between the City of Port Angeles, a non-charter code city of the State of Washington,
(hereinafter called the "CITY") and Herrera Environmental Consultants a Washington
Corporation authorized to do business in the State of Washington (hereinafter called the
"CONSULTANT").
NOW, THEREFORE, in consideration of the representations and the terms, conditions,
covenants and agreements set forth in the original AGREEMENT and this
AMENDMENT, the parties hereto agree as follows:
SECTION 1
The CITY entered into the existing AGREEMENT with CONSULTANT on December 9,
2011, (the AGREEMENT), Amendment No. 1 on March 13, 2012, Amendment No. 2 on
June 19, 2012, Amendment No. 3 on March 28, 2013, Amendment No. 4 on July 16, 2013,
Amendment No. 5 on November 17, 2013 and Amendment No. 6 on January 21, 2014,
SECTION 2
I. AMENDMENT SCOPE OF WORK
The scope of professional services to be performed and the results to be achieved by the
CONSULTANT are hereby amended by adding the tasks identified in the attached Exhibit
A7 to Amendment 7. The CONSULTANT shall provide and furnish all services and
material necessary to accomplish the additional work identified in Exhibit A7.
11. TIME OF PERFORMANCE
The work identified in Exhibit A7 shall be completed by December 31, 2015.
111. MAXIMUM COMPENSATION
The maximum compensation in Section V of the Agreement is amended to $3,364,057, an
increase of $426,000. Budgets for each Subtask are in Exhibit B7 to Amendment 7. The
budget for any Subtask may be adjusted upon mutual agreement between the two parties
without an AMENDMENT to the AGREEMENT, as long as the maximum compensation
amount of $3,364,057 is not exceeded.

This Amendment, including its exhibits, constitutes the entire Amendment, supersedes all
prior written or oral understanding related to the subject of this Agreement, and may only
be changed by written agreement by both parties. The following exhibits are hereby -made
part, of this Amendment:

Except as modified herein, the original AGREEMENT is confirmed and ratified. In
WITNESS WHEREOF, the parties hereto have executed this Amendment No.7 to the
Agreement as of the date and year written above.

Amendment 7 provides a scope of services, and associated budgets, for design team support to
the City during the Landfill Cell Stabilization construction phase. Design support shall include
review of Contractor submittals on proposed material components of the improvements,
interpretation of design intent when questions might arise, evaluation of proposals for changing
the design, observation of construction work for specific design elements, communication and
meetings as needed, and final revisions to the grading plan, final cover design, leachate
collection design, and surface water system once excavation is complete and all contaminated
soil at the bottom of the 304 cell has been identified. A more complete description of these
services is presented below.
The design team (CONSULTANT) covered by this amendment includes Herrera Environmental
Consultants (principal designer), BHC Engineering (structural design, landfill cover system),
Aspect Consulting (geotechnical design, MRE wall), and. PRDW Ltd. (Coastal Engineering,
seawall modifications).
Construction is intended to begin in May 2014 and to be complete in December 2015.
Subtask 33 — Design Engineering Services during Construction
33.1 Design Engineer Construction Services
Objective:
Provide field and office engineering services to the City during the construction phase of the Port
Angeles Landfill Cell Stabilization project.
Activities:
The Consultant will respond to City, Construction Manager (CM) and general contractor
questions and address day-to-day construction related issues, as requested. All contractor
communication will be routed through the CM. Services shall include review and comments on
Construction Contractor (Contractor) submittals, technical interpretation of the contract drawings
and specifications as requested in Requests for Information (RFI), review of substitution
requests, and change order related services, as well as telephone consultation. The scope of
services does not include review or participation in Claims.
33.13 Site Visits
Activities:
Lead design staff will conduct periodic site visits to review the progress and quality of
construction and/or provide services to the City related to the resolution of construction related

issues. Site visits may include attendance at weekly construction meetings, or coordination
meetings as requested by the CM. Typically the Consultant will attend weekly construction
meetings by phone.
Provide on-site construction observation during installation of MIZE buttress, bulkhead walls and
rock revetments, final cover systems, and Dry Creek structures.
Assumptions:
Frequency of site visits will vary depending on construction activities and project status. The
Consultant and the City will agree on a mutually acceptable schedule. The Construction Manager
may also request a site visit. The Consultant may use the Construction Manager's on-site office.
The budget assumes 60 staff-person site visits.
Deliverables:
Site visit memoranda will be prepared when applicable with electronic copies sent to City and
the CM. Memoranda will discuss field observations and identify any specific construction issues.
33.1.2 ASubmittaal Reviews
Activities:
Submittals will be reviewed for general conformance with the project design concept and
compliance with the information and design requirements specified in the contract documents.
The Consultant will perform these services within 20 calendar days following Consultant receipt.
Submittal review comments will identify the corrections, modifications, additions required, and,
if appropriate, reasons as to why the submittal does not comply with the specifications. Should
any submittal be found to be substantially deficient, Consultant may reject the submittal without
markups, while giving written examples of major deficiencies as the cause for rejection. Written
responses, in the form of written comments and/or marked-up submittals, will be transmitted to
the CM via a submittal transmittal/comment form and supplemented by mark-ups of hard copy
submittal documents when required for clarity or as may be consistent with the CM procedures.
The Consultant will maintain a submittal file in their office.
Specific submittal reviews that are outside the scope of this Amendment include: Contractor's
Injury and Illness Prevention Program, Site Specific Health and Safety Plans, Contractor's
Applications for Payment, and construction schedules.
Assumptions:
Submittals shall be packaged and sent directly to the Consultant's designated respondent by the
CM.
The CM will provide initial review to the extent of screening of incomplete submittals.

CM will develop and maintain a submittal logging system and provide access to the Consultant
for purposes of Consultant tracking.
Task Deliverables:
Submittal reviews on submittal forms, supplemented by mark-ups of hard copy submittal
documents when required for clarity.
Subtask 33.1.3 — Review and Response to RFI's
Activities:
Review BFI's as requested by the Construction Manager (CM). Proposals will be reviewed for
general conformance and compatibility with the project design concept and for compliance with
the information and design requirements specified in the contract documents. The Consultant
will provide to the City a recommendation or commentary on the request.
RFI's will be reviewed and written responses provided on appropriate RFI forms within 7
calendar days following Consultant receipt except when a longer time has been agreed in
advance due to unusual complexity.
Assumptions:
BFI's shall not include calculations and other submittal items (i.e. pipe support calculations,
which are considered a shop drawing submittal) or design changes.
Task Deliverables:
Written or verbal responses to requests for information or design clarifications which may
include drawings, specifications, and cost estimates.
Subtask 33.1.4 — Change Order Assistance
Objective:
Provide service to the City regarding change proposal review and development of change orders.
Activities:
Review change proposals and develop required information for change orders involving the
technical content of the design. If work under this task requires a design modification, Consultant
will notify the City of the proposal's cost and time to complete. The City may consider the cost
of the design change and any savings and may authorize the work. If authorized by City,
Consultant will prepare necessary drawings and supporting information.
Assumptions:
The CM will prepare the actual change order document incorporating Consultant provided
technical requirements.
Budget assumes 15 change order requests that will be packaged into 6 unique change orders,

Written or verbal responses to requests for information or design clarifications which may
include drawings, specifications, and cost estimates. Drawings and sketches will be prepared if
required for approved proposals.
Objective:
Final revisions to the grading plan, -final cover design, leachate collection design, and surface
water system once excavation is complete and all contaminated soil at the bottom of the eastern
cell of the 304 landfill has been identified.
Activities:
Revised plans and specifications will specifically address the following issues. A construction
estimate will be included to assist in negotiating a change order with the Contractor, should a
change order be required.
a. Revise 304 cell cover interface with final grades
b. Revise 304 cell leachate collection system
c. Revise 304 cell surface water system
d. Revise 304 cell landfill gas system if needed
e. Revise 351 cell cover with final grades if needed
f. Revise 351 cell surface water system if needed
g. Revise 351 cell landfill gas system if needed
Assumptions:
City will provide new topographic survey of final refuse removal excavation surface for
incorporation into cast cell 304 Landfill closure system revisions.
Task Deliverables:
Revised drawings, associated specifications, and estimated costs of 304 Cell and 351 Cell
closure systems.
312 Subconsultant Support during Construction
Objective:
Subconsultant design team members will provide engineering support during construction in the
areas of their expertise and design responsibilities.
Activities:
General assignments of subconsultant support are as follows:
1. BHC, structural and civil engineering, will perform selected submittal review and design
modification support relative to their design responsibilities. Design responsibilities
include landfill cover system, landfill gas system, leachate collection system, and seawall

end protection concrete panels. Site visits will be required occasionally during
construction. BHC will be involved in the 304 cell post-excavation design update, for
tying in the leachate system to the final cover design and other details.
2. Aspect, geoteclinical engineering, will make site visits and review submittals related to
the MR E buttress bentonite/ soil mixing for the low permeability soil, and aggregate
specifications.
3. PRDW will review submittals and respond to RFIs related to the seawall modifications.
