Your proposal for an accessory residential unit located at 616 East 4th Street was approved subject to the
following conditions: .
1. Meeting the permitting and utility requIrements.
2. Meeting the parking requirements for residential uses.
The parking layout has been identified and is sufficient. Public Works and Utilities does not have a record
requesting a water meter or sanitary sewer connection: In referencing the Port Angeles Municipal Code, Chapter
17;08.010 - A, paragraph B. Accessory Residential Unit - a dwelling lplit which is incidental to a detached single
family residence, is subordinate in space (i.e., fifty percent or less space than the single family residential use) and
is located on the same zoning lot as the sipgle family residence. An accessory residential unit is served by water
arid electrical service that is separate from the primary residential service and has a separate address: ,
It appears that there is only one utility billing for both the accessory and primary structures. This does not comply
with all the requirements of yoUr conditional use permit application. . Installation of separate water and electrical
meters is required. Addressing for the second structure should be placed on the building and identified as 616 Yz .
East 4th. You may obtain both water and electrical permits at the building permit counter.

My name is Ken Fox. I hav.e been a resident, and property owner in Port Angele~, Clallam COlmty
since 1977. I was a Port Angeles City Police DetectiveIPolice Officer for ov.er20 years, retiring in 1998.

In August of 1999, I purchased the buildings and property located at 616 EAth St., Port Angeles.
This consisted of a small 80 plus year old two bedroom house, and a two car garage-shop, with a
one bedroom apartment located over the garage-shop.
Prior to my purchase of this property, the previouS owner completed improvements and remodeling to
the interiors of the house and apartment. At the time of my purchase, both thehouse .
and apartment were occupied. .
I obtained a loan through First Federal Bank of Port Angeles to fmance the purchase. The bank
had the entire property and aU buildings appraised. . As required by the bank, titleinsur8nce waS obtained.
In addition, I had all the buildings professionally inspected.
Throughout this entire process. there was never any mention, by anyone, of any irregularities, or areas. of
non-compliance with City codes.
Once the purchase was. completed, I moved into the one bedroom apartment. Several months
later, I rented the two--bedroom house to a single mother with a small child, to supplement my retirement.
Sinceu9te purchase over two years ago,. I have continued to invest in improvements to the buildings and
property Jffu June 2000, I obtained the proper building permits from the city, then installed new roofing on
all the buildings. The grOl.mds aild landscaping are niaintainedin a neat and otderlyfilshion.
The renter owns one vehicle, and there is ample parking. . The renter is employed at a job where
She is away from home half the week. There are three paved off street patkingstalls located next to my
apartment. I am away from my home for extended periods of time. During the past two years of
ownerShip. I have been.gone approximately one year. lwill.continueto be a model citizen and good
neighbor. I will maintain my property, make improvements as needed and continue to always pay my bills. .

This past July 2001,8 former Port Angeles. resident and friend, Dowretir.ed to Florida, .arrived at
my home fora brief visit. This friend fornierly worked inP()rt Angelesfor over 20 years, and was a
huge contributor to the City and County. Notonly does he have numerous friends in the area, but mimy
family members in the Northwest. My friend parked his motor home in one of my offstreet parking stalls.

Shortly after my friend arrived, I received a letter from the City of Port Angeles Planning Dept
informing me of alleged violations with my property . . This was the first time in. over two years since
my purchase, I was aware of any problems..One of the issues was having.a motor. home on my property. I.
immediately made arrangements formy friend to move from my property to anotherlOciltion, which he did
the following day. .
My house and apartment have been occupied and lived in for many years prior to my purchase. Both have
been occupied and lived in since my purchase. lhad no problems or contacts by the City prior to my
friend's arrival. I remedied thatissueimmediately. I have worked with, and been in continuous contact
with the Planning Dept. since receipt of their letter.
I am requesting the issuance of a Conditional Use Permit and or a Variance so I may retain the use of
my rental house and the apartment inwhich I live.

The Building Division has issued (two) 2 building permits for the above mentioned
address.
A re-roof permit # 11993 was issued on 6/1312000, this permit only covered the re-
roof of the main structure and rear building. Upon inspection for the re-roof, it was
found that a new roof over the porch of the rear building had been added. The owner
was notified that a permit was required for the roof addition.
A permit # 12737 was issued on 6/18/2001 for the construction of a new roof over the
deck of the rear building.
Regarding the conversion of the upper portion of the rear building(garage) to living
quarters/ apartment, the Building Division has no record of permits having been
issued.

SUBJECT: Existing Apartment over Garage at 616 E. Fourth Street, Port
Angeles, Washington
An inspection of the above referenced structure was performed on December 28, 2002.
The structure consists of an apartment, R-3 occupancy, over a private garage, U-1
occupancy, of wood framed construction. The apartment has egress and ingress from
an open exterior stairway, which does not enter the garage. The structure was
inspected for general conformance with the requirements of the 1997 Uniform Building
Code. The structure generally conforms to the requirements of the Uniform Building
Code with the following two deficiencies:
a) The garage portion of the structure is not separated from the apartment portion of
the structure with materials approved for one-hour fire-resistive construction on the
garage side of the structure as required per UBC Section 302.4. This will require
the installation.of 5/8", Type X, gypsum wallboard on the ceiling and walls of the
garage and fire taping of the seams.

b) The plumbing vent which exits the apartment on the east gable end of the residence
does not meet requirements of the Uniform Plumbing Code. This vent shall be
extended out and up so it terminates a minimum of six inches above the roof line.
This may be accomplished by connecting to the existing end of the vent with a short
piece of like material and installing a 90 degree elbow and vertical piece that
meets the height requirements noted above. This vent extension may be strapped
to the gable trim such that the vent pipe does not need to penetrate the roof.

Port Angeles Electrical Inspector.

In December 12,2001, Mr. Fox was granted a Conditional Use for an accessory residential unit. The
CUP was approved subject to meeting the permitting, utility and parking requirements for residential
uses. See attached letter dated June 10,2001. It appears that there has been no attempt to comply with
the separation of the water or electrical service requirements, nor has a separate building address been
established for the 2nd structure.
