In Genera�-
When considering the decision to prosecute or file a case, the City Attorney's office will not be
influenced by race, gender, religion, or creed.
The City Attorney's office may decline to prosecute a charge that is supported by probable cause
if:
1. Considering all of the admissible evidence and legitimate potential defenses, a reasonable
finder of fact would not find that the defendant committed the offense.
2. Prosecution would be clearly contrary to legislative intent.
3. The alleged violation is de minimis, i.e., the violation is only technical or insubstantial
and deterrent purpose would be served by prosecution.
4. The defendant is currently confined, or is facing confinement, that is of such a lengthy
period that conviction of the new offense would not result in any additional direct or
collateral consequences.
5. The cost of prosecution is disproportionate to the importance of prosecuting the offense.
6. The complainant is motivated by improper purposes.
7. The defendant is granted immunity in exchange for their assistance in the prosecution of
a more serious offense.
8. The victim voluntarily requests that charges be dismissed or not be filed.
Fefiordes-
All cases referred by the Prosecutor's office must be thoroughly reviewed and vetted
before charges are filed. If there is probable cause for a felony, but the prosecutor declines to file
it because of a lack of history or resources, the City Attorney's office must carefully review the
case before filing the charges. Drug and property crimes will be routinely returned to the
prosecutor. Crimes of violence against people may be filed as misdemeanors in lieu of a felony
only with the approval and signature of the City Attorney.
When the Prosecutor's office declines a felony because they do not believe the probable
cause supports a felony, the City Attorney's office will carefully review the case. If the City
Attorney's office agrees that the case is a misdemeanor, the City Attorney's office will file the
case in District Court. Should the City Attorney's office disagree with the Prosecutor's office,
the City Attorney's office will communicate openly with the Prosecutor's office. These cases
will be handled on a case by case basis.

Absent extraordinary circumstances, the City Attorney's office will decline to file any
shoplift case valued at less than $300. Individuals with little or no prior history will be referred
to diversion. The goal in any shoplift case is recovery of the merchandise or restitution for the
merchant. When saleable merchandise is recovered, the City Attorney's office may allow stores
to handle shoplift cases as civil matters.

The City Attorney's office will refer DWLS 3 cases to diversion to encourage defendants
to re-instate their drivers' licenses. After a referral back from diversion, absent extraordinary
circumstances, the City Attorney's office will file all DWLS 3 cases as NVOL infractions up to
and including the fifth case.

Absent extraordinary circumstances, the City Attorney's office will decline to file
criminal trespass 2 charges.
Crum naafi Trespass p;
Absent extraordinary circumstances, the City Attorney's office will decline to file
criminal trespass 1 charges that occur in public locations like stores, banks, and commercial
offices. The City Attorney's office may file criminal trespass 1 charges when the defendant is
located in a residence or a closed business.

Absent extraordinary circumstances, the City Attorney's office will decline to file use of
paraphernalia charges. Most often, these charges are in lieu of felony possession charges and are
more appropriately handled as possession of a controlled substance.

For all cases referred by law enforcement prior to charging, the City Attorney's office
will review the case carefully before filing charges. The City Attorney's office will not file any
charge that is not supported by probable cause. And, the City Attorney's office will carefully
consider public safety and the City's budget when making charging decisions.

The City Attorney's office will carefully review all cases directly filed by the Port
Angeles Police Department and will dismiss any case that is not supported by probable cause.

The City Attorney's office will also refer to the Prosecutor's office any case that is more
appropriately filed as a felony. The City Attorney's office will also carefully consider and
dismiss any case when in the best interests of the City.
For A Cases-
The City Attorney's office will be mindful of public safety and the City's budget when
pursuing all cases. The City Attorney's office will prioritize cases so that crimes against people,
DUIs, and other crimes with a high hazard potential take precedent over crimes against property.
The City Attorney's office will consider a defendant's ability to pay before requesting legal
financial obligations, with the exception of restitution. In all cases, the City Attorney's office
will seek justice and the good of the City.
ffiversioin
The City Attorney's office will make full use of diversion and refer as many cases as
possible to diversion for resolution outside the judicial system. The City Attorney's office will
not use diversion when it will undermine public safety.
Stipulated Order oir Continuance
The City Attorney's Office will use SoCs sparingly and when appropriate to resolve
cases. SoCs are disfavored by the court and should only be used when appropriate.
Drug Court
The City Attorney's office will recommend and support drug court in all cases when it is
appropriate.
Mental health Court
Mental Health Court is available to defendants whose criminal conduct is primarily
motivated by mental illness. Defendants in this program receive mental health care and
medications to help ensure lawful behavior. Participation in mental health court requires an
evaluation by the DCMHP.

The City Attorney's office will carefully consider the appropriate suspended time in addition to
the appropriate sentence. In cases with no affirmative conduct requirements, the City Attorney's
office may request fewer suspended days.

The City will make the following recommendations on all offenses involving the use of alcohol
or a controlled substance and the operation or control of a motor vehicle.
