In Recognition of
Billy Frank Jr. Day
WHEREAS, In celebration of Billy Frank Jr.’s legacy and in recognition of his tireless dedication
to the rights of the Native people of Washington, we wish to honor him as one of
the great stewards of the land.
WHEREAS, He fought for treaty rights to fish the waters of the Pacific Northwest, a battle he
finally won in 1974 to save the salmon that had fed his family for generations .
WHEREAS, Today, thanks to his courage and determined effort, our resources are better
protected, and more tribes are able to enjoy the rights preserved for them more
than a century ago.
WHEREAS, Billy Frank Jr. never stopped fighting to make sure future generation s would be
able to enjoy the outdoors as he did, and his passion on the issue of climate change .
WHEREAS, He believed that if fish can’t live, neither can we and he dedicated himself to
everyone’s children not just his own.
WHEREAS, Billy Frank Jr. was an honored elder and Nisqually tribal member, as well as
Chairman of the Northwest Indian Fisheries Commission for over 30 years.
WHEREAS, The recognitions he received include the Presidential Medal of Freedom
posthumously from President Obama and the Albert Schweitzer Prize for
Humanitarianism.
NOW, THEREFORE, I, Patrick Downie, Mayor, ON BEHALF OF THE CITY COUNCIL
OF PORT ANGELES, do hereby RECOGNIZE March 9th as Billy Frank Jr. Day in honor of an
internationally known Native leader and Nisqually Tribal Elder. May we look with great
admiration to inspiring individuals like Billy Frank Jr. and follow the past for the sake of our future.

PROCLAMATION
In Recognition of
Mr. Fowler Stratton & the Stratton Family
WHEREAS, On February 20,2016,the community lost a leader,an advocate for the Port Angeles community,
and a volunteer who served in multiple fashions for more than 10 years. That community leader
was Mr. Fowler Stratton; and
WHEREAS, Fowler Stratton was born in Port Chester, New York, on June 22, 1941. He attended Bucknell
University and graduated from the University of Dubuque in Iowa with a bachelor's degree in
business. His business career was in advertising sales with DuPont, Good Housekeeping
Magazine, and Blair and Ketchum's County Journal. In 1975, Fowler relocated to Coldspring,
Texas, to own and operate The Sailboard Marina on Lake Livingston. Fowler enjoyed sailing
throughout his life. In 1992, he married his wife Julia,who passed away in 2015.
WHEREAS, Fowler Stratton and his lovely bride Julia moved to Port Angeles in 2005. Although Fowler was
not a Port Angeles native,he embraced this community and he gave countless hours volunteering
because he loved Port Angeles and everything it represents. And, as much as he loved Port
Angeles,Port Angeles and everyone he came in contact with loved him back; and
WHEREAS, Fowler Stratton served the City of Port Angeles by sitting on the Parks, Recreation &
Beautification Commission for eight years, the Lodging Tax Advisory Committee for three
years, and was on the Board of Directors for the Port Angeles Fine Arts Center.
WHEREAS, Fowler Stratton also volunteered and served in many other ways.He was President of the Friends
of the Library, a supporter of the Port Angeles Symphony Orchestra, active at the Port Angeles
Senior Center, and was instrumental in getting the pickleball courts developed at Elks Playfield.
WHEREAS, On the pickleball court, Fowler's serve was legendary.
WHEREAS, To honor Fowler's commitment to volunteerism, his advocacy of the Port Angeles area, and all
he did for the community,the City of Port Angeles would like to recognize Mr. Fowler Stratton
for all of his achievements.
NOW, THEREFORE, I, PATRICK DOWNIE, MAYOR, ON BEHALF OF THE CITY COUNCIL OF
PORT ANGELES, THE LODGING TAX ADVISORY COMMITTEE, AND THE PARKS,
RECREATION &BEAUTIFICATION COMMISSION, do hereby HONOR and CELEBRATE the life

Terry Gallagher
WHEREAS, Police Chief Terry Gallagher began his law enforcement career in 1985 when he joined the Port
Angeles Police Department, soon after serving as the City's first Drug and Alcohol Resistance
Education(DARE) officer. As a DARE officer,Terry's devotion to the youth of the community
began and has continued to this day. Throughout his career he has supported innovative and best
practice programs including the School Resource Officer,the Downtown Resource Officer, the
Olympic Peninsula Drug Task Force and Police K-9 programs.
WHEREAS, his dedication to public safety extended into neighboring communities as he pursued uniting efforts
through regionalization in order to merge the administration and operations of two large and
complex 911 dispatch centers.
WHEREAS, Chief Gallagher understood the current fiscal crisis and the negative impact this has had on his
department's resources and proactively met the issue head on. In securing outside funding and by
trimming costs, Chief Gallagher was able to maintain the fundamental necessities that were critical
to maintaining a high level of public safety in the community.
WHEREAS, through his commitment to high educational standards, Chief Gallagher has emphasized the
importance of continued education to improve individual skills and maintain a department that
employs the best and most suited for the job at hand — people who always strive to be the best they
can be.
WHEREAS, Chief Gallagher sought out new technology in order to maintain the highest standards,his
department deployed a vast array of new equipment and software to improve performance and
above all,provide excellent public safety. Projects that included New World records, mobile data
and computer aided dispatch technology, and the waterfront camera project.
NOW, THEREFORE, I,Patrick Downie,Mayor, ON BEHALF OF THE CITY COUNCIL OF
PORT ANGELES, and Dan McKeen, City Manager, ON BEHALF OF THE CITY STAFF, with great
appreciation for his service to the community do hereby APPROVE the retirement of Terry Gallagher. His public
service, dedication to his position as Chief, and quick wit will be greatly missed by all. May others be blessed by
your humorous spirt from this day forth and may we never read your name in the headlines again.

Deputy Mayor Kidd called the special meeting of the Port Angeles City Council to order at 5:33 p.m.
ROLL CALL:

EXECUTIVE SESSION:
Based on input from Attorney Bloor, Deputy Mayor Kidd announced the need for an Executive Session, under the
authority of RCW 42.30.110(1)(i) for the purpose of discussing potential litigation with legal counsel, for
approximately 15 minutes with no action to follow. The Executive Session convened at 5:34 p.m.
RETURN TO OPEN SESSION:
The Executive Session concluded at 5:46 p.m. No action was taken.

ORDINANCES NOT REQUIRING PUBLIC HEARINGS:
1. Franchise Ordinance
City Attorney Bill Bloor said that the Franchise Ordinance came about as part of the Wave Cable franchise renewal
process that staff began working on in 2014. He said that as part of the renewal process, staff found that the City’s
current municipal code is silent about many issues related to franchises. The ordinance is intended to amend and
update the City’s current ordinances to include franchises for television cable systems and open video systems.
Attorney Bloor said these revisions will provide a uniform and consistent framework for granting new franchises
and renewing existing ones, and allows the City to get the very best cable service it can from companies that want to
come in and use the City’s rights-of-ways to make a profit.
Deputy Mayor Kidd conducted a first reading of the ordinance by title, entitled,
ORDINANCE NO. 3550
An ordinance regulating the occupancy and use of public rights-of-way by television cable systems and open video
systems, providing for establishment of customer service standards; establishing franchise and licensing
requirements for operators of such systems and prescribing terms, and conditions for and upon the construction,
maintenance, and repair of such systems; amending Chapters 11.08 and 11.14 of the Port Angeles City Code, all
relating to television cable systems and open video systems.
Deputy Mayor Kidd continued the ordinance to February 16, 2016.
OTHER CONSIDERATIONS:
1. Clallam County Economic Development Corporation Funding
Community & Economic Development Director Nathan West said City Council requested that staff provide detailed
information regarding partnering with the Clallam County Economic Development Council in 2016. At the last
Council meeting, none of the options provided by staff received the necessary votes to move forward. A consensus
of Council requested that the issue be discussed again at the following meeting which is why new options for
funding the EDC were being brought forward. Council discussion followed.
It was moved by Collins and seconded by Gase to:
Draft a contract with the EDC for a base amount of $10,000 from the restricted economic development account
special project funds.
Motion carried 4-3, with Whetham, Bruch and Merideth opposed.
It was moved by Collins and seconded by Bruch to:
Extend appointment of Orville Campbell to EDC Board and Opportunity Fund Advisory Board until the end of
February.
Motion carried 7-0.

FINANCE:
1. Landfill Bluff Stabilization Project Settlement Change Order
Public Works & Utilities Director Craig Fulton said that during the Landfill Cell Stabilization work, the contractor
encountered asbestos containing materials far in excess of the amounts anticipated. The materials required special
handling, for which Magnus was entitled to additional compensation. The amount of the compensation was
disputed. To address that, the parties agreed to mediation. He said in the course of the mediation, the parties reached
a proposed final settlement with Magnus Pacific on all outstanding claims. Council discussion followed.
It was moved by Bruch and seconded by Merideth to:
Ratify the Settlement Agreement by approving and authorizing the City Manager to sign change order #12 to the
Landfill Cell Stabilization Contract (Project SW0212) with Magnus Pacific Corporation in the amount of $300,000
including tax, increasing the total contract amount to $14,540,552.64.
Motion carried 6-1, with Whetham opposed.
2. Server Replacements (IT0614)
Chief Financial Officer Byron Olson said the purchase of the servers was approved as part of the Information
Technology Strategic Plan and was included in the 2016 budget. He said the City is moving to virtual servers for
better savings and more storage space. The old servers will be used in a testing environment. Council discussion
followed.
It was moved by Bruch and seconded by Whetham to:
Move forward with this hardware purchase under Washington State Contract through IBM/Lenovo business partner
Nordisk Systems.
Motion carried 7-0.
Deputy Mayor Kidd recessed the meeting for a 10 minute break at 7:44 p.m. The meeting reconvened at 7:53 p.m.
CITY COUNCIL REPORTS:
Councilmember Whetham said he was sorry that public comment had been cut short.
Councilmember Gase said he attended a PA-CAN meeting last week. Mark Nichols and Chief Gallagher were at
that meeting to help with issues related to drug abuse and crime. Gase thanked both leaders for attending and
speaking with concerned citizens. He also attended the Economic Development Corporation dinner.
Deputy Mayor Kidd said she also attended the EDC dinner, and she went to the dedication of the Community
Memorial Wall in honor of Vern Burton.
Councilmember Bruch asked that the public be notified in advance when public comment would be shortened.
She attended the Association of Washington Cities (AWC) conference and said that our legislators are working
really hard and have their constituents’ best interests in mind.
Mayor Downie also attended the AWC in Olympia. He said he enjoyed the opportunity to meet with the City’s
representatives. He noted that the Council meeting includes a second public comment period, so he did not feel that
discussion or comments had been limited during the Council meeting.
No other reports were given.
INFORMATION:
Director West spoke about a request from the Feiro Marine Life Center to have Councilmember Bruch represent
Council on a new committee, the Feiro Marine Life Center’s City Pier Master Plan Stakeholder committee. Director
West asked for Council consideration of the request.

Council agreed by consensus to appoint Councilmember Bruch to the Feiro committee assignment.
Manager McKeen spoke regarding the reports included in the packet, highlighting the 911 Regionalization Study,
“thank you” letter to Polar Pioneer, and the Council Committee, Board & Commission Assignments.

Socrata Open Budget Presentation
Chief Financial Officer Byron Olson introduced Senior Finance staff members Linda Kheriaty, Sherry Wright and
Tess Agesson who conducted a presentation on the City’s new Open Budget software which will allow the public to
access the City’s financial data information.
CFO Olson noted that after the Finance Department rolls out Open Budget, next will be Open Books and Open Payroll.

CEREMONIAL MATTERS, PROCLAMATIONS & EMPLOYEE RECOGNITIONS
1. Proclamation for Dennis McBride
Mayor Downie and Public Works & Utilities Director Craig Fulton honored Dennis McBride, Fleet Manager, with a
proclamation and a Superior Service award for his 30 years of service to the City of Port Angeles. Mr. McBride
thanked everyone for the opportunity to serve the City for so many years.
PUBLIC COMMENT:
City Manager Dan McKeen spoke about Public Comment guidelines contained in the Council Rules of Procedure. He
noted there had been a mistake when the most recent version of the Rules of Procedure was drafted, in which the “15
minute” guideline for public comment periods had been omitted in error. Staff reviewed information that was
presented to Council in July 2015 when the body adopted a second public comment period. In reviewing memos and
minutes as well as listening to the audio recording of the July meeting, staff reaffirmed Council’s wishes to add a

second public comment period to all agendas with comments limited to no more than three minutes per person, and a
total of 15 minutes for each comment period, with the Mayor’s discretion to lengthen or shorten . Manager McKeen

ORDINANCES NOT REQUIRING PUBLIC HEARINGS:
1. Franchise Ordinance
City Attorney Bill Bloor noted that it would be a second reading of ordinance. He said that there had been a couple of
changes to format since the first reading on February, 2, 2016 , but no substantive changes. Attorney Bloor said that
the ordinance primarily sets a framework for how the City will proceed with franchises in the future.

AN ORDINANCE regulating the occupancy and use of Public Rights-of-Way by Television Cable Systems and
Open Video Systems, providing for establishment of customer service standards; establishing Franchise and
licensing requirements for Operators of such systems and prescribing terms, and conditions for and upon the
construction, maintenance, and repair of such systems; amending Chapters 11.08 and 11.14 of the Port Angeles City
Code, all relating to Television Cable Systems and Open Video Systems.
It was moved by Gase and seconded by Merideth to:

OTHER CONSIDERATIONS:
1. Formation of Board of Ethics to Review Complaint
Manager McKeen said that on February 4, 2016 the City received a complaint that invoked Chapter 2.78 of the Port
Angeles Municipal Code of Ethical Conduct. He said the City Clerk sent the complaint to the full Council, City
Attorney and City Manager as directed by the Municipal Code. He said Council was to take the next steps in the
complaint process which is to choose a 3-person board to review the complaint.
Manager McKeen spoke about the requirements for the Board of Ethics, saying that the composition of the
3-member board is to be made up of at least one member who is a former judicial officer or has expertise in ethics
acquired through education or experience. At least one member shall have experience in municipal government.
The third member may be any of the preapproved applicants.
Council ranked their top three choices in each category.

CFO Olson gave results of the tabulation, noting that 3 points were given for each first choice, 2 points for each second
choice, and 1 point for each third choice.

It was moved by Gase and seconded by Merideth to:
Approve Grant Meiner, Danetta Rutten and Frank Prince as top vote obtainers as tabulated by City staff.
Motion carried 5-0 with Deputy Mayor Kidd abstaining.
2. Proposed Ad Hoc Committee to Explore Fluoridation Alternatives
Manager McKeen said that at Council direction, he met with Councilmembers Bruch and Collins about the proposed
structure for an ad hoc committee to explore fluoridation alternatives. He said that structure and a proposed
membership to the committee was being presented to Council for consideration.
Councilmember Bruch stated the goal of the committee was to bridge the divide that exists in the community related
to the issue of fluoridation, and to look for viable alternatives that recognize the importance of oral health in the
community. She said they had decided to select two people “for” water fluoridation, two “against” water fluoridation,
two neutral members and one member from the Utility Advisory Committee. Collins added that the committee would
not vote on anything, that they would have to arrive on something via consensus, otherwise they would not be
recommending anything to Council. He said that whatever alternative might be identified, Council would have to
wrestle the question of funding. Councilmember Collins noted that Dr. Chris Frank had declined to be on the
committee. Council discussion followed.
Council agreed by consensus to move forward with the ad hoc committee structure proposed by Councilmembers
Bruch and Collins.
FINANCE:
1. Department of Ecology Stormwater Grant Acceptances
Public Works and Utilities Director Craig Fulton outlined three water quality stormwater grants offered to the City by
the Department of Ecology (DOE). Council discussion followed.
It was moved by Kidd and seconded by Bruch to:
Accept three grants from DOE on behalf of the City – A $50,000 Stormwater Capacity grant with no local match to
implement and manage the City’s Western Washington Phase II Municipal Stormwater NPDES Permit; a $474,300
Water Quality Combined Financial Assistance grant with a 15% local match to design and construct a Decant Facility
at the Port Angeles Regional Transfer Station; a $461,250 Water Quality Combined Financial Assistance grant with
a 25% local match to construct two Green Low Impact Development Alley’s with per meable pavement; and to
authorize the City Manager to sign the agreements and to make minor modifications as necessary.
Motion carried 6-0.
CITY COUNCIL REPORTS:
Councilmember Gase said he attended the Chamber of Commerce board meeting and that the Chamber’s new
executive director is on board and making great progress.
Councilmember Bruch said she had received many positive comments on the new street signs that honor Klallam
tribal history by having the name of the streets in both English and Klallam.
Councilmember Merideth said he had received a call thanking the City for the Officer in downtown Port Angeles.
No other reports were given.
INFORMATION:
Manager McKeen spoke regarding the joint City Council and Tribal meeting that is scheduled for 5 p.m. on March
23, 2016 at the Elwha Klallam Heritage Center. He said the agenda for that meeting will be out soon.

Manager McKeen said staff will work with the 3-member Board of Ethics to find a time for them to review the
ethics complaint. He also noted that staff will provide support to the fluoridation ad hoc committee under direction
of Councilmembers Bruch and Collins.

SUBJECT: Lodging Tax Event Grant Awards
Summary: The City Lodging Tax Committee considered seventeen (17) event grant
applications for Lodging Tax Funding. The Committee has forwarded a recommendation
to City Council for consideration.
Funding: In accordance with the Revised Code of Washington, the Lodging Tax Advisory
Committee must provide recommendations to City Council for the use of Lodging Tax funds. The
Committee has proposed $520,491 in expenditures to coincide with an anticipated $521,000 in
revenues for 2016. On November 17, 2015 City Council approved these recommendations and
directed staff to prepare budget amendments reflecting the recommendations. A total of $70,000
was allocated for event grants as part of the Council approved lodging tax expenditures.
Recommendation: 1.) Award 2016 event grants and Authorize the City Manager to execute
Lodging Tax Event Grant contracts.
Background/Analysis
In January of 2016 City staff advertised an opportunity for Lodging Tax Event Grants. The
application was posted on the City website, advertised in local media sources, and provided
directly to past recipients of City event grants. The deadline for receiving the grants was
February 18, 2015. A total of seventeen (17) applications were received. On February 25, 2015,
the City Lodging Tax Committee reviewed the grant applications and provided a unanimous
recommendation for City Council approval. Committee member Vicki Heckman recused herself
from consideration as she was the proponent of one of the applications.
The table on page 2 of this memorandum lists each event that applied and the dates associated
with their proposed event. A total of $104,000 in grant requests were received. Based on City
Council’s November 17, 2015 Lodging Tax Fund allocation the Committee was limited to a total

award of $70,000. Only one grant request was not awarded. An application for a concert at the
Extreme Sports park did not received funding due to funding allocated to other aspects of that
event.
Applications were reviewed based on the criteria established in State Statute. These criteria
included overall attendance, number of people traveling more than fifty (50) miles to attend,
number of people staying overnight, and number of paid room nights projected.
This year was considered a transition year with policy changes being made based on LTAC
Committee and City Council input. Changes included:
1. Incentivizing and placing more emphasis supporting new events, and events occurring
outside the peak tourist season (Mid-September through May);
2. Transitioning established events towards self-sufficiency (Longstanding events with a
history of City subsidy should anticipate a decrease in funding);
3. Placing a funding cap on all events (Transition in 2016 with full implementation in
2017);
4. Focusing on demonstrated positive lodging impacts.
In review of the Lodging Tax Committee’s recommendation staff recommends that City Council
award the grants in accordance with the table found in attachment A to this staff report. It is
further requested that the City Manager be authorized to execute and sign contracts with each of
the event grant recipients. Staff is available to answer additional questions.
Funding Overview: The Lodging Tax Fund is derived from a 4% tax on all charges at hotels,
motels, and other overnight lodging establishments. The Lodging Tax Committee has
recommended a total of approximately $520,491 in expenditures to coincide with a projected
$521,000 in revenues. No use of reserves is anticipated. The fund balance as of February, 2016
was $694,570. A total of $70,000 was allocated for event grants as part of the Council approved
lodging tax expenditures.

SUBJECT: 2016-2017 LODGING TAX ADVISORY COMMITTEE APPOINTMENTS
Summary: LodgingTax Advisory Committee (LTAC) appointments expire at the end of
February of each year. In order to continue the implementation of Lodging Tax related efforts in
2016 the City needs to maintainactive Committee participation.
Funding: NA
Recommendation: Re-appoint six (6) representatives to the Lodging Tax Advisory Committee
for terms ending February 28, 2017.
Background / Analysis:
At thistime all positions need to be filled. In accordance with the Port Angeles Municipal Code
terms of the positions for the Lodging Tax Advisory Committee are for one year expiring February
28th of each year. City staff began advertising for positions in February of this year and two
Citizen-at-large vacancies remain with one additional position to be appointed by the PA Forward
Committee. Membership is structured to have specific representatives for collectors, recipients
and citizens-at-large. Remainingpositions have been advertised as open until filled.
Maintaining an active Committee is important to ensure review of measurable performance on
LodgingTax related contracts and expenditures. The Committee strives to meet at least quarterly
to receive updates on current tourism related trends and activities.
TheCommitteereviews, comments and makes recommendations to the City Council on activities
and/or facilities to be funded by lodging excise tax revenues. The Committee is composed of nine
members. Staff recommends that Council approve the recommended appointments to the Lodging
Tax Advisory Committee for terms ending February 28, 2017 as indicated on page 2 of this
memorandum. Additional appointments are anticipated as applications are received.

Summary: Due toexpiring terms and one resignation, as of March 1st, there will be six
vacancies on the Planning Commission without re-appointment of two individuals and the
appointment of four new individuals.
Funding: NA
Recommendation: 1.) Re-appoint Brian Hunter and Duane Morris to serve a second term on
Planning Commission. 2.) Interview applicants Bailey, Gee, Mathews and Schwab and appoint
as appropriate to unfilled Planning Commission seats.
Background / Analysis:
At this time six seats on the PlanningCommission need to be reappointed or filled. In accordance
with the Port Angeles Municipal Code Chapter 2.36, Commissioners serve four yearterms.
Terms are required to bestaggered to ensure nomore than two Commission members expire in the
same year. Appointments will need to reflect that staggering. Appointments are recommended as
follows:

Questions:
Why are you interestedin serving on this particular Board or Commission?
My main interest is in helping the city council to direct the development and growth of the
city. Additionally to assistin guidance for the city council and city residents to provide a well
planned and aesthetically pleasing living environment. I have lived in and near small towns for
almost 50 years, during that time I have witnessed growth that has been sometimes appropriate
and well planned , in other instances growth has overpowered the planning process. I would like
to see Port Angeles maintain its heritagewhile providing for the well being of residents, their
children and grand children.
What in your background or experience do you think would help you in serving on this board?
There are three main areas that will be helpful in my serving as a commissioner.
1. My past education and professional experiences are paramount. My specialty throughout
my life has been theoutdoor environment of people, its appropriateness, how itfunctions and its
aesthetic effects. I graduated from, Cal Poly State University, one of the most respected
Architecture and Planning Universities on the west coast. My 21 years as a business owner and my
experience in landscape construction and designcan be of benefit in my service. I havebeen a real
estate broker and have broad knowledge of land ownership issues, land uses, ordinances, zoning
and the planning process that occurs in a city. Being self - employed with success in business
management and construction has honed my ability to make decisions. I have taught design and
construction at the university level for 17 yearsand enjoy the opportunity to share my knowledge
and experience.
2. 1 have been a volunteer in several different capacities throughout my career. Most
important might be my service as a member of the Architectural Review Commission for the City
of San Luis Obispo from 1988 -1992. l served as the ARC committee chairperson for 1 -1/2 years. My
experience in working on the San Luis Obispo Downtown General Plan Review Committee and
Tree Committee has provided added exposure to city issues and solutions. I have also beenactive
in the California Landscape Contractors Association and the Association of Professional Landscape
Designers serving on various committees and officer positions on both the state and national
levels. I spent a number of years in the Obispo Beautiful Association.
3. In the course of activities I have been fortunate to travel extensively throughout the United
States and also internationally which has provided me with an enormous resource of experiences
and knowledge upon which to draw.

What is your understanding of the responsibilities of this particular Board or Commission?
The Planning Commission makes decisions concerning and for the benefit of, City residents,
businesses, and property owners. Some actions are recommendations to the City Council, some
are final. The commission also reviewslong range planning issues (General Plan) for City
development, land use, zoning and recommends action to the City Council. The commission also
hears appeals from actions taken by the Planning Department.
The commissions concern will be for where people live, work, play, how travel is accomplished, the
quality of the environment and providing safe surroundings within the City limits. Emphasis is
placedon ethical conduct and activity and the appearance of such. Within its duties and objectives
commissionersshould keep in mind sensitive areas, conservation of resources, and the best
interests of the community while beingsensitive to individual, business and public input during the
hearing process.

One concern for all commissioners is the amount of time required to serve on the commission.
While I am retired from the California University system I do still teach landscape computer
graphics and train in on -line courses. My teaching /trainingcommitment only takes about 12 -20
hours per month which leaves me with plenty of available time.
I would very much appreciate the opportunity to serve for the Council as a planning commissioner
and bring my experience and knowledge to the commission in an effort to have a better
community for existing and future city residents.
I would be happy to meet with city officials /representatives and answer any additional questions
that may be of importance.

RESOLUTION NO.
ARESOLUTION of the City Council of the City of Port Angeles,
Washington, affirming and ratifying the Declaration of
Emergency issued by the City Manager on February 23, 2016.
WHEREAS, a Declaration of Emergency was issued by the Acting City Manager on
February 23, a complete copy of which is attached; and
WHEREAS, City Council has reviewed the facts and circumstances that prompted the
Declaration of emergency.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Angeles:
The Council hereby finds that the facts recited in the Declaration are true and correct.
On the basis of those facts, the Council finds and declares that the break of an 8-inch cast
iron water main at the end of 11th and Cedar Street constituted an emergency in the City of
Port Angeles.
The City Council affirms and ratifies (1) the Declaration of Emergency issued
by the Acting City Manager on February 23, 2016, and (2) all actions authorized by that
Declaration.
PASSED by the City Council of the City of Port Angeles at a regular meeting of said
Council held on the 1st day of March, 2016.

DECLARATION OF EMERGENCY
Dan McKeen, the City Manager of the City of Port Angeles find that the following facts
exist:
1. The City incurred an 8-inch cast iron water main failure at the end of I 1'h and Cedar
Street. The alignment of this pipe goes down a steep ravine and under Tumwater Creek. The main
break was located at the top of the ravine and washed out a large portion of the hillside exposing
approximately 70 feet of water main.
2. The failed segment of pipe is a critical component to the City's water distribution
system. There are two cast iron water mains that distribute water to approximately 300 customers
within the Pine Hill area. Both water mains were installed in 1955 and have similar alignments.
Repairing this main break is critical to maintain water quality and distribution redundancy,
eliminating the risk all 300 customers in the area could be without water.
3. Due to the severity of the main break, its location, and current lack of water
redundancy, an emergency is present which may necessitate activation of the City of Port Angeles
Comprehensive Emergency Management Plan, including utilization of emergency powers granted
pursuant to RCW 35.33.081 and RCW 38.52.070(2).
Now, therefore, by the authority granted to me under State law and by the City Council, we

Summary: A complaint invoking the City’s Code of Ethical Conduct was filed on February 19,
2016. This one alleges that Deputy Mayor Cherie Kidd and Councilmember Dan Gase violated
that code. This is the second of two complaints that center on events that transpired at Council’s
February 2, 2016 meeting.
The Port Angeles Municipal Code directs that Council assemble a three-member Board of Ethics
to receive, investigate and make recommendations for disposition of the complaint. On February
16, Council chose Grant Meiner, Danetta Rutten and Frank Prince from a pool of pre-approved
applicants to serve on the Board of Ethics to review the first complaint. That board is scheduled
to meet on March 8, 2016.
Funding: N/A
Recommendation: City Council should select a Board of Ethics to review this second
complaint. Council may select a Board with different members from the Board formed on
February 2. Alternatively, since both complaints allege similar ethics violations from the same
City Council meeting, Council may appoint the same three-member board to review both
complaints. In either case, this action requires a supermajority vote of Council.
Background/Analysis:
On February 19, 2016, a complaint was filed against Deputy Mayor Cherie Kidd and
Councilmember Dan Gase alleging that they had violated the City’s Code of Ethical Conduct as
outlined in Chapter 2.78 of the Port Angeles Municipal Code. As directed by the ordinance, the
City Clerk forwarded the complaint to the City Attorney, City Manager and the full Council.

This is the second of two complaints filed in past three weeks. The first complaint was filed on
February 4, 2016. Both complaints allege that one or more Councilmembers violated the ethics
code during the February 2nd City Council meeting.
As outlined in the Code, Council is to take the next steps:
1. Choose three members from a pool of preapproved applicants to make-up the Board of
Ethics. The Board must be chosen by a supermajority vote.
2. Forward the complaint to the Board of Ethics to investigate and make recommendations
for disposition. The Board’s findings will be forwarded to the Council.
Selection Process
The composition of the 3-member board is to be made up of at least one member who is a former
judicial officer or has expertise in ethics acquired through education or experience. At least one
member shall have experience in municipal government. The third member may be any of the
preapproved applicants.
At its February 16, 2016 meeting, Council approved Grant Meiner, Danetta Rutten and Frank
Prince from a pool of pre-approved applicants to serve on the Board of Ethics Board to review a
complaint received on February 4th. That board is scheduled to meet on March 8, 2016.
Because both ethics complaints center on events that happened at the February 2nd Council
meeting, Council may find it appropriate to appoint the same three member board to review both
complaints. The Port Angeles Municipal Code directs that Council assemble a three-member
Board of Ethics to review any complaints received against a public official. However, there is
nothing in the code that prohibits Council from assigning the same three members to review a
second complaint. From a practical standpoint, the board(s) would be reviewing identical
meeting minutes, audio recordings, and possibly testimony.
If Council chooses not to appoint the same three-member board, staff recommends Council use
the same process as it did at the last meeting:
1. Review applications from the Board of Ethics members who were preapproved by
Council to serve in this capacity.
2. Rank your top three choices within each of the three categories: judicial/ethics,
municipal, and citizen-at-large.
To assist with your selection, staff has noted applicants that have experience in one or more of
the areas required. We have also included a ranking sheet. After the Council has stated their
choices for the record, we recommend that Council break for 10 minutes to allow staff time to
tabulate the results. City Council then will be given the opportunity to structure the committee as
you desire, providing only that the final selection be approved by supermajority.

Review of the Ordinance

to review how this process works and suggest modifications and adjustments to the ordinance
that could simplify the process and make it procedurally more effective. These suggested
changes would be brought to Council for consideration at a future meeting after we’ve gone
through the full process.

to the grinders.
1975-1977:1 worked in the yard department. My duties includeddriving fork|i0s, unloading hoi8Mt.
Hauling four foot woodawayfrom the aavvmiU, movingmotore, emptyinggerboge, and driving chip
trucks, as well as bob cat's and sweepers.
1977-1987:During this ten year period | Worked in the shipping warehouse. | loadingpaper rolls into
trucks and unloading all kinds of freight for the mill . | alsoloaded and unloadedPaper and pulp barges. |
also spent a good doe| of time loading and unloading railcars. | have driven both diesel and gas hystany.

1892-2002: This ten year period | worked in the Recycle plant as e shift operator, we provided recycled
stock(pulp) whichwasmade from recycled newnpaper, phonebooksand magazine's for the rest of the
mill. We producedabout 200 tons m day, | was in charge of and responsible for two otheremployees that
helped merun the facility as well as the quality and production of the plant. | controlled the product

SUBJECT: Interlocal Agreement for Emergency Dispatch Services between the
City of Port Angeles and JeffCom
Summary: On August 4, 2015 the City Council passed Resolution #11-15 authorizing the Police
Chief to explore consolidation of the administrative functions of Peninsula Communications
(PenCom) with Jefferson County 9-1-1 (JeffCom) and the future consolidation of the two dispatch
entities into a regional 9-1-1 communication system. Both PenCom and JeffCom have continued
their joint exploration of the regionalization concept and have agreed to a shared management and
administration merger as a necessary first step toward further exploration of the concept. The
attached Interlocal Agreement will join PenCom and JeffCom under a single administration model
and appoint Karl Hatton as PenCom/JeffCom 9-1-1 Regional Emergency Communications
Director. Both Jefferson County and City of Port Angeles attorneys have reviewed and approved
the Interlocal Agreement. The Jefferson County Advisory Board signed the Interlocal Agreement
at their regular meeting of February 17, 2016. The PenCom Advisory Board endorsed the
agreement by unanimous vote at a special meeting held February 22, 2016. The Public Safety
Advisory Board endorsed this proposal at their meeting of February 24, 2016.
Funding: A budget explanation prepared by City of Port Angeles Finance Department staff is
attached.
Recommendation: Authorize the Mayor to sign the Interlocal Agreement for Emergency
Dispatch Administrative Services between the City of Port Angeles and JeffCom appointing
Karl Hatton as Regional Emergency Communications Director so that further exploration
of the concept of 9-1-1 center regionalization can continue.
At the regular meeting of the Port Angeles City Council on August 4, 2015, Resolution 11-15
was passed endorsing the concept of regionalized 9-1-1 emergency dispatch and authorizing the
Police Chief to further explore the issue in partnership with Jefferson County.

At the February 2, 2016 meeting of the City Council the council was presented with a state-
funded report authored by ADCOMM Engineering Company that further explored
regionalization of the 9-1-1 dispatch function on the Olympic Peninsula. The ADCOMM report
was intended to “determine the feasibility of providing regionalized 9-1-1 service to Clallam and
Jefferson Counties, with the intent of improving efficiency while sustaining or improving
effectiveness.”
Both PenCom and JeffCom understand that regionalization of the 9-1-1 dispatch function may be
in the best interest of their respective client agencies. Both also understand, however, the
complexity of such an undertaking and the need to proceed at a pace and in a manner that the
different jurisdictions find acceptable. Both JeffCom and PenCom have agreed to further explore
regionalization by implementing Alternative #1 as identified in the ADCOMM Engineering
study.
ADCOMM Alternative #1 identified shared management and administration as a logical first
step in carefully reviewing the feasibility of regionalization, the options available for
consolidation, actual benefits, cost implications, and potential obstacles.
PenCom and JeffCom recognize that regionalization may benefit both jurisdictions. The most
significant of these benefits include enhanced public safety through the 9-1-1 centers ability to
share resources, coordinate responses, increase interoperability, and the possibility of more
effective and efficient service by eliminating duplicate costs.
The extent of the potential benefits will vary, however, depending on the specific regionalization
model implemented of the five (5) identified by ADCOMM (e.g. full consolidation of 9-1-1 and
dispatch, communication systems and related technology, partial consolidation, co-location, or a
hybrid solution). Further influences will include the political environment and the respective
standards and expectations of the respective communities in regards to public safety services.
JeffCom and PenCom have committed to the continued examination of inter-agency shared
facilities, networks and applications, technologies, staffing, and more in an effort to someday
provide their communities with the latest technologies, the most effective operations, and the
most reasonable costs. The attached Interlocal Agreement is the result of many hours of work to
help ensure that the first step in the process is successful. It represents many hours of good-faith
effort on the part of JeffCom and PenCom management. It is a statement of mutual trust on the
part of the respective management teams and the governing bodies of both organizations in the
commitment of all involved to seek solutions that are in the best interest of the public we serve.
All involved deserve credit for the progress made to date.
PAPD currently budgets $15,400.00 per year for a management assistant position. That
employee is retiring and the position will be eliminated. The duties of that employee will be
assigned to the new Regional Administrative Coordinator (RAC) position that will be filled by
Steve Romberg once Karl Hatton assumes the Regional 9-1-1 Director position. The $15,400.00
will then be applied to fund about 18% of the RAC position. This represents a 0.20 reduction in
the PAPD employee count while maintaining General Fund obligations at the current level (no
reduction). The balance of the RAC salary and benefit package of $72,200.00 will be borne by

PenCom. The salary allocation costs between PenCom and JeffCom is a negotiated number that
reflects the anticipated tasks and duties of the RAC.
Total Proposed Staffing salary and benefit costs are a $28,400.00 reduction from the Current
Staffing salary and benefit costs of JeffCom and PenCom. The bottom line is that if council
approves the Interlocal the City of Port Angeles will not realize any budget savings or increases;
PenCom will realize a $10,600.00 cost increase; JeffCom will realize a $39,000.00 cost savings.
JeffCom will use the $39,000.00 savings in-part to fund a vehicle and related transportation
expenses for Hatton in his position as Regional 9-1-1 Director in that Hatton will be required to
travel between Port Townsend and Port Angeles on a regular basis. Any funds not expended on
the acquisition and operation of the vehicle will be applied to the increased administrative and
legal costs anticipated to result from the administrative merger. PenCom 2016 user fees will not
be affected by the $10,600.00 increase. Post-2016 user fees will reflect actual budget costs in
accord with the normal PenCom user fee allocation formulae.

INTERLOCAL AGREEMENT
FOR EMERGENCY DISPATCH ADMINISTRATIVE SERVICES
BETWEEN THE CITY OF PORT ANGELES
AND JEFFCOM
This Agreement is made, pursuant to RCW 39.34.030--part of the Interlocal Cooperation Act as of the date of
the last signature affixed below, between the CITY OF PORT ANGELES (“City”), a Washington Municipal
Corporation, and JeffCom (hereinafter "the Contractor"), a Washington Municipal administrative agency
created by Jefferson County, the City of Port Townsend, and Jefferson County Fire Protection Districts 1
through 5. Herein, the City and Contractor may collectively be referred to as “the Parties.”
In consideration of the mutual covenants and promises described herein the City of Port Angeles and
Contractor recite, covenant, and agree as follows:
Section 1. Recitals.
1. Currently, both the City and Contractor operate separate, independent E911 emergency dispatch
centers. The Parties are pursuing a span of regionalization alternatives for emergency communications
and dispatch, ranging from shared services and interoperability to consolidation, for the mutual benefit
of both Parties and the citizens and agencies they serve.
2. Contractor currently employs Karl Hatton (hereinafter “Hatton”) as Director of its dispatch operations.
The Parties agree that Hatton possesses the expertise, skill, talent, and abilities needed to manage both
existing emergency dispatch centers, and to facilitate the evaluation and implementation of future
organizational and operational changes as may be agreed by each Party.
3. For the purposes described above, and as further detailed in this Agreement, the Parties hereby agree to
jointly use the services of Hatton in accordance with the terms and conditions stated in this Agreement.
Section 2. Employee Services.
Beginning on the effective date of this Agreement, and continuing so long as this Agreement is in effect,
Hatton shall hold the position of Regional Emergency Communications Director for both Jefferson and
Clallam counties. In that capacity he shall direct the operations of both the City’s current dispatch center and
Contractor’s current dispatch center, and he shall also take such steps as are necessary and appropriate to
coordinate and implement the Parties’ mutually-agreed policy direction for organizational and operational
changes to further coordinate, share, or consolidate emergency communications and dispatch services in the
two-county region. In performing these services, Hatton shall devote approximately one-half his time to the
City’s dispatch center and one-half to Contractor’s dispatch center. Additional provisions describing the tasks
and duties to be performed by Hatton are set out in Attachment A, attached hereto and incorporated herein by
reference, as if set out in full.

Section 3. Hatton’s Employment Status.
1. Hatton is currently a full-time, regular employee of Contractor. For convenience of the Parties and
Hatton, after the effective date of this Agreement, Contractor shall continue to administer the
employment relationship with Hatton. This is intended to mean that Contractor will continue to pay
Hatton the full amount of wages and benefits that Hatton earns for full performance under this
Agreement, and in doing so, Contractor will fully satisfy all obligations the City would otherwise owe
to Hatton for providing such services to the City. Pursuant to Section 5 below, the City shall reimburse
Contractor for the City’s share of the cost of employing Hatton.
2. After the effective date of this Agreement, Hatton shall continue to be a regular employee of
Contractor. In addition to the services he will perform in accordance with Section 2 above, he shall
have all the duties, rights, and authorities he currently has. After the effective date of this Agreement,
Hatton shall provide services directly to the City, in accordance with the terms and conditions set forth
in this Agreement. In that capacity, while he is acting on behalf of the City in the role of Director of
Pencom, Hatton shall be subject to direction and supervision of the Port Angeles Chief of Police,
provided that any issues pertaining to his performance, if not resolved between the Police Chief and
Hatton, shall be taken up with the JeffCom Board, his Employer.
3. For purposes of regionalization activities, Hatton shall report to and be subject to the supervision and
direction of both the Port Angeles Chief of Police and the chair of the JeffCom Administrative Board
acting on behalf of the JeffCom Administrative Board. The Port Angeles Police Chief and chair of the
JeffCom Administrative Board will operate in good faith to reach agreement on regionalization tasks,
in consultation with the PenCom Advisory Board and JeffCom Administrative Board, in providing
direction to Hatton.
4. For purposes of the administration of this Agreement, which does not create any new legal entity, for
Contractor the Agreement shall be administered by the JeffCom Administrative Board, and for the City
it shall be administered by the Chief of Police.
Section 4. Term.
The effective date of this Agreement is March 1, 2016 or the date of the last signature affixed to this
Agreement, whichever is later, and shall continue until its expiration at the end of December 31, 2016, unless
terminated earlier than its expiration date, as provided in Section 6 and Section 7 below. The term of this
Agreement may be extended by the mutual written agreement of the Parties.
Section 5. Compensation.
1. Compensation to the Employee: For the purposes of administering his wages, payroll deduction,
benefits, and similar matters, Hatton shall remain an employee of Contractor with all wages and health
benefits currently provided by Contractor. Contractor shall assume full responsibility for payment of
all Federal, State, and local taxes or contributions imposed or required, including, but not limited to,
unemployment insurance, Social Security, and income tax.

2. Consideration paid by City: The City will reimburse Contractor for the cost of employee’s salary and
benefits for the term of this Agreement at a rate of $70,000 per year. The rate will be increased
annually by the annual Seattle-Tacoma-Bremerton CPI-W published in June of each year. Contractor
will invoice the City for payment once a quarter and the City will pay within 30 days of the invoice
request.
Section 6. Breach.
1. In the event of either party's material breach of the terms or conditions of this Agreement, the non-
breaching party reserves the right to withhold payments or services until corrective action has been
taken or completed. However, the party shall not exercise this right until they have given written notice
of such material breach to the breaching party and ten days have passed since the receipt of such notice.
This option is in addition to and not in lieu of the parties' right to terminate this Agreement or any other
right that Washington State law offers for breach of contract.
2. If either party shall materially breach any of the covenants undertaken herein or any of the duties
imposed upon it by this Agreement, such material breach shall entitle the other party to terminate this
Agreement, provided that the party desiring to terminate for such cause shall give the offending party at
least twenty days' written notice, specifying the particulars wherein it is claimed that there has been a
violation hereof, and if at the end of such time, the party notified has not removed the cause of
complaint, or remedied the purported violation, then the termination of this Agreement shall be deemed
complete.
Section 7. Termination.
1. Either party may terminate this Agreement in accordance with the termination provisions set out in
Section 6 above.
2. In the event this Agreement is terminated prior to its expiration date as defined in Section 4, a final
payment shall be made to the Contractor, which, when added to any payments previously made, shall
reimburse the Contractor for costs actually incurred as of the date of termination. Final payment shall
not include compensation for loss of anticipated income. Except for the final payment, no additional
payment shall be due or owing to the Contractor on any grounds whatsoever. As a substantial element
of the consideration for the City entering into this Agreement, the Contractor hereby waives and
relinquishes any right, claim or cause of action for additional payment, unless otherwise mutually
agreed to in writing by the Parties. As of the date of termination, all rights and obligations of the
Contractor to the City, and of the City to the Contractor, shall cease and determine.
3. Either party may terminate this Agreement at will upon sixty (60) days written notice to the other party.
Section 8. Dispute Resolution.
The parties agree that any dispute related to this Agreement shall first be submitted to the Contractor
and the Port Angeles Chief of Police, and they shall attempt to resolve that dispute. If they are not able
to resolve that dispute, the dispute shall next be submitted to the City Manager and to the Contractor’s
Board Chair. Those individuals shall attempt to resolve the dispute. If they are not able to resolve the
dispute, the dispute shall be submitted to mediation. The parties shall agree on one mediator. If

mediation is unable to resolve the dispute, then either party may take such legal action as they deem
appropriate. The venue of any lawsuit related to this Agreement shall be in Clallam County,
Washington.
Section 9. Jurisdiction
This Agreement shall be construed and interpreted pursuant to the laws and precedents of Washington
State.
Section 10. Indemnification / Hold Harmless
Contractor shall defend, indemnify and hold the City, its officers, officials, employees and volunteers
harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out
of or resulting from the acts, errors or omissions of Hatton while performing services for Contractor.
The City shall defend, indemnify and hold the Contractor, its officers, officials, employees and
volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees,
arising out of or resulting from the acts, errors or omissions of Hatton while performing services for the
City.
Section 11. Insurance
Each party shall procure and maintain for the duration of the Agreement, such insurance as each deems
appropriate against claims for injuries to persons, damage to property and other liabilities that may
arise from or in connection with the performance of the work hereunder by Hatton.
Section 12. Entire Agreement
This Agreement for the provision of professional services constitutes the entire agreement between the
parties with respect to the subject matter thereof, and supersedes all prior written agreements and all prior or
contemporaneous oral agreements or understandings between the parties.
Section 13. Record Keeping and Reporting.
Each party shall maintain records and reports adequate to demonstrate the numbers of hours Hatton
devotes performing services for the party, a description of the services performed, and the progress
achieved on regionalization activities. These records shall be provided to both Parties on a quarterly
basis.
The Parties shall cooperate by facilitating audits of Hatton’s performance under this Agreement during
the first quarter of every year to assure that the purposes of this Agreement are being fulfilled.
Section 14. Change in Personnel.
The Parties agree and understand that Hatton is an at-will employee of Contractor and thus the Parties
agree that if Hatton leaves the Contractor’s employ for any reason, the Parties will meet and discuss the
implications for this Agreement.

ATTACHMENT A
SCOPE OF WORK
For Jeffcom: Hatton will continue to perform all the duties and reporting relations pursuant to his terms
of employment with Jeffcom as they existed prior to this Agreement, as may be mutually amended by
Jeffcom and Hatton, and as supplemented by this Agreement.
For the City: Under direction of the Police Chief, Hatton will plan, direct, and manage the
Communications Division of the Port Angeles Police Department. This includes Peninsula
Communications (PenCom), the Department's centralized 9-1-1-communication center that is responsible
for Police, Fire and medical dispatch for most of Clallam County. PenCom agencies include the City of
Port Angeles, City of Sequim, Clallam County Sheriff’s Office, Local Fire Districts, Tribal law
enforcement, and Olympic National Park. Duties and work will include:
1. Assign and supervise the work of subordinate personnel in the communications center, including a
comprehensive training program for dispatchers.
2. Oversee the development and management of the communications division operating budget and
provides periodic reports to PenCom agencies.
3. Oversee the preparation of technical reports in a complete and timely manner relative to the activities of
the City’s centralized communications center.
4. Assure compliance with all regulations, rules, standards, and agreements related to the communication
center operations and personnel.
5. Establish and maintain effective working relationships with representatives of the contracting agencies,
the general public, and other City departments.
6. Serves as Chairperson for the PenCom Advisory Committee.
7. Monitor the interagency agreements and prepares necessary statistical and financial reports to
coordinate each agency activity and revenue charges.
8. Participate in the planning and design of various area communication systems, assuring compatibility,
system integration, and future capability and expansion.
9. Maintain relationships with computer software vendors and the Clallam County data processing staff,
identifying and communicating software problems and offering potential solutions.
10. Maintain the following knowledge and skills:
• Principles, procedures, rules and regulations involved in the operation and maintenance of
communication equipment.
• Emergency service programs and procedures, including Fire, Law Enforcement and EMS.
• Technical aspects of modern electronic computer applications, record systems, and office procedures.
• Modern management and supervisory practices and techniques.
• Police and Fire dispatch and records programs.
• Emergency dispatch console equipment.

• Various radio systems, including repeater and simulcast systems, remote base stations, voting
receivers, trunking, and mobile data terminal technology.
• Ability to establish and maintain effective working relationships with fellow employees, contract
agencies, and the public.

• Ability to prepare written reports of a technical matter in a clear, concise manner.

1. Provide quarterly reports to the Port Angeles Police Chief, the PenCom Advisory Board, the
JeffCom Board Chair, and the JeffCom Administrative Board that account for work time and
provide information on projects and matters important to the management of JeffCom 9-1-1 center,
PenCom 9-1-1 center, and all tasks or duties accomplished towards the goal of enhanced
regionalization of 9-1-1 services between Jefferson and Clallam counties.
2. Perform tasks oriented towards enhanced regionalization of 9-1-1 services as mutually assigned by
the JeffCom Board Chair and Chief of Police, consistent with the policy directions of the Jeffcom
Administrative Board and the City with input of its PenCom Advisory Board.
