAM TRIBE
to the
CITY OF PORT ANGELES
FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, LOWER ELWHA
KLALLAM TRIBE ("TRIBE") hereby grants, bargains, sells, and conveys to the CITY OF PORT
ANGELES ("CITY") the following described utility facilities as agreed under easements recorded
with Clallam County Auditor under AFN 2010 1247041 and 2010-1247374 and located in
CLALLAM COUNTY, WASHINGTON: municipal waterline installed during construction of the
Elwha Valley Road Project.
MUNICIPAL WATER MAIN MONITORING: In EASEMENT AGREEMENT with the CITY (AFN 2010-
1247041) the TRIBE agreed to annual leak detection monitoring on the CITY water main located
within the Elwha Valley Road Project. The last monitoring cycle was completed by Clallam
County in May, 2012. The TRIBE will complete an additional monitoring cycle December 17,
2012. If new leaks in the CITY municipal water main are found during this monitoring cycle the
TRIBE will repair the waterline within the Elwha Valley Road Project at no cost to the CITY.
CONVEYANCE of utilities constructed includes CITY municipal water main and telemetry within
the Elwha Valley Road Project. Conveyance of new construction includes municipal water main
with cathodic protection described as follows:

In making the conveyance, the undersigned warrants to the CITY that all claims for labor
materials, or taxes, and other indebtedness that might b8a lien against said public facilities,
have been paid, and further guarantees to the CITY for the period of twelve (12) months from
the date Of this instrument, that the said public facilities be free nf defects in labor and
materials.
The undersigned further warrants to the CITY that they own said public facilities free and clear
of all encumbrances, and have full right, title, and right tO dispose ofsame.
