COVENANT RUNNING WITH THE LAND,
This Covenant is executed in favor of the City of Port Angeles("City")by the
undersigned owner(s)("Grantor")of the real property and improvements defined in Exhibit A
(the"Property"and"Improvements")on behalf of Grantor and Grantor's heirs, successors,and
assigns. The Property is located at 920 East 10th Boulevard;parcel number 0630000336250000.
The undersigned warrants that Grantor has bargained for and negotiated this Covenant
with the City,it is supported by adequate consideration,including the settlement agreement of

A. ACKNOWLEDGEMENT

Grantor acknowledges that the Improvements encroach into a City right-of-way.
B. PERMISSION TO CONSTRUCTION
As part of this settlement,the City will allow a single reconstruction in the City's right of
way of a substantially similar structure in the same footprint as the Improvements damaged
March 2015. Grantor will need to secure all necessary permits and comply with all land use
policies not specifically addressed in this Agreement.
C. AGREEMENT TO REMOVE
Grantor agrees to remove the Improvements from the City right of way at Grantor's
expense within sixty(60)days written notice from the City Director of Public Works and
Utilities(Director)or his or her designee should the City find it necessary to modify or improve
the underlying right of way. If the required work is not done in a timely fashion or if the work
does not meet the requirements and conditions set forth by the Director's notice,the City is
authorized to have the work done and the cost thereof including reasonable overhead and
attorney's fees.shall become a civil debt of the property owner and shall be a lien against the
property.
D. DUTY TO INFORM
Grantor,on behalf of Grantor and Grantor's heirs,successors, and assigns,agrees to
provide a copy of this Covenant to any prospective purchaser, lessor,occupant,or assignee of the
Property prior to closing, assignment,tenancy,or occupancy.
E. RECORDING
This Covenant shall be recorded in the real estate records of Clallam County,
Washington.
F. RUNNING COVENANT
The parties intend that this Covenant touches and concerns the land, shall run with the
land,and be binding on Grantor and on Grantor's heirs, successors,and assigns.
