PROJECT SW08-01 RELATING TO: PORT ANGELES LANDFILL POST-CLOSURE CONSULTING ENGINEERING SERVICES AND PERMIT COMPLIANCE SERVICES THIS AMENDMENT NO. 5 is made and entered into by and between the City of Port Angeles,a non-charter code city of the State of Washington, (hereinafter called the"CITY") and Aspect Consulting, LLC., a Washington Corporation authorized to do business in the State of Washington (hereinafter called the"CONSULTANT"); The CITY entered into an AGREEMENT with the CONSULTANT on October 27, 2008, (the AGREEMENT). The AGREEMENT was amended on September 15, 2009 (Amendment 1), February 15, 2011 (Amendment 2),January 17,2012(Amendment 3),and January 21,2014(Amendment 4). WHEREAS, the CITY desires to amend the AGREEMENT to extend the duration of the services to be provided,and to provide additional budget. NOW, THEREFORE, in consideration of the representations and the terms, conditions, covenants and agreements set forth in this AMENDMENT, the Agreement is hereby amended as follows: I. REVISED SCOPE OF WORK The scope of professional services to be performed and the results to be achieved by the CONSULTANT pursuant to the AGREEMENT shall be amended to include the attached Exhibit A5 to Amendment 5. Exhibit A5 is in addition to Exhibit A of the original AGREEMENT and to all other AMENDMENTS. The Scope of Work shall include all services and material necessary to accomplish the work. 11. TIME OF PERFORMANCE The City requires additional time for compliance and monitoring support activities, and the Consultant has agreed to continued effort. Therefore, the time of performance in Section IV of the original Agreement is amended to read: The duration of the Agreement shall extend through April 30, 2017. III MAXIMUM COMPENSATION Professional Services Agreement SW08-01, Page I Amendment No.5 The CONSULTANT'S total compensation and reimbursement are stated in the attached Exhibit B5 of this Amendment. The maximum compensation amount,referenced in Section VI of the Agreement, is amended from $632,747.64 to $736,717.20, an increase of $103,969.56. The budget for any Task may be further adjusted by mutual agreement without an amendment to the Agreement, as long as the maximum compensation amount of $736,717.20 is not exceeded. Exhibit B5 is in addition to Exhibit B of Amendment 4. IV EXHIBITS AND SIGNATURES This Amendment, including its exhibits, constitutes the entire Amendment, supersedes all prior written or oral understandings, and may only be changed by a written amendment executed by both parties. Bo or, City Attorney Professional Services Agreement SW08-01 Amendment 5 Professional Services Agreement SW08-01, Page 2 Amendment No.S II$ `A EXHIBIT A5 SCOPE OF WORK BACKGROUND Since May 2014, the Port Angeles Landfill (PALF)has been operating under a modification to the Clallam County Environmental Health Services (CCEHS) Solid Waste Handling Facility Permit(Facility Permit). The modification was issued in order to provide for the implementation of the Landfill Cell Stabilization Project (the Project), which involved the relocation of approximately 400,000 cubic yards of waste from the 304 Landfill to the 351 Landfill, along with modifications to the existing seawall, a mechanically reinforced earth(MRE)slope on the face of the Valley Cell behind the seawall, a new cover system, modifications to the access road, habitat improvements to Dry Creek, and modifications to the leachate, landfill gas, groundwater monitoring and storrnwater systems. Regulated Post-Closure Activities include environmental monitoring, inspection, maintenance,reporting and recordkeeping, and emergency reporting. Aspect has been supporting the City in post-closure compliance prior to the Project and during the Project. The Project was substantially complete in February 2016, and during this period,as the renovated landfill site is transitioning to post-closure maintenance, and as a new modification to the Facility Permit is being processed, it is important to have continuity in the City's support staff. Amendment 5 to the Professional Services Agreement SWOS-01 extends the work in support of PALF Post-Closure Facility Permit compliance through April 2017. The tasks that will be performed as part of this amendment are summarized in the following scope of work. A description is provided for activities that are continuing, and also for new tasks that relate to the newly constnrcted cover system, and the mechanically reinforced earth slope. TASK 1 —COMPLI.ANCE AND REPORTING SUPPORT This element of work will provide regulatory reporting and permit coordination for landfill post closure operations. Work will include assisting the City with the preparation of routine reports for submittal to CCEHS, to the Washington State Department of Ecology (DOE) and other regulatory agencies. Reporting will be compiled so as to achieve compliance with the Landfill Post Closure Permit, the Criteria for Solid Waste Facilities (WAC 173-351) and Minimum Functional Standards for Solid Waste Handling(WAC 173-304). Task 1.1 —Groundwater Reports Objective: To assist the City with regulatory reporting related to groundwater monitoring as required by CCEHS and DOE. Activities: Professional Services Agreement SW08-01, Page 3 Amendment No.5 1. Preparation of the Semiannual Groundwater Monitoring Results Reports for 2016 (two reports per year). The City will perform the groundwater sampling and provide the Consultant with a copy of all relevant field forms and analytical data. The Consultant will perform the following: a) Compile and maintain a database of the leachate, seawall fluid, and groundwater monitoring analytical results. b) Compare the groundwater data to the groundwater quality standards and perform appropriate statistical comparisons. c) Create time series plots, trilinear diagrams, stiff diagrams, and potentiometric maps. d) Calculate cation/anion balances, groundwater flow directions,and rates of flow. e) Evaluate the leachate and seawall fluid data. t) Prepare a written report, signed and stamped by the Consultant, summarizing the methods, results,and recommendations for the monitoring program. g) Provide a CD with the written report that includes electronic deliverables of source files. 2. Preparation of the Annual Groundwater Monitoring Reports for 2016. The annual reports will be prepared by the Consultant and will include the following for both the 351 and 304 compliant landfill cells: a) A summary of engineering and monitoring activities for the previous year. b) Tables of the leachate,and groundwater monitoring results. c) Comparison of the groundwater data to groundwater quality standards, and notification of any exceedances. d) Review of time series plots for select leachate indicator parameters. e) Statistical comparisons and notification of any exceedances of the Upper Prediction Limits(UPLs),or statistical increases in analyte concentrations. f) Analysis of well geochemistry based on trilinear plots of major element composition, stiff diagrams, and cation/anion balance. g) Calculation of groundwater flow rate and direction based on potentiometric surface contour maps of groundwater level data. h) An evaluation and recommendation of leachate indicator parameters to be used for subsequent statistical analyses. i) Update of UPLs to include recent groundwater quality data. J) A summary of the results and recommendations for subsequent monitoring activities. k) A CD that includes electronic deliverables of source files. Assumptions: Professional Services Agreement SW08-01, Page 4 Amendment No.5 I. The City will collect all groundwater samples and will contract for all required laboratory analyses. The City will provide the Consultant with copies of all laboratory and field data sheets for the sampling period. 2. One round of comments from the City will be required to finalize the Semiannual and Annual reports. In addition, there are likely to be comments from the regulatory Agencies to which Consultant must respond. 3. The results of the semiannual reports will be discussed via a conference call and a meeting will be held with the City to discuss the results of the annual reports. Deliverables: Draft and final versions of the following reports: 2016 1"Semiannual Groundwater Monitoring Results Report 20162 d Semiannual Groundwater Monitoring Results Report 2016 Annual Groundwater Monitoring Results Report Task 1.5—Operations Support for the Landfill Gas(LFG) System Objective: To assist the City with the operation and maintenance of the LFG collection system, flare system,condensate collection system,and other related engineered systems. Activities: I. Review the LFG collection system monitoring data, including blower and flare performance, following each event (monthly). Analyze the LFG collection data to optimize methane collection and flare operations. 2. Recommend target flows for each of the individual LFG collection points during the next event via email each month. 3. Provide a quarterly status update summarizing LFG collection efforts in the 304- and 351-compliant landfill cells. The quarterly update will include descriptions of the following: a, Work performed during the reporting period, b. Results of performance analysis, including the following(as necessary): i. LFG migration monitoring and control; ii. LFG collection monitoring and concentrations; iii. Leachate monitoring and control; and iv. Cover system monitoring and maintenance. c. Anticipated work to be performed during the next period; and d. Recommendations, including the following(as necessary): i. Strategic changes in LFG collection; ii. Strategic changes in flare operations; and iii. Equipment modifications, repairs, and/or upgrades. 4. Annual site visit to inspect the condition of the LFG collection and condensate collection systems. Assumptions: 1. Includes up to one additional as-needed site visit per year(2016). Deliverables: Monthly e-mail deliverables. Activities: 1. Assist the City in identifying and documenting changes that may jeopardize integrity of turf cover system. 2. Aid the City in formatting a new section of the Post-Closure Annual Report to include cover system monitoring and maintenance records. Task 1.7—Operations Support for the Mechanically Reinforced Earth(MRE) Slope Objective: To assist the City with first year inspection and maintenance of the new mechanically reinforced earth slope system,and other related engineered systems(i.e. MRE drainage and riprap erosion protection along east end-wall). Activities: I. Assist the City in development of MRE slope inspection procedures, forms, and schedule. 2. Assist the City in selection of photographing locations to document the condition and position of facing units, erosion protection, and other critical system elements over time. 3. Working with a licensed surveyor(surveyor under a separate contract with City), assist the City in selection of permanent survey baseline control points outside of the MRE slope, and in selection of survey hub locations on the MRE slope facing units to document changes in location of the hubs over time. 4. Assist the City in review of initial baseline MRE slope facing survey monitoring data. 5. Review the first year's survey records to assess performance in relation to anticipated range of post-construction settlement. Provide conclusions to City for inclusion in the annual report. 6. Aid the City in formatting a new section of the Post-Closure Annual Report to include MRE slope monitoring and maintenance records. TASK 2—MAINTENANCE SUPPORT This element of work will provide support for unforeseen issues which may develop at the landfill.
